Nationals of a Member State of the European Community or of a State Party to the Agreement on the European Economic Area that wish to practise in France the profession of genetic advisor in application of theArticle R. 1132-4 of the Public Health Code must obtain an exercise authorization issued by the Minister for Health.
The application for an exercise authorization file includes:
1° A proof of nationality;
2° Certified true copy of diplomas, certificates or titles obtained;
3° Document of the authority that has issued diplomas, certificates or titles certifying that such training has been carried out at a university, higher education institution or at another institution of the same level of training, with indication of the duration of such training;
4° The content of the studies and courses carried out during the training, with the number of annual hours per subject for the theoretical lessons, the duration of the courses and the area in which they were carried out, delivered and certified by the training structure;
5° A certificate from the competent authority of the State having recognized diplomas, certificates or other titles certifying:
- that they allow access or exercise of functions corresponding to the profession of genetic advisor in that State;
―that they comply with Council Directive 89/48/EEC of 21 December 1988 and Council Directive 92/51/EEC of 18 June 1992 providing for a general system of recognition of higher education diplomas and vocational training;
6° For persons with a degree, certificate or title issued by a third country and recognized by a Member State and for persons who have exercised in a Member State who do not regulate the profession concerned:
(a) Certification from the competent authority of the Member State certifying the duration of the professional exercise, with the corresponding dates;
(b) Relevé des cours de formation permanente pourront suivis, avec indication du contenu et de la durée de ces ateliers ;
(c) Copy of the diploma issued by equivalence by the Member State of the European Union, or certificate of recognition of the diploma, authorizing the exercise of the profession concerned in its territory;
7° Translation by a sworn translator of the aforementioned documents.
The file is sent, by registered letter with acknowledgement of receipt, to the Minister responsible for health (direction of hospitalization and care organization, sub-direction of paramedical professions and hospital staff).
A receipt is issued to the interested party upon receipt of the complete file.
The authorization to exercise the profession is issued when the conditions defined by article R. 1132-4 above. However, the issuance of the exercise authorization is subject to the verification of the applicant's ability to practise the profession in France. This audit may result in the applicant's obligation to submit to its choice:
1° Be at an aptitude test;
2° Either an adaptation course whose duration cannot exceed three years.
When the candidate's training was found to be substantially different from the training required in France, the Minister for Health determines, after the advice of trade union and professional organizations, the nature and duration of the fitness test and the adaptation course proposed to the candidate. It shall decide on the application for authorization by a reasoned decision, taken within three months of the date of receipt of the receipt referred to in Article 2 of this Order.
The Minister for Health grants the authorization, in the event that the person concerned is subject to this decision to the suitability test or to the adaptation internship referred to in article R. 1132-4 above, after success in the aptitude test or validation of the adaptation course.
The aptitude test mentioned at article R. 1132-4 above a for the purpose of verifying by means of written or oral examinations that the interested person has an appropriate knowledge of the materials that were not initially taught to him or that he was unable to acquire through his or her professional experience. It consists of a knowledge control for each subject not initially taught. Each of these controls is noted on 20 and consists of one or more written or oral questions.
The aptitude test is organized by a regional management of health and social affairs.
The jury of the suitability test, designated by the regional prefect, consists of the Regional Director of Health and Social Affairs, or his representative, who chairs him, and two qualified professionals who have practised for at least three years, including a teacher exercising or exercising. The subjects of the suitability test are fixed by the jury.
The applicant must file with one of the regional Health and Social Affairs Directorates of the Fitness Test a registration file including the following:
– a request for free paper registration;
– the original of the ministerial notification specifying the nature and duration of the test.
To complete the fitness test, the candidate must obtain a general average of 10 out of 20 without a rating of less than 7 out of 20 to one or more of the knowledge controls.
In the case of a general average of less than 10 out of 20 or greater than 10 out of 20 but with a rating less than 7 out of 20 to one or more of the knowledge controls, the candidate, whose grades were notified to him by the Regional Directorate of Health and Social Affairs in which he passed the fitness test, may be represented with that direction or another direction organizing the test. In this case, the interested party may retain, upon request, the benefit of the grades greater than or equal to 10 of 20 obtained at one or more of the knowledge controls.
The adaptation course mentioned to article R. 1132-4 a to give interested persons the knowledge defined in the preceding paragraph. It can take place on several approved courses and be accompanied by additional training.
The adaptation course is organized by a regional directorate of health and social affairs, on one or more courses in an institution, approved by this management on the proposal of the regional inspector of public health. The trainee is placed under the pedagogical responsibility of a qualified professional with at least three years of experience.
The applicant must file with one of the regional directorates of health and social affairs organizing the internship a file including the following:
- an application for a free paper internship;
– the original of the ministerial notification specifying the nature and duration of the internship to be validated.
The course, which eventually includes a complementary theoretical training, is validated by the host structure manager, on the proposal of the qualified professional evaluating the trainee.
In the event of a non-validation of the course, the interested person, informed by the Regional Directorate for Health and Social Affairs that organized the internship, may apply for a new internship in one of the regional directorates of health and social affairs organizing the course.
In the event of success in the fitness or validation test of the course, the Regional Directorate for Health and Social Affairs has organized the course notifies the results to the Minister for Health, who authorizes the candidate to practise the profession as a genetic advisor.
The Director of Hospitalization and Care Organization is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
