In light of the amended Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 providing for an information procedure in the field of technical standards and regulations and rules relating to the services of the information society, together with notification No. 2007/428/F of 26 July 2007 addressed to the Commission of the European Communities;
In light of Council Directive 2001/113/EC of 20 December 2001 on jams, jellies and fruit marmalades, as well as brown cream, intended for human food;
Vu le Consumer codeincluding articles L. 214-1 and L. 214-2;
Vu le Decree No. 85-872 of 14 August 1985 amended to implement Act of 1 August 1905 on fraud and falsifications of products or services in respect of jams, jellies and fruit and other similar products;
Considering the opinion of the French Food Safety Agency dated 4 October 2007;
The State Council (Finance Section) heard,
Decrete:
Article 4 of the above-mentioned Decree of 14 August 1985 is replaced by the following provisions:
“Art. 4. ― The soluble dry matter content of jam, extra jam, jelly, extra jelly, marmelade, frozen marmelade, determined by refractometer, is equal to or greater than 55%. It is set at a minimum of 75% for inshell fruit creams, other than maroon cream, referred to in title I of the schedule and at a minimum of 60% for maroon cream, plum cream, petal jam, confit of fruits and fruit grape. These soluble dry matter content are not applicable to products for which sugars have been partially or totally replaced by sweeteners. »
After Article 7 of the same decree, an article 8 is reinstated as follows:
“Art. 8. ― The provisions of this decree do not oppose the placing on the market of the products mentioned in Article 1 legally manufactured or marketed and in conformity with the loyal uses in another Member State of the European Community, or part of the agreement on the European Economic Area or in Turkey. »
♪ articles 9 and 10 of Decree No. 2004-314 of 29 March 2004 amending Decree No. 85-872 of 14 August 1985 Implementing the Act of 1 August 1905 on fraud and falsification of products and services in respect of jams, frosts and fruit marmalades and other similar products are repealed.
The Minister of Economy, Finance and Employment, the Minister of Agriculture and Fisheries, the Minister of Health, Youth and Sports and the State Secretary for Consumer Affairs and Tourism are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
