Order of November 26, 2007 setting out the terms and conditions for the election of representatives of civil students to the board of directors of the Higher Institute of Aeronautics and Space

The election of the two representatives of the civilian students to the board of the Higher Institute of Aeronautics and Space, designated below "the Institute", scheduled by Article 7 (9°) of the above-mentioned decreeshall be held within the framework of the College established under Title I of this Order.
Students ' representatives are elected by the list vote at a turn to the proportional representation with the distribution of the remaining seats to be filled to the strongest remains, without dressing or radiation. The seats shall be allocated in accordance with the distribution rule of Article 24 of this Order.

  • PART I COMPOSITION OF THE ELECTTORAL COLLÈGE Article 2


    For the election of the two student representatives, a college is established (i.e., College D).

    Article 3


    College D includes students in school at the Institute on polling date, preparing a national degree or a degree from the Institute. Students who have a military status are excluded from this college, PhD students with a contract of work with the institute, trainees, students in continuous training and listeners who do not have the quality of a student within the meaning of Article 5 of the aforementioned decree. College D designates two representatives to the Board of Directors.

  • TITRE II CONDITIONS OF EXERCISE OF THE LAW OF SUFFRAGE Article 4


    Students who meet the conditions to be part of College D are electors.
    Students may be electors who are also electors in another public higher education institution.

    Article 5


    The electoral list for College D is prepared under the responsibility of the Director General of the Institute. Registration on the list of electors is made on an ex officio basis from the registrations made with the tuition service.
    No one can vote if he is not on the list of electors.
    No one can have more than one vote.

    Article 6


    The Chief Executive Officer sets the date of the elections and publishes the list of electors. This list is posted in places accessible to all students of the Institute at least twenty days before the date of the election. It is sent by correspondence, within the same period, to electors who do not have access to the display sites.
    The Director-General may receive, within five days of this publication, claims relating to the composition of the list.
    After consultation with the Electoral Operations Control Board referred to in Title VI, which, in particular, deliberates on the merits of the claims, the Director General of the Institute shall determine the final election list at least ten days before the date of the election.

    Article 7


    Electors who do their schooling at a polling station vote directly on the ballot box. Electoral operations are carried out publicly, in the premises of the institute and according to a schedule decided by the director general of the institute.

    Article 8


    Electors who cannot vote personally have the opportunity to exercise their right to vote through an agent, giving them a written power to vote in their place and place.
    The agent must be registered on the electoral list in the same way as the principal.
    No one can carry more than two mandates.

    Article 9


    Electors may also vote by mail under the following conditions:
    The necessary ballots and envelopes are transmitted in a timely manner to the interested in the care of the Institute.
    The elector inserts his ballot in a first envelope (named envelope 1). This envelope, of a model fixed by the administration, shall not bear any distinctive mention or sign. The elector inserts this enclosed envelope without being cached in a second envelope (known as envelope No. 2) on which the name, first name and signature must be legibly displayed. This stamped fold is placed in a third envelope (this envelope n° 3) bearing the mention "election to the board of directors ―college D" that the elector addresses by mail to the polling station to which he is attached.
    Envelope No. 3 must reach the relevant polling station prior to the closing of the poll.

  • PART III ELIGIBILITY CONDITIONS Article 10


    All electors regularly registered on the list of electors in accordance with Articles 4 to 6 of this Order shall be eligible in College D.

    Article 11


    No one may be elected to more than one scientific, cultural and professional public institution board.

    Article 12


    When an elected member of the board of directors loses the quality for which he or she was elected or when his or her seat becomes vacant, he or she is replaced, for the remainder of the term, by the candidate of the same list immediately following the last elected candidate, unless the vacancy occurs less than three months before the term expires. In the event of impossibility, a partial renewal shall be effected under the conditions provided for in this Order.

    Article 13


    The nomination is mandatory. Each list of candidates must be accompanied by a declaration of application, signed by each candidate, including his or her name and first name as well as the degree prepared and the current year of study indicated in all letters.
    No one can be a candidate on more than one list.
    Lists of candidates and corresponding profession of faith must be filed with the Director General of the Institute against receipt no later than fifteen days before the date of the election.

    Article 14


    The Director General checks the eligibility of candidates. If he finds an ineligibility, he requests that a candidate be substituted for an ineligible candidate. The Electoral Operations Supervisory Board shall consider disputes over the transactions described in this article.
    The Director General publishes the lists of candidates who meet the eligibility conditions, by posting, in places accessible to all students of the Institute ten days at least before the date of the election.
    Any claims are addressed to the Director General within three days of posting. The Director General shall decide within three days and shall determine the final list of candidates. If a candidate fails after the nominations are published, he cannot be replaced.

  • PART IV REFERENCE AND REGULARITY OF SCRUTIN Article 15


    The ballot shall be held in secret ballot and under envelope. Only the envelopes and ballots established by the Institute shall be used for the election.
    Each ballot is a single list of candidates; there may be no other mention than the designation and date of the election and the designation of the college.
    The ballots and envelopes must be identical in colour to College D, with different colours associated with other electoral colleges.

    Article 16


    During the voting period, any propaganda is prohibited inside the voting rooms.

    Article 17


    A polling station is established for College D and voting sections can be established.
    The Director General of the Institute shall designate, for the polling station and, where appropriate, for each polling section, a president and at least two assessors, including one member of the administration and one member selected from non-candidate volunteer students.
    Each list in attendance has the right to propose a assessor. If the number of assailants proposed by the lists is greater than three, the office or section may be composed of four assessors, three of whom are designated by lot among the assessors proposed by the lists.
    The voting section collects votes to the ballot box and transmits them, without counting them, to the president of the voting office.
    The polling station and the polling division provisionally decide on the difficulties encountered during the electoral process. Their decisions are motivated and must be recorded in the minutes.
    Members of the electoral control board have access at any time to each polling station or polling division.

    Article 18


    Each polling station or section has one or more isoloirs and an urn. The office or section checks that the ballot box is empty and closed at the beginning of the election and ensures that it remains closed until the ballot is closed.

    Article 19


    For the duration of the voting operations, a copy of the electoral list certified by the Director General of the Institute remains deposited on the table around which the office or voting section is located. This copy is the starting list.

    Rule 20


    The vote is secret. The passage through isoloir is mandatory.
    The ballots and envelopes are placed at the disposal of electors in each polling station and section and remain under the responsibility of the electors.
    Each elector of College D votes for a single list using a single ballot before entering an envelope.
    After completing the identity check, the elector deposits his envelope in the urn and enters his signature on the bootlist.
    At the end of the poll, the president of the polling division forwards the ballot box, along with the stand-by list, to the president of the polling station.

  • STRENGTHENING, DISCOVERING AND RESULTS Article 21


    At the end of the poll, the polling station conducts the census of votes by correspondence. The envelopes n° 3 and the envelopes n° 2 are open. As envelopes 2 are opened, the list of electors is started and envelope 1 is filed in the ballot box containing the votes of the students who voted directly on the ballot box.
    Excepted without being open and annexed to the minutes:
    – Envelopes from electors who took part directly in the vote. In such a case, the correspondence vote is not taken into account;
    — envelopes No. 3 reached after the closing hour of the ballot;
    ― envelopes No. 2 on which the name and signature of the voter or on which the name is illegible;
    – multiple envelopes reached under the signature of the same student;
    – envelopes No. 1 reached in multiple numbers under the same envelope No. 2;
    - envelopes No. 1 bearing a distinctive mention or sign;
    – envelopes not in accordance with the model provided by the administration.
    The name of the voters whose envelopes emanate is not on the list of electors.
    The polling station shall prepare a record of the census of votes by correspondence. These are annexed to this report the envelopes which have been set aside without being opened with reference to the causes of their annexation.

    Article 22


    The remains are public. The polling station shall be among the electors at least three deputy returning officers who shall be present at the time of counting.
    Members of the electoral control board have access at any time to counting operations.
    The voting office counts the number of envelopes from the opening of the ballot box. If their number is different from that of the start, reference is made to the report.

    Article 23


    During the counting of the ballot, are not recorded in the valid votes cast and are considered null:
    white ballots;
    - the ballots found in the urn without envelope;
    ― the ballots that are ratted, torn, with overadded inscriptions or signs of recognition;
    - bulletins not in accordance with the model provided by the administration;
    – the multiple bulletins contained in the same envelope and identifying different lists.
    When several ballots in an envelope designate the same list, they are considered validly expressed and count for a single vote.
    A record of counting operations is prepared, which is annexed to the ballots considered null and the non-regulatory envelopes. Each attached bulletin or envelope must be countersigned and mention the causes of the annexation.

    Article 24


    The number of votes cast equals the total number of votes collected by all lists. The electoral quota is equal to the total number of votes cast divided by the number of seats to be filled. It is assigned to each list as many seats as the number of its votes contains the electoral quota.
    The seats not distributed by application of these provisions are allocated successively to the lists that contain the strongest remains. When a list has obtained a lower number of votes than the electoral quota, the number of votes remains.
    When several lists have the same rest, the seat returns to the list with the largest number of votes. If the lists in question obtained the same number of votes, the seat shall be assigned by lot.
    When the number of seats assigned to a list exceeds the number of candidates nominated by this list, the seats exceeding that number are not allocated; a by-election was then made.
    The seats are assigned to the candidates by order of presentation on the list.

    Rule 25


    At the end of the electoral process, the polling station shall prepare a report, signed by the members of the office, which shall be delivered to the Chairman of the Electoral Operations Control Board.
    Within three days of the end of the electoral process, the supervisory committee proclaims the results of the election that are posted, without delay, on the premises of the institute.

    Rule 26


    The results can be contested within seven days of the posting by declaration given to the Director General of the Institute who delivers it. The electoral control board shall deliberate within fifteen days of the filing of the contestation.
    Valid ballots and envelopes are retained until the dispute period expires.

  • PART VI CONTROL OF ELECTORAL OPERATIONS Rule 27


    During each election, a commission for the control of electoral operations is established which may be competent for other elections of the institute taking place at the same time. It is composed of a president and two assessors chosen by it. The Minister of Defence shall designate the Chairperson of the Board and his alternate on the proposal of the Director General of the Institute.

    Rule 28


    The Electoral Control Board shall exercise the powers set out in articles 6, 14, 17, 22 and 25 of this Order. The deliberations of the control committee are enforceable.

    Rule 29


    Any elector and the director general of the institute may invoke the irregularity or invalidity of the electoral operations before the administrative tribunal of Toulouse after having previously lodged an appeal before the electoral control board.
    The Administrative Court shall be seized by the sixth day after the decision of the Administrative Court. He's in a maximum of two months.

  • PART VII TRANSITIONAL AND FINAL PROVISIONS Rule 30


    During the first election, and subject to the conditions of Article 4 of this Order, students who have started to prepare a degree in the National Higher School of Aeronautical Construction Engineers and the National Higher School of Aeronautics and Space, as well as students starting their schooling in the Institute and who are validly registered.

    Rule 31


    The Director General of the Higher Institute of Aeronautics and Space is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
