Considering the amended decision of 29 June 1992 setting out the list of sections, sub-sections and options and the number of members of each sub-section of the National Council of Universities for medical and odontological disciplines;
In view of the amended decision of 26 January 1993 setting out the list of disciplines in which a practical pedagogical test is organized under theArticle 52 of Decree No. 84-135 of 24 February 1984 amended by establishing the status of teachers and hospitals in hospitals and universities;
Having regard to the amended decision of 2 May 1995 setting out the list of groups and sections and the number of members of each section of the National Council of Universities;
In view of the decision of 19 March 1998 on the registration procedure on the qualification list for the functions of university professors in pharmaceutical disciplines;
In light of the February 25, 2003 decision on the terms and conditions for granting and exercising leave for research or thematic conversions provided for inArticle 19 of Decree No. 84-431 of 6 June 1984 Amending the common statutory provisions for teachers-researchers and bearing particular status of the body of university professors and the body of lecturers;
In view of the decision of July 3, 2006, setting out the composition, responsibilities and operating rules of the competent national integration commission with respect to teachers and hospitals in the pharmaceutical disciplines of university hospital centres;
In view of the amended decision of 18 December 2006 on the equivalence or dispensation of certain diplomas required for the recruitment of teachers and hospital staff from hospital and university centres and dental care, education and research centres,
Stop:
In the title and article 1 of the above-mentioned 17 September 1987 Order, the words: "and lecturers of universities-hospital practitioners" are replaced by the words: ", lecturers of universities-hospital practitioners, professors of universities-hospital practitioners of pharmaceutical disciplines and lecturers-hospital practitioners of pharmaceutical disciplines".
Section 2 of the above-mentioned 17 September 1987 Order is replaced by the following provisions:
"Art. 2.-For the application of articles 48, 48-1, 51, 52, 61-2, 62, 63, 63-1 and 66 of the decree of 24 February 1984 referred to abovethe disciplines of the national competitions correspond to the sub-sections or, where appropriate, in the pharmaceutical disciplines, to the sections of the National Council of Universities for medical, odontological and pharmaceutical disciplines. »
Section 4 of the same order is replaced by the following provisions:
"Art. 4.-Applications shall be examined by jury members trained, as the case may be, by members of the sub-section, section or intersection of the National Council of Universities for medical, odontological and pharmaceutical disciplines whose employment is under.
"They are chaired by the president of the subsection or intersection. In pharmaceutical disciplines, the jury is chaired by the president of the section or intersection. In the event of the failure of the president duly recognized by the respective ministers responsible for health and higher education, he is suppleed by the professor with the highest seniority in the highest grade.
"The members of the jury who lose the status of a member of the National Council of Universities for Medical, Odontological and Pharmaceutical Disciples after the date fixed for the beginning of the trials continue to sit in the jury until the end of the examination. »
The fourth paragraph of Article 9 of the Order is replaced by the following provisions:
"In the event that the hospital discipline of employment differs from academic discipline, the president of the jury shall transmit the list of candidates proposed for admission, as the case may be, to the sub-section or to the competent section of the National Council of Universities for medical, odontological and pharmaceutical disciplines. The registration of a candidate on the admission list is subject, as the case may be, to the agreement of the subsection or section. »
Section 11 of the same order is replaced by the following provisions:
"Art. 11.- Candidates send directly to the Director of the relevant training and research unit whose employment is a copy of the written statement of their titles and works submitted to the jury referred to in Article 4 above, accompanied by all supporting documents and possibly a copy of the list referred to in the second paragraph of Article 10 above.
"The director of the training and research unit concerned shall forward the candidates' files for advice to the board of the training and research unit concerned in restricted training to teachers and personnel assimilated from at least equal to that applied by the candidate. »
Section 12 of the same order is replaced by the following provisions:
"Art. 12.- Candidates also send to the Director General of the University Hospital Centre that is part of the hospital and university centre whose job is to provide a copy of the written statement of their titles and works, submitted to the jury referred to in Article 4 above, accompanied by all supporting documents and, possibly, a copy of the list referred to in the second paragraph of Article 10 above.
"The Director General shall forward the applicants' files for advice to the Medical Establishment Commission. »
Section 13 of the same order is replaced by the following provisions:
"Art. 13.-The file of candidates accompanied by the advice of the Board of the Training and Research Unit and the Medical Establishment Commission is transmitted by the Director of the Training and Research Unit concerned and by the Director General of the University Hospital Centre respectively to the Minister for Health and the Minister for Higher Education for appointment to the corresponding jobs. »
In the title, in article 1st, article 4, article 7, article 8 and article 9 of the above-mentioned decree of September 28, 1987, the words: "National Council of Universities for Medical and Odonological Disciples" are replaced by the words: "National Council of Universities for Medical, Odonological and Pharmaceutical Disciples".
It is inserted, after article 9 of the above-mentioned decree of 28 September 1987, an article 9-1, as follows:
"Art. 9-1.-The decisions of the National Council of Universities for Medical, Odontological and Pharmaceutical Disciples on individual measures relating to the qualification of teachers and researchers in pharmaceutical disciplines are taken according to the rules set out in this Order and by the Decree No. 84-431 of 6 June 1984 establishing the common statutory provisions applicable to teachers-researchers and bearing particular status of the body of university professors and the body of lecturers.
"The president of each section can make anyone heard as an expert or rapporteur. In this case, the summonses of the persons concerned are addressed by the minister responsible for higher education.
“The deliberations on each nomination are subject to the following conditions:
"The ballots bearing the mention "denial of choice", not being the votes cast, are not taken into account in calculating the majority.
"At the end of a debate organized by the president, a vote was taken on the proposal of the section or group as it emerges from this debate.
"This vote takes place with secret ballots, by "yes" or "no" on the proposal. White ballots are considered unfavourable to the proposal. The proposal was adopted if a majority of ballots "yes" were found.
"In the event of the equal sharing of votes, a new deliberation takes place during the same meeting. If, as a result of this deliberation, equal sharing of votes is again recognized, the proposal is not adopted. »
Section 11 of the same order is replaced by the following provisions:
"Art. 11.-When subsections under different sections are called to sit together by a joint decision of the Minister for Higher Education and the Minister for Health, each subsection is represented by a number of members equal to that of the lowest subsection. The most numerous sub-sections elect their representatives in accordance with the proportions provided for in Articles 3 and 4 of the aforementioned Decree of 20 January 1987.
"When subsections under different sections are attached to the appropriate section by joint decision of the Minister for Higher Education and the Minister for Health, the decision specifies the number of representatives of the sub-sections concerned so that their number does not exceed the staffing of the competent section. »
In the title of thearrested on 15 June 1992the words: "National Council of Universities for Medical and Odonological Disciples" are replaced by the words: "National Council of Universities for Medical, Odonological and Pharmaceutical Disciples".
Article 1 of the above-mentioned decision of 15 June 1992 is amended as follows:
I. ― The first paragraph is as follows:
"Similar to university professors in medical, odontological and pharmaceutical disciplines, for the application ofarticle 4 of the decree of 20 January 1987 referred to above, the incumbents belonging to the following bodies listed :".
II. ― After the last paragraph, it is added a paragraph as follows:
"People belonging to the body of the professors of the National Natural History Museum are also assimilated to the professors of the universities of the pharmaceutical disciplines for the application of theArticle 4 of the Decree of 20 January 1987 referred to above. »
Article 2 of the same order is amended as follows:
I. ― The first paragraph is as follows:
"Similar to lecturers in medical, odontological and pharmaceutical disciplines, for the application ofarticle 4 of the decree of 20 January 1987 referred to above, the incumbents belonging to the bodies listed below:".
II. ― After the last paragraph, it is added a paragraph as follows:
"People belonging to the body of the lecturers of the National Museum of Natural History are also assimilated to the lecturers of the pharmaceutical disciplines for the application of theArticle 4 of the Decree of 20 January 1987 referred to above. »
The title of the above-mentioned decision of 29 June 1992 is replaced by the following title:
"Order setting out the list of sections, sub-sections and options as well as the number of members of each section and sub-section of the National Council of Universities for medical, odontological and pharmaceutical disciplines".
In article 1st, article 1st, and article 2 of the above-mentioned Decree of 29 June 1992, the words "National Council of Universities for Medical and Odonological Disciples" are replaced by the words "National Council of Universities for Medical, Odonological and Pharmaceutical Disciples".
It is inserted after article 2-1 of the same order, an article 2-2 and an article 2-3 as follows:
"Art. 2-2.-The list and number of members of the sections of the group of pharmaceutical disciplines of the National Council of Universities for medical, odontological and pharmaceutical disciplines are fixed in accordance with the following table:

Article 1 of the above-mentioned decision of 26 January 1993 is supplemented by the following provisions:
« 3° Recruitment of lecturers from universities-patients in pharmaceutical disciplines:

« 4° Competition for the recruitment of professors from universities-patients in pharmaceutical disciplines:
“– all disciplines. »
In the table annexed to the above-mentioned decision of May 2, 1995, the provisions concerning group XI, section 39: Physico-chemical sciences and pharmaceutical technologies, section 40: drug sciences, section 41: Pharmaceutical biological sciences and the distribution of elected and appointed members in the 1st College and the 2nd College in these same sections are deleted.
In Article 2 and Article 4 of the above-mentioned Order of March 19, 1998, the words "National Council of Universities" are replaced by the words "National Council of Universities for Medical, Odonological and Pharmaceutical disciplines".
In the first paragraph of Article 1 of the above-mentioned Order of February 25, 2003, after the words: "the competent section of the National Council of Universities" are added the words: "the competent section of the group of pharmaceutical disciplines of the National Council of Universities for medical, odontological and pharmaceutical disciplines".
In article 2 of the above-mentioned decree of February 25, 2003, after the words: "and between the sections of the National Council of Universities" are added the words: "and the sections of the group of pharmaceutical disciplines of the National Council of Universities for medical, odontological and pharmaceutical disciplines".
The second paragraph of Article 3 of the Order is replaced by the following provisions:
"Each candidate must specify whether the application is submitted under one of the sections of the National Council of Universities, under one of the sections of the group of pharmaceutical disciplines of the National Council of Universities for medical, odontological and pharmaceutical disciplines or under its duty station. In the event that the application is submitted under the National Council of Universities or the National Council of Universities for Medical, Odontological or Pharmaceutical Disciples, the competent section to be specified at the nomination is determined by the candidate's choice. »
The second paragraph of Article 4 of the Order is replaced by the following provisions:
"When the application is submitted under one of the sections of the National Council of Universities or one of those of the group of pharmaceutical disciplines of the National Council for Medical, Odontological and Pharmaceutical disciplines, the president or director of the institution shall, with his opinion, transmit it to the minister responsible for higher education. The State shall have before it the competent section of the National Council of Universities or, if not, the competent section of the group of pharmaceutical disciplines of the National Council of Universities for medical, odontological and pharmaceutical disciplines, which proposes the nominations and the duration of the leave proposed within the limits of the possibilities that have been notified in the section. This duration is six or twelve months and cannot be split. »
Section 5 of the same order is replaced by the following provisions:
"Art. 5.-The proposal of the section of the National Council of Universities or the section of the group of pharmaceutical disciplines of the National Council of Universities for medical, odontological and pharmaceutical disciplines or of the scientific council is forwarded to the president or director of the institution of assignment of the interested person. The decision to grant leave for research or thematic conversions is taken by order of the president or director of the institution of assignment of the interested party on the proposal of the National Council of Universities, the National Council of Universities for Medical, Odonological and Pharmaceutical Disciples or the Scientific Council. »
The tenth and eleventh paragraphs of Article 1 of the above-mentioned Order of July 3, 2006 are replaced by the following provisions:
"The Presidency of the National Integration Commission is ensured by the Director of Hospitalization and Care Organization at the Ministry of Health and the Vice-Chair by the Director of Human Resources at the Ministry of Higher Education, when the commission decides on an application submitted by a candidate under section 36 of the decree of May 23, 2006 and section 50 of the decree of April 2nd 2008 of the Decree No.
"The chair of the above-mentioned commission is provided by the Director of Human Resources at the Ministry of Higher Education and the vice-chairing by the Director of Hospitalization and Care Organization at the Ministry of Health, when the commission decides on an application submitted by a candidate under section 36 of the decree of 23 May 2006 and section 50 of the decree of 2 April 2008 referred to above. »
Section 2 of the same order is replaced by the following provisions:
"Art. 2.-The National Integration Commission renders an opinion on the requests for integration into the body of the lecturers of the universities-practors hospital of the pharmaceutical disciplines and in the body of the professors of the universities-practors hospital of the pharmaceutical disciplines, governed by the Decree No. 84-135 of 24 February 1984, formulated by candidates meeting the conditions set to theArticle 36 of the Decree of 23 May 2006 and to theArticle 50 of the Decree of 2 April 2008 above."
Section 7 of the above-mentioned Order of 18 December 2006 is amended as follows:
I. ― In the first paragraph, the words "and 63" are replaced by the words ", 63 and 63-1".
II. ― In the second paragraph, the words: "National Council of Universities for Medical and Odonological Disciples" are replaced by the words: "National Council of Universities for Medical, Odonological and Pharmaceutical Disciples".
The decision of April 5, 1991 on the establishment of the competitive examination boards for lecturers and university professors and setting the start date of the competitions is repealed.
The Director General of Human Resources and the Director of Hospitalization and Care Organization are responsible, each with regard to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.
