Judgment of June 6, 2008 setting out the nature, duration and program of the entrance examinations to the regional administration institutes

  • TITRE IER : NATURE AND DURE OF THE PREUV
    • CHAPTER IER: EXTERNAL Article 1 Learn more about this article...


      The external entrance examination to the regional administrative institutes consists of two written examinations of eligibility and two oral examinations of admission.
      The written tests are as follows:
      1° A composition on a general topic on the place of the State and its role in the major areas of public intervention (society, economy, employment, health, culture, territories, external relations...) to assess the openness of candidates to the world, their ability to analyse and question and their ability to project themselves in their future professional environment (duration: four hours; coefficient 4);
      2° A series of six to ten short answer questions, covering key elements of public law, European issues, human resources management, social issues, public finances and the economy.
      Each question may be accompanied by one or more documents related to the question asked that do not exceed a page in total (duration: four hours); coefficient 4, of which coefficient 2 for public law, European issues and social issues, and coefficient 2 for public finances, human resources management and the economy).
      The oral examinations are as follows:
      1° An interview with the jury to assess the candidate's personal qualities, potential, behaviour in the face of a specific situation, if any in the form of a situational situation (duration: twenty-five minutes, of which ten minutes are no more presented by the candidate; coefficient 4).
      The interview begins with a presentation by the candidate of his course and his motivation. For the maintenance test, the qualifying candidate addresses an individual fact sheet to the contest manager service on a date fixed by the service and before the intake test begins. The individual fact sheet is available on the Ministry of Public Service website at the following address: www.function-publique.gouv.fr.
      2° A foreign living language test consisting of an interview from a short text written in one of the following languages: German, English, Spanish, Italian and Russian (duration: fifteen minutes, preceded by a preparation of fifteen minutes; coefficient 1), the candidate's choice being expressed at the time of the examination.

      The internal competition for admission to regional administrative institutes includes a written eligibility test and an oral admission test.
      The written proof of eligibility consists in the drafting, from an administrative record, of a note to verify the candidate's writing, analysis and synthesis qualities and his ability to identify appropriate solutions (duration: four hours; coefficient 4).
      For this trial, the documentary file cannot exceed thirty pages.
      The admission test consists of an interview with the jury to assess the candidate's personality, abilities and motivation and to recognize the achievements of his professional experience. To conduct this interview, which has as its starting point a candidate's presentation on his or her professional experience, for a period of not more than ten minutes, the jury has the candidate's file for recognition of the achievements of the professional experience. During this interview, the candidate is also questioned on questions relating to general administrative knowledge (duration: 25 minutes); coefficient 4).
      For the oral admission test, the candidate shall prepare a record of recognition of the achievements of his or her professional experience with the entries listed in the appendix to this order that he or she shall give to the organizing service at a date fixed in the opening of the contest.
      The record of recognition of the achievements of the professional experience as well as the filling guide are available on the website of the Minister for Public Service and on the websites of the regional administrative institutes mentioned in the annex to this Order. The file is forwarded to the jury by the competition manager after the establishment of the eligibility list.

      The third entrance examination to the regional administrative institutes includes a written eligibility test and an oral admission test.
      The written proof of eligibility consists of a summary note on file on a topic of general order relating to the place of the State and its role in the major areas of public intervention (society, economy, employment, health, culture, territories, external relations...) to assess the openness of candidates to the world, their ability to analyse and question and their ability to project in their future professional environment (duration: four hours coefficient 4).
      For this trial, the documentary file cannot exceed thirty pages.
      The admission test consists of an interview with the jury to assess the candidate's personality, abilities and motivation and to recognize the achievements of his professional experience. To conduct this interview, which has as its starting point a candidate's presentation on his or her professional experience, for a period of not more than ten minutes, the jury has the file constituted by the candidate for recognition of the achievements of the professional experience (duration: 25 minutes; coefficient 4).

      Applicants to the internal contest and the third contest may, if requested at the time of registration, undergo an optional foreign language test consisting of an interview from a short text written in one of the following languages: German, English, Spanish, Italian and Russian (duration: fifteen minutes, preceded by a preparation of fifteen minutes; coefficient 1), the candidate's choice being expressed at the time of the examination.
      The notes obtained at the optional foreign living language test of the internal competition and the third competition are taken into account only for their part exceeding the score of 10 of 20. The additional points obtained in the optional test are added to the total of the points obtained in the mandatory tests for the establishment of the admission list.

      For each competition, following the eligibility test, each Eligibility Board sets out the list of candidates authorized to take part in the oral examinations, after equalization of the grades awarded to candidates for the different Eligibility Tests.
      Under the same conditions, at the end of the oral examinations of admission, each jury of admission shall establish the list of admissions, after equalization of the notes attributed to the candidates for oral examinations.

      No person may be declared eligible or admitted if he or she has not participated in all of the mandatory tests, or if he or she has obtained, at any of the qualifying tests or the foreign living language oral test of the external competition, a grade of 1 out of 20 and a grade of 5 out of 20 at the interview examination with the jury.

      If several candidates have obtained the same number of points, they are departed as follows when the admission list is established:
      1° For the external contest:
      - priority is given to the one who has obtained the highest grade in the first mandatory written test;
      – in the event of equality of points at the first written test, the priority is given to the candidate who obtained the best note at the oral interview with the jury.
      2° For the internal competition and the third competition:
      ― priority is given to those who have obtained the highest grade in the oral maintenance and recognition test of the gains of professional experience.

    The programme for the second written examination of the external examination is as follows:


    I.- Public safety
    1. Constitutional law


    General notes on political institutions.
    Current French political institutions; the Constitution of 4 October 1958, the organization of public authorities, the relationship between authorities, the constitutionality bloc, the control of constitutionality of laws.


    2. Administrative and administrative law


    A.-The administrative and territorial organisation of France:
    1. Legal and territorial frameworks of the administrative organization:
    ― centralization, deconcentration and decentralization.
    2. State administration:
    ― central administration, national jurisdiction, independent administrative authorities, decentralized services, disconcerned authorities (regional prefects, department, sub-prefects).
    3. The decentralized organization of the Republic:
    - the legal status of territorial authorities, communities with special or special status;
    – the different territorial authorities: municipalities, departments and regions;
    public institutions of intercommunal cooperation.
    4. Special public persons:
    public institutions, public interest groups.
    B. ― The administrative and administrative courts:
    1. The principle of separation of administrative and judicial authorities: definition, origins and foundations:
    ― the role of the conflict court in the functioning of French judicial dualism.

    - special administrative courts (financial courts and other specialized courts).

    - appeals before the administrative court: appeal for excess of power, litigation of full jurisdiction, new powers of the administrative judge;

    - remedies against decisions of administrative courts.
    C. ∙ Administrative action and the principle of legality:
    1. The sources of administrative law, the hierarchy of norms, the principle of legality and the control of legality.
    2. The activities of the administration:
    the administrative police: definition, administrative police authorities, police powers, police measures, distribution of police powers, judicial review of administrative police measures;
    ― public service activities: definition of the concept of public service, the typology of public services, the broad principles of public service, the modes of public service management.
    3. The acts of the administration:
    ― unilateral administrative acts: regulatory authority, administrative act definition, development procedure (non-contentious administrative procedure: consultation, motivation, transparency), conditions of entry into force, repeal and withdrawal of administrative acts;
    - the contracts of the administration;
    - the criteria of distinction between administrative contracts and private contracts of the administration; the legal regime of administrative contracts;
