Order of January 25, 2008 empowering the Director of the Marine Protected Areas Agency to establish advances and revenue-based authorities at this facility

Considering the environmental code, including articles L. 334-1 to L. 334-8 and R. 334-1 to R. 334-38;
Vu le Decree No. 53-1227 of 10 December 1953 amended for accounting regulations applicable to national administrative institutions, together with Decree No. 62-1587 of 29 December 1962 amended by-law on public accounting, including section 18;
Vu le Decree No. 66-850 of 15 November 1966 amended on the personal and financial responsibility of the regulators;
Vu le Decree No. 92-681 of 20 July 1992 amended on revenue-based authorities and advances by public bodies;
In view of the decision of 20 July 1992 on the bail-out threshold of the directors of advances and income directors, as amended by the decree of 27 December 2001;
See?arrested on 23 December 1992 the conditions under which directors of national public institutions may institute advances and revenues, as amended byDecree of 12 July 2001 ;
In view of the decision of 28 May 1993 on the rate of liability allowances that may be allocated to the directors of advances and income directors of the public bodies and the amount of the bond imposed on them, as amended by the order of 3 September 2001 on the adaptation of the value in euros of certain amounts expressed in francs;
Having regard to the decision of 13 January 1997 on the amount per operation of the intervention expenses and subsidies payable through an advance regulator, as amended by the order of 3 September 2001 to adjust the value in euros of certain amounts expressed in francs;
Having regard to the order of January 28, 2002 relating to the amount by operation of the equipment and operating expenses payable through a forwarding officer,

      The Director of the Marine Protected Areas Agency may, by a decision made under his or her signature and by agreement of the member of the Economic and Financial Control Corps placed at the establishment, establish advance authorities at the various offices, delegations, missions or representations of the Marine Protected Areas Agency, other than the headquarters, for the payment of the planned expenditures to the AgencyArticle 10 of the Decree of 20 July 1992.
      In addition, may be paid through these advance authorities, abroad and overseas departments and regions, as well as in other overseas communities, the costs of equipment, arrangement, miscellaneous equipment and the operating costs of offices, delegations, missions or representations that cannot bear the time limits of the normal ordering procedure, to the extent that the maximum amount of each transaction does not exceed a maximum amount of € 1500

      Decisions made by the Director of the Marine Protected Areas Agency determine, within the limits set out in section 1, the nature of expenses that may be paid by each of the Boards.

      The amount of advances that may be made to the regulators shall, in each case, be determined by decisions of the Director of the Marine Protected Areas Agency within a quarter of the anticipated annual expenditures to be paid by the regulator.

      When the boards are located outside of the metropolitan territory, advances may be paid through the network of the General Directorate of Public Accounts in overseas departments and regions, as well as in other overseas or foreign communities.

      The supporting documentation of expenses paid through these advances must be delivered to the accounting officer concerned within a maximum period of one month from the date of payment.

    The Director of the Marine Protected Areas Agency may, by a decision made under his or her sole signature and after agreement of the member of the Economic and Financial Control Corps placed at the establishment, establish revenue streams from the various offices, delegations, missions or representations of the Marine Protected Areas Agency, other than the headquarters, for the collection of claims of any nature of the establishment.

    Revenues under section 6 shall be collected by the regulator and justified to the accounting officer under the conditions set out in articles 7, 8 and 9 of the decree of 20 July 1992 referred to above.
    The terms and conditions for payment of the cash pool and the amount of the permanent cash fund authorized to be disposed of are set out in the decisions constitutive of the directors.

    When the boards are located outside the metropolitan territory, the products recovered by their care may be paid to the accounting officer of the Marine Protected Areas Agency through the network of the General Directorate of Public Accounts in overseas departments and regions, as well as in other overseas and foreign communities.

      The directors are appointed by decision of the Director of the Marine Protected Areas Agency with the approval of the establishment's accounting officer.
      The functions of an advance manager and revenue manager may be entrusted to the same agent.

      The directors are subject to bail.
      However, the directors of advances or receipts are exempted from the establishment of a bond when the monthly amount of advances or receipts received does not exceed the threshold set by the above-mentioned Order of 20 July 1992.
      As part of the creation of a temporary authority, i.e. for a period not exceeding six months or for a particular operation, the director may be exempted from making a bail on the decision of the director of the establishment with the approval of the accounting officer.

      The supervisors receive a liability allowance, the amount set out in the above-mentioned decision of 28 May 1993.

      The Director of Nature and Landscapes at the Ministry of Ecology, Development and Sustainable Development and the Director General of Public Accounts at the Ministry of Budget, Public Accounts and Public Service are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
