Decree of 21 December 2007 on the reception of motor vehicles with regard to air conditioning systems

Having regard to Council Directive 70/156/EEC of 6 February 1970 on the approximation of the legislation of the Member States concerning the receipt of motor vehicles and their trailers, as last amended by Directive 2006/40/EC of the European Parliament and the Council of 17 May 2006;
Having regard to Council Directive 70/220/EEC of 6 February 1970 on the approximation of the legislation of member States on measures to be taken against air pollution by the emissions of motor vehicles and their trailers, as amended by Commission Directive 2003/76/EC of 11 August 2003;
Having regard to Directive 2006/40/EC of the European Parliament and the Council of 17 May 2006 on emissions from motor vehicle air conditioning systems and amending Council Directive 70/156/EEC;
Having regard to Commission Regulation (EC) No. 706/2007 of 21 June 2007 establishing, in accordance with Directive 2006/40/EC of the European Parliament and the Council, the administrative provisions for the CE reception of vehicles and a harmonized test for measuring the leakage of certain air conditioning systems;
Having regard to Directive 2007/40/EC of the European Parliament and the Council of 5 September 2007 establishing a framework for the reception of motor vehicles, their trailers and systems, components and technical entities for these vehicles;
Vu le road codeincluding articles L. 318-1 and R. 321-6 to R. 321-14;
Having regard to the decision of 16 September 1994 concerning the community reception of vehicle types, systems and equipment, last amended on 27 September 2002;

This Order applies to the Community Receipt (CE) and to the national Type Receipt of Motor Vehicles with respect to the emissions from the air conditioning systems of these vehicles and to the post-equipment provisions of these systems on these vehicles.

For the purpose of this Order, "engineered vehicles" means vehicles of international categories M1 and N1 Class I as defined in Annex II of the above-mentioned Directives 70/156/EEC and 2007/40/EC and the first table of Annex I, item 5.3.1.4 of the above-mentioned Directive 70/220/EEC.

The Community Receipt (EC) and the National Type Receipt of the vehicles referred to in Article 2 of this Order in respect of emissions from air conditioning systems shall be carried out in accordance with the administrative and technical provisions of the above-mentioned Directives 70/156/EEC or 2007/40/EC, Directive 2006/40/EC and Regulation (EC) No. 706/2007 of the Commission referred to above.
Community receptions are issued in France to vehicles in accordance with the provisions set out in Articles 3 to 7 of the above-mentioned Decree of 16 September 1994.

The provisions of this Order shall apply:
―as of June 21, 2008 at the CE or national reception of new vehicle types with regard to the limitation of the leakage rate of air conditioning systems installed on these vehicles and designed to contain a fluorinated greenhouse gas with a global warming potential greater than 150;
―as of June 21, 2009 to all vehicles put for the first time in circulation with regard to the limitation of the leakage rate of air conditioning systems installed on these vehicles and designed to contain a fluorinated greenhouse gas whose global warming potential is greater than 150;
―as of January 1, 2011 at the CE or national reception of new types of vehicles with respect to the ban on the installation of air conditioning systems designed to contain fluorinated greenhouse gases whose global warming potential is greater than 150;
―as of January 1, 2017 to all vehicles put for the first time in circulation with respect to the ban on the installation of air conditioning systems designed to contain fluorinated greenhouse gases whose global warming potential is greater than 150.

In accordance with the provisions of Article 6 of the above-mentioned Directive 2006/40/EC, the provisions of this Order are also applicable to the post-equipment installation of air conditioning systems on in-service vehicles:
- as of January 1, 2011, the air-conditioning systems designed to contain fluorinated greenhouse gases whose global warming potential is more than 150 are not used for post-equipment of vehicles received by type from that date. As of January 1, 2017, such systems are not used for post-equipment of any vehicle;
– Air conditioning systems installed in vehicles received on or after January 1, 2011 do not contain fluorinated greenhouse gases whose global warming potential is greater than 150. As of January 1, 2017, the air-conditioning systems of all vehicles no longer contain fluorinated greenhouse gases whose global warming potential is more than 150, with the exception of the reloading of air-conditioning systems containing such gases that were mounted on vehicles before that date.

For the purpose of this Order, the definition of the vehicle type is that contained in section 2-1 of Regulation (EC) No. 706/2007 referred to above.
