Vu la Act No. 84-53 of 26 January 1984 amended with provisions relating to the territorial public service;
Vu la Act No. 84-594 of 12 July 1984 amended on the training of officials of the territorial public service, including the 2nd of its article 1;
Vu le Decree No. 2007-1845 of 26 December 2007 relating to professional training throughout the life of officials of the territorial public service;
Considering the opinion of the Superior Council of the Territorial Public Service of 20 February 2008,
Decrete:
I.-Chapter VI, title II, of Book II, of the regulatory part of the Code of Social Action and Families is entitled "Protection of minors at risk and collection of information of concern".
II.- Section 1 of this chapter is supplemented by the following articles:
"Art.D. 226-1-1.-In accordance with Article L. 226-12-1, territorial executives who, by delegation of the President of the General Council, make decisions on the protection of children and determine the modalities of their implementation shall, after taking office, follow a training on the protection of children, organized in accordance with the 2nd of Article 1 of the Law of 12 July 1984 amended on the protection of children.
"This training, for a duration of 240 hours, is started in the year following their takeover and takes place on a maximum amplitude of 18 months.
"The theoretical training of 200 hours includes 30 hours in common with professionals from other institutions involved in the field of child protection.
"The practical course, for a duration of 40 hours, is organized under the responsibility of the employer and in terms defined in consultation with the training body. It is carried out in an institution involved in the protection of children other than that to which the territorial frameworks concerned belong.
"Art.D. 226-1-2.-The training provided for in Article D. 226-1-1 includes the following four areas of competence:
« 1° Being able to locate the prevention and protection of childhood in a historical and philosophical perspective;
« 2° To know the guiding principles of theories and practices of the humanities regarding the development of the child and the family;
« 3° Mastering the child protection system and the legislative and regulatory framework;
« 4° Being able to be in the child protection device.
"The content of the training in each of these areas is determined by a joint order of the Minister for the Family and the Minister for Territorial Communities.
"Art.D. 226-1-3.- Upon completion of the training provided for in Article D. 226-1-1, the training organization shall issue to the individual a training follow-up certificate, specifying the duration and topics covered in this framework. »
The provisions of this Decree shall enter into force within three months of its publication.
Territorial frameworks that already exercise, at the time of the coming into force of this Order, the missions mentioned inarticle D. 226-1-1 For more than a year may only follow part of the training referred to in section 1 above, in the course of career development training at the request of the employer or agent.
The Minister of the Interior, the Overseas and Territorial Communities, the Minister of Labour, Social Relations, the Family and Solidarity, the Minister of Budget, Public Accounts and the Public Service and the Secretary of State for the Family are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
