In view of Commission decision 2008/284/EC of 6 March 2008 on the technical specification of interoperability in relation to the subsystem "energy" of the high-speed trans-European railway system;
In light of Commission decision 2008/386/EC of 23 April 2008 amending Appendix A to Decision 2006/679/EC of 28 March 2006 on the technical specification of interoperability regarding the subsystem "control-command and signalling" of the conventional trans-European railway system and Appendix A to Decision 2006/860/EC of 7 November 2006 on a technical specification of interoperability regarding the sub-command
Vu la Act No. 2006-10 of 5 January 2006 on transport security and development;
Vu le Decree No. 2006-1279 of 19 October 2006 concerning the safety of railway traffic and the interoperability of the railway system, including Article 3;
Considering the decision of 19 February 2007 taken for the application of theArticle 3 of Decree No. 2006-1279 of 19 October 2006 concerning the safety of railway traffic and the interoperability of the railway system;
Having regard to the decision of 31 December 2007 on authorizations for the realization and commercial exploitation of new or substantially modified railway systems or subsystems,
Stop:
For sub-systems, sub-system parts and their interfaces on the conventional and high-speed trans-European railway network, is applicable the technical specification of interoperability for " persons with reduced mobility" contained in the annex to Commission decision 2008/164/EC of 21 December 2007 referred to above, published in the Official Journal of the European Union No. L 64 of 7 March 2008.
For the purposes of this specification, "station" means any stopping point of a train intended for the rise or descent of passengers.
The provision in item 1.1 of this specification as follows: "However, the existing rolling stock is specifically exempted from the requirement to comply with the ITS during a redevelopment or renewal" refers exclusively to tourism or historical rolling stock.
For sub-systems, sub-system parts and their interfaces on the conventional and high-speed trans-European railway network, is applicable the technical specification of interoperability relating to "safety in railway tunnels" set out in the annex to the above-mentioned decision 2007/163/EC of 20 December 2007 published in the Official Journal of the European Union No. L 64 of 7 March 2008.
For subsystems, subsystem parts and their interfaces on the high-speed trans-European rail network are applicable:
- the technical specification of interoperability relating to the subsystem "infrastructure" annexed to Commission decision 2008/217/EC of 20 December 2007 referred to above, published in the Official Journal of the European Union No. L 77 of 19 March 2008;
- the technical specification of interoperability relating to the subsystem "exploitation" annexed to Commission decision 2008/231/EC of 1 February 2008 referred to above, published in the Official Journal of the European Union No. L 84 of 26 March 2008;
- the technical specification of interoperability with respect to the subsystem "rolling equipment" annexed to Commission decision 2008/232/EC of 21 February 2008 referred to, published in the Official Journal of the European Union No. L 84 of 26 March 2008;
― the technical specification of interoperability relating to the subsystem "energy" annexed to Commission decision 2008/284/EC of 6 March 2008 referred to above, published in the Official Journal of the European Union No. L 104 of 14 April 2008.
Appendix A of the technical specifications for interoperability for the subsystem "control-command and signalling" of the high-speed trans-European railway system and the conventional railway system, whose publication references in the Official Journal of the European Union are contained in articles 1 and 4 of the above-mentioned Decree of 19 February 2007 is replaced by the annex to Decision 2008 / 386 / CE of the Commission of 23 April 2008 referred to above. For subsystems, subsystem parts and their intended interfaces on the high-speed trans-European rail network and on the conventional rail network, this annex applies.
After Article 15 of the above-mentioned Order of December 31, 2007, it is inserted at the beginning of Title III "Different Provisions" an article 15 bis as follows:
"Art. 15 bis. - The declarations of verification "EC" of a subsystem authorized in France by the EPSF which is subject to a renewal or redevelopment in accordance with the provisions of the technical specifications of interoperability, in particular in their chapter 7, do not constitute a substantial modification within the meaning of title V of the above-mentioned decree of October 19, 2006 shall be transmitted for information to the EPSF, unless the amended subsystem has already been the subject of another
When derogated from all or part of an ITS under an exemption granted in accordance with articles 36 and 37 of the decree of 19 October 2006 referred to above or a decision of the Minister responsible for transport pursuant to section 38 of the same order, the declaration of verification "EC" of a subsystem mentions the points of the ITS to which it is derogated. »
The provisions of the amended dated 16 December 2002 order for the application of theArticle 4 of Decree No. 2001-129 of 8 February 2001 transposition of Council Directive 96/48/EC of 23 July 1996 on the interoperability of the high-speed trans-European railway system is repealed effective 1 October 2008, with the exception of the second paragraph of Article 1, repealed as of the entry into force of this Order, and the first, third, fifth and sixth paragraphs of Article 1, repealed effective 1 September 2008.
The Director General of Infrastructure, Transport and the Sea is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
