Order of 7 July 2008 amending the Order of 10 October 2006 establishing an automated processing of personal data relating to the recruitment and management of national gendarmerie personnel

Vu la Act No. 78-17 of 6 January 1978 amended on computer science, files and freedoms, including article 23;
In view of the decree of 20 January 1988 authorizing the National Gendarmerie to register the registration number on the national register for the identification of natural persons in the file of its personnel;
Vu le Decree No. 91-1404 of 27 December 1991 authorizing the use of the National Register of Identification of Physical Persons by Employers in Automated Pay and Personnel Management Treatments;
Vu le Decree No. 2005-850 of 27 July 2005 concerning delegations of signature of members of the Government;
In view of the decision of 10 October 2006 on the creation of an automated processing of personal data relating to the recruitment and management of national gendarmerie personnel;
Considering the receipt number 1113385 of the National Commission on Informatics and Freedoms dated 31 October 2007,

Sections 2 and 3 of the above-mentioned 10 October 2006 Order are amended as follows:
1° Section 2 is replaced by the following:
“Recorded personal data categories are:
I. ― For the recruitment of candidates to a national gendarmerie position:
11. "With respect to data that are subject to automated processing, those related to:
―at identity: quality, sex, surnames, name, title, date, place, department and country of birth, nationality, addresses, telephone numbers, email;
- in the family situation: the candidate (family situation, number of children), the spouse (family name), the parents (birthplace, profession, sector of activity);
―at the military situation: status, grade, date of appointment in grade, weapon, position in respect of national service, current or previous military situation, identification of defence or registration number, history of assignments, office or national service centre, date of commencement and termination of service, date of call for defence preparation, military preparation, current assignment, recruitment officer (region of gendarmerie and posting group, date of entry to military service
- training, diplomas and distinctions: diplomas, qualifications, driver's license, patents, certificates, initial training school, foreign languages practiced and level of knowledge;
― to the application for the appointment: file (possible date of death, candidate number and application, type of application, selection centre, initial account unit, station post code, date of availability, date of application, status of application, candidate number and application, date of general or physical fitness tests, opinion on the application), for the candidates
health: size, date of medical visit, aptitude or inability.
12. With respect to data that are subject to non-automated processing, those relating to:
- identity: photograph, wife name, gendarme identification number;
― in the family situation: the candidate (number of brothers and sisters), the spouse (names, date and place of birth, address, professional situation, situation of the spouse), the parents (name of family, first names, date and place of birth, address, marital status, military parent or ex-military), the guardians (name of family, addresses, profession, relationship of parent, period of birth)
- in the military situation: reservist employment, officer recruitment (reported state and services, punishment and rewards, notes);
― to the application for the undertaking: file (reports of the candidate, current situation, current and previous professions, position of head of business, candidate beneficiary of a pension, difficulties encountered in childhood, motivations), for the candidates officer (year of the previous preparation organized by the gendarmerie), for the candidates non-commissioned (declaration of choice of the territorial regime), for the voluntary candidates of overseas (declaration of metropolis serve).
13. With regard to the tests carried out by the candidates, those relating to:
- identification: candidate's computer number;
―at identity: patronymic name, marital or use, first names, date and place of birth, sex, candidate's age;
– to the military situation: codification of the origin of the application;
- the identification of the session: session number;
• identification of the selection centre: identification number of the selection centre;
- training and instruction: level of study of the candidate;
― responses to personality tests: answers to the professional fitness test #1, answers to the fitness test 2;
―at the notices to the personality tests: scores and thresholds (notice to the professional fitness test number 1, scores obtained according to the thresholds, professional fitness test number 2, scores obtained according to the scales, final notice to the professional fitness test number 1, final notice to the professional fitness test number 2);
• the answers to professional fitness tests: answers to professional fitness tests n° 3, 4, 5, 6, to English tests, answers to technical tests n° s 1, 2, 3, 4, 5, 6, 7, 8, answers to the general culture test n° 5, answers to the accounting test, answers to the test of non-testing officers;
– to the performance of professional fitness tests: results in raw notes and calibrated notes (professional fitness tests n° s 3, 4, 5, 6, and English, technical tests n° s 1, 2, 3, 4, 5, 6, 7, 8, of the general culture test n° 5, of the accounting test, of the test of non-testing officers);
―at the state of the test results by type of selection: final notice of personality tests and results in calibrated notes of professional fitness tests;
― to the editing of personality test protocols.
II. ― For the management of national gendarmerie personnel:
- identity: civility, nationality, name, name, photograph, date and place of birth, date of death, sex, addresses, telephone numbers, email, professional card references, traffic card references, passport, gendarme identification number, defense ID;
- the registration number on the national directory for the identification of natural persons;
family situation: current and past family situations, geographical celibacy, spouses (name of use, birth, first name, sex, date and place of birth, nationality, date of death, number of gendarmerie identification and unit of assignment, employer, class of employer, activity), children (number, name, first name, sex, date and place of birth, date of death, filiation, date of arrival at home, date of birth
- training, diplomas and distinctions: diplomas, certificates and certificates, patents, military training (lyceased), foreign languages practiced, civil training and school curricula followed, vocational training, decorations, awards, citations, qualifications, dominant, specialty, training, retraining of courses, examinations and examinations, classification and grade of the initial training course in gendarmerie, driver's license;

Information on the social security number of persons affected by the treatment can only be provided for the only operations required for the transmission of information between the personnel file and the National Military Social Security Fund or the organizations covered by the Social Security Fund.Article 1 of Decree No. 91-1404 of 27 December 1991. »
2° Section 3 is replaced by the following:
“The personal data thus recorded shall be retained:
I. ― For the recruitment of candidates to a national gendarmerie position:
11. Data subject to automated processing are:
― retained, in the event of failure until the person concerned reaches the age of 41;
- transferred in case of success, in the personnel management base;
destroyed as soon as the administration is informed of the death of the candidate;
― retained, in the event of success, until the individual reaches the age of 41, without being transferred to the management base.
12. Data subject to non-automated processing are:
― destroyed the fifth year after the nomination date, in case of failure;
― classified as running archives, in case of success;
destroyed as soon as the administration is informed of the death of the candidate;
― the statements of punishment and information relating to the difficulties encountered in children are destroyed after the decision to enter into employment in the National Gendarmerie.
13. The test data of the candidates are:
― destroyed the fifth year following the date of application in case of failure;
― classified as running archives, in case of success;
destroyed as soon as the administration is informed of the candidate's death.
II. ― For the management of national gendarmerie personnel:
The data is retained until the member's or agent's link is broken with the manager's body, depending on whether it is active or reserve.
The retention of data relating to reasons of absence is limited to a period not exceeding two years, unless otherwise provided by law.
Information relating to disciplinary sanctions is retained in accordance with the provisions of Article 6 of the aforementioned Decree of 15 July 2005.
The personal data required for the calculation of pension entitlements may be retained for the purpose of re-establishing the career until the liquidation of old-age pensions. »

After Article 3, an article 3-1 is inserted as follows:
"The recipients of recorded personal data are, depending on their respective responsibilities and the need to know:
I. ∙ For the recruitment of candidates for a position in gendarmerie:
11. Regarding data that are subject to automated processing:
the recruitment office;
- the medical centres of the national gendarmerie;
- information and recruitment centres;
- selection centres and national service offices;
- the services responsible for conducting environmental investigations;
- the initial integration units;
- the sub-direction of studies and foresight.
12. Regarding data that are subject to non-automated processing:
the recruitment office;
- information and recruitment centres;
- selection centres and national service offices;
- the services responsible for conducting environmental investigations;
- the initial integration units;
- the sub-direction of studies and foresight.
13. Concerning the tests carried out by the candidates:
- the sub-direction of skills;
the recruitment office;
– the evaluation and selection section.
II. ― For the management of national gendarmerie personnel:
- administrative and accounting officers;
- staff management officers (including recruitment offices);
- the superiors of the concerned;
the National Military Social Security Fund;
- the family allowance fund and the work accidents in New Caledonia;
the National Gendarmerie Fund;
- the service of the armed pensions;
- the sub-direction of studies and foresight;
- the medical centres of the national gendarmerie. »
