Judgment of 17 December 2007 to extend amendments to the National Collective Sport Agreement (No. 2511)

Minister of Labour, Social Relations and Solidarity,

Considering the Labour Code, including articles L. 133-1 and following;

In view of the decision of 21 November 2006 and subsequent decrees, including the order of 5 October 2007 , extending the national collective agreement on sport of 7 July 2005 and the texts supplementing or amending it;

Having regard to Act No. 7 of 5 July 2007 on the establishment of a subcommission certificates of professional qualification in the National Joint Employment Training Commission, to the aforementioned collective agreement;

Having regard to Act No. 9 of 1 June 2007 on the terms and conditions of the part-time employment contract, to the aforementioned collective agreement;

Having regard to Act No. 10 of 1 June 2007 on trade union sections and their means of action, to the aforementioned collective agreement;

Having regard to Act No. 11 of 5 July 2007 on the daily interruption of activity, to the aforementioned collective agreement;

Having regard to Act No. 12 of 5 July 2007 on the Certificate of Professional Qualification Animator Shot, to the aforementioned collective agreement;

Having regard to Act No. 13 of 5 July 2007 relating to the professional qualification certificate animating gymnastics activities, to the aforementioned collective agreement;

Having regard to Act No. 14 of 5 July 2007 on the certificate of professional qualification animator of savate, to the aforementioned collective agreement;

Having regard to Act No. 15 of 5 July 2007 on the Certificate of Professional Qualification Guide of Motorized Land Vehicles to the aforementioned collective agreement;

Having regard to Act No. 16 of 5 July 2007 on the modulation of working time, to the aforementioned collective agreement;

Considering the request for extension submitted by signatory organizations;

Considering the opinion published in the Official Journal of 4 October 2007;

Considering the opinions collected during the investigation;

Considering the reasoned opinion of the National Collective Bargaining Commission (subcommission of agreements and agreements) rendered at the meeting of 4 December 2007,

For all employers and employees included in the scope of the national collective agreement on sport of 7 July 2005, the provisions of Act No. 7 of 5 July 2007 relating to the establishment of a subcommission certificates of professional qualification in the national joint commission of employment training, to the aforementioned collective agreement.
The penultimate paragraph of Article 1 is extended subject to respect for provisions of Article L. 412-8 of the Labour Code, which impose a billboard in any establishment with a trade union section:
- Act No. 10 of 1 June 2007 on trade union sections and their means of action to the aforementioned collective agreement;
- Act No. 11 of 5 July 2007 on the daily interruption of activity to the aforementioned collective agreement;
- Act No. 12 of 5 July 2007 relating to the professional qualification certificate animator archery to the aforementioned collective agreement;
- Act No. 13 of 5 July 2007 on the certificate of professional qualification animating gymnastics activities to the aforementioned collective agreement;
- Act No. 14 of 5 July 2007 on the certificate of professional qualification animator of savate to the aforementioned collective agreement;
- Act No. 15 of 5 July 2007 on the Certificate of Professional Qualification Guide of Motorized Land Vehicles to the aforementioned collective agreement;
―Act No. 9 of June 1, 2007 on the terms and conditions of the part-time employment contract to the aforementioned collective agreement, excluding:
― the terms "or year" in section 4.6.1 (Definition), in that none of the mandatory clauses provided by theArticle L. 212-4-6 of the Labour Code for the implementation of the modulated part-time is not set out in section 4.6.1.
―Act No. 16 of 5 July 2007 on the modulation of working time to the above-mentioned collective agreement, excluding:
― the term "average" in the third point of the second paragraph of section 5.2.4.1 (Modulation Expense) as contrary to provisions of Article L. 212-4-6 of the Labour Code, under which the change in the duration of work shall be made from the time stipulated in the contract of work and not the average weekly duration provided for in the contract.
Section 5.2.3.4 (Full-time Work-Remuneration) is extended subject to the application of the regulatory provisions establishing the minimum interprofessional salary of growth and, on the other hand, compliance with provisions of Article L. 132-12-3 of the Labour Code.
Section 5.2.4.2 (Programmation) is extended subject to compliance provisions of Article L. 212-4-6 (6°) of the Labour Code, under which the indicative programme of the distribution of the working period is communicated in writing to the employee.
Section 5.2.4.3 (Modulated-Remuneration Part-time Work) is extended subject to the application of the regulatory provisions establishing the Inter-Professional Minimum Wage of Growth and, on the other hand, compliance with provisions of Article L. 132-12-3 of the Labour Code.

Article 2


The extension of the effects and sanctions of the above-mentioned amendments shall be made on the date of the publication of this order for the remaining period of time and the conditions provided for by the said amendments.

The Director General of Labour is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
