See?11 August 2006 relating to fees for the processing of applications for frequency assignments reported to the International Telecommunication Union and applications for authorization pursuant to Articles R. 52-3-1 and R. 52-3-4 of the Post and Electronic Communications Code;
See?11 August 2006 the content of the application for permission to operate frequency assignments to satellite systems and satellite system information;
Having regard to the instruction file transmitted by the National Frequency Agency on December 7, 2007 to the Minister of Economy, Finance and Employment;
Considering the opinion of the Electronic Communications and Post Regulatory Authority dated 9 October 2007;
Considering the opinion of the National Centre for Space Studies of 13 September 2007;
Considering the opinion of the Ministry of Defence of 4 October 2007;
Having regard to the Civil Aviation Opinion of 21 September 2007;

Article 1


France Télécom is authorized to operate the frequency assignments declared by France to the International Telecommunication Union at orbital position 3° Is under the conditions set out in the schedule to this Order.

The authorization shall be granted for a period of twenty years from the date of publication of this order subject to the conditions of modification and caducity provided for by the Articles R. 52-3-13 to R. 52-3-15 of the Post and Electronic Communications Code. The conditions for renewal of this authorization are defined at theR. 52-3-12 of the same code.

    Implementation articles L. 97-2 and R. 52-3-1 to R. 52-3-21 of the Post and Electronic Communications Code, the authorization is issued under the following conditions:
    (a) The relevant frequency assignments are limited to those at orbital position 3° East, which are included in the frequency bands:
    2 029, 49-2 029, 79 MHz, 2 030, 59-2 030, 89 MHz, 2 032, 25-2 032, 55 MHz and 2 037, 35-2 037, 65 MHz for the Earth-to-space space operation and 3 700-4 200 MHz (in circular polarization in bands 3 965-4 121 MHz, 3 955, 7-3 956, 7 MHz and 3 957, 2-3 958)

    (b) The Earth stations operated are located in the service area as follows:
    In frequency bands 5,925-6,425 MHz and 3,700-4,200 MHz, the service area is the envelope for frequency assignments of TELECOM-2C, TELECOM-3C, TELECOM-4C and GEOSAT-3E networks in the table above.
    In frequency bands 2 203, 91-2 204, 35 MHz, 2 205, 11-2 205, 55 MHz, 2 206, 91-2 207, 35 MHz, 2 212-2 212, 89 MHz, 2 029, 49-2 029, 79 MHz, 2 030, 59-2 030, 89 MHz, 2 032, 25-2 032, 55 MHz and 2 037, 35-2 037, 65 MHz, the orbital position area is the visible part since the 3 East.
    (c) The emissions do not radiate at any point in the space or surface of the globe a power greater than that produced by the emissions corresponding to the frequency assignments whose characteristics are or will be entered in the ITU International Frequency Reference File, and the receptions operated do not in any case require more protection than would require frequency assignments whose characteristics are or will be entered in the same file.
    (d) Frequency assignments shall be carried out in accordance with the coordination agreements concluded with other ITU member States or with other frequency assignment operators declared by France to the ITU, including those that would be after the date of issue of this authorization. This operation is subject to respect for the rights associated with assignments previously communicated to the ITU for the duration of their operation.
    (e) The frequency assignments of the bands 3 965-4 121 MHz, 3 955, 7-3 956, 7 MHz, 3 957, 2-3 958, 2 MHz, 6 190-6 346 MHz, 6 181, 5-6 182, 5 MHz and 6 183-6 184 MHz are operated so as not to disrupt the use of the frequency assignments authorized in the March 16, 2007 order authorizing the company France Télécom to operate the frequency assignments East.
    (f) The operation of the frequency assignments concerned by the authorization is subject to compliance with the obligations set out in sections L. 97-2-II and R. 52-3-7 to R. 52-3-11 of the Post and Electronic Communications Code.
    (g) France Télécom is the sole licensee of this authorization and remains responsible for complying with the obligations related to the operation of these assignments, including where associated radio stations are held, installed or operated by third parties, or located outside France.
    (h) This authorization does not prejudge authorizations that are required to operate the system in the territories included in the service area.
    (i) The authorization shall be granted for a period of twenty years from the date of publication of this order, subject to the conditions of modification and decidity provided for by the conditions of amendment and decidity Articles R. 52-3-13 to R. 52-3-15 of the Post and Electronic Communications Code. The conditions for renewal of this authorization are defined at theArticle R. 52-3-12 of the Post and Electronic Communications Code.
