Order of December 30, 2002 amending the August 10, 2001 Order on the Prohibition of the Import of Certain Ruminant Tissues at Risk from Subacute Spongiform Encephalopathies for Human Feed

The Minister of Agriculture, Food, Fisheries and Rural Affairs, the Minister Delegate for Budget and Budget Reform and the Secretary of State for Small and Medium Enterprises, Trade, Crafts, Professionals and Consumer Affairs,
Considering the rural code, including articles L. 236-1 and L. 237-3;
Considering the Customs Code, including articles 38-1 and 38-5;
Considering the code of consumption;
In view of Decree No. 71-636 of 21 July 1971 adopted for the application of articles 258, 259 and 262 of the rural code and relating to the sanitary and qualitative inspection of living animals and animal or animal products;
Considering the amended decision of 17 March 1992 on the conditions to be met by the butchery slaughterhouses for the production and marketing of fresh meat and determining the conditions for the sanitary inspection of these establishments;
Considering the decision of 6 June 1994 on sanitary conditions for the importation of live animals, animal products and animal or animal products from third countries;
Having regard to the decision of 11 March 1996 on health rules and veterinary controls applicable to products of animal origin from another Member State of the European Community and having the status of community goods;
Considering the amended decision of 10 August 2001 on the prohibition of imports of certain ruminant tissues at risk from communicable subacute spongiform encephalopathies for human food;
Considering the decision of 30 December 2002 suspending the direct delivery to the consumer of certain ovine and caprine cutting pieces containing spinal cord;
Considering the opinion of the French Food Safety Agency dated 20 December 2002,
Stop:

Article 1


In Article 1 of the above-mentioned Order of August 10, 2001, in the fifth preambular paragraph, the words "and, as of January 1, 2003, of the spinal cord of sheep and caprins over six months" are deleted.

Article 2


In section 1 of the above-mentioned decision of 10 August 2001, the twelfth paragraph shall be replaced by the following provisions:
" - the spinal column, excluding caudal vertebrae, transverse apophyses of lumbar and thoracic vertebrae and the wings of the sacrum, but including rachidian ganglions. »

Article 3


In section 2 of the above-mentioned decision of 10 August 2001, the fourth paragraph shall be replaced by the following provisions:
" - the thymus, or the products in containers, of cattle originating from other countries of the European Union, born between 1 January 2002 and 30 June 2002 and accompanied by a health certificate, signed by an official veterinarian and bearing the following mention: "The animals that are the subject of this certificate have been fed since their birth exclusively with foods that do not incorporate ruminant materials except milk or milk materials;
" - the thymus, or the products in container, of cattle originating from other countries of the European Union, born after 30 June 2002 and accompanied by a health certificate, signed by an official veterinarian, bearing the mention defined in the preceding paragraph, possibly completed by the following mention, in the case of use for their safe grease of ruminants: "and with the exception of ruminant greases collected before "

Section 3 of the above-mentioned Order dated 10 August 2001 is replaced by the following provisions:
“Art. 3. - Cervelles and products containing ovine and caprine species, from another Member State of the European Community and having the status of community goods, shall be accompanied by a certificate of health set out in amended Regulation No. (EC) 999/2001 and by the decree of 11 March 1996 referred to above, be accompanied by a certificate of health aged on which is marked less »

Article 5


Article 4 of the above-mentioned Order of August 10, 2001 is as follows:
“Art. 4. - For the products referred to in Annex II, excluding cervids and products containing ovine and caprine species and excluding thymus and products containing the bovine species, from another Member State of the European Community and having the status of community goods, in addition to the sanitary conditions established by the amended Regulation (EC) No. 999/2001 and by the following Order issued on March 11, 1996,
"The above-mentioned product does not contain and has not been prepared from:
"-amygdales, spleen and thymus of cattle whatever their age;
" - all or part of the head, including the eyes and tonsils, but excluding encephalus, tongue and slaughter, ovins and caprins less than six months;
" - all or part of the head, including encephalus, eyes and tonsils, but excluding the language and masseters, ovins and caprins of more than six months;
" - all or part of the head, including encephalus, eyes and tonsils, but excluding the language and masseters, ovins and caprins born or raised in the United Kingdom;
" - melted animal fat from all or part of the ruminant bone melt or prepared from adipose tissues of ruminants collected after the slit of the spinal column;
" - gelatin originated for all or part of ruminant bones. »
"As of March 1, 2003, the above reference is supplemented for the above-mentioned products, excluding fresh meats from ovine and caprine species, with a paragraph thus written:
" - spinal cord of ovins and caprins of a net weight carcass greater than twelve kilograms."

Appendix II to the above-mentioned Order dated 10 August 2001 is as follows:

Article 7


The Director General of Food at the Ministry of Agriculture, Food, Fisheries and Rural Affairs, the Director General of Customs and Indirect Rights, the Director General of Competition, Consumption and Suppression of Frauds and the Prefects are responsible, each with regard to the execution of this Order, which will be published in the Official Journal of the French Republic.
