Judgment of 29 July 2002 to extend an amendment to the collective agreement of the construction workers of the Lower Normandy region entered into within the framework of the national collective agreements of the construction workers (companies employing up to 10 employees and more than 10 employees)

Considering articles L. 133-1 et seq. of the Labour Code;
In view of the decree of 8 February 1991 extending the national collective agreement of 8 October 1990 of workers employed by the construction companies not covered by the decree of 1 March 1962 (i.e. occupying more than 10 employees);
In view of the decrees of 12 February 1991 and the successive decrees, including the decree of 23 November 2000, extending the national collective agreement of 18 October 1990 of the workers employed by the construction companies referred to in the decree of 1 March 1962 (i.e. occupying up to 10 employees) and supplementing it;
In view of the decision of 8 July 1994 to extend the collective agreement of the construction workers of the Lower Normandy region of 9 February 1994 entered into under the aforementioned national collective agreements;
Having regard to the 20 December 2001 decision on the remuneration of young people under apprenticeship contracts and under qualification contract to the above-mentioned regional collective agreement;
Considering the extension request submitted by the signatory trade union organizations;
Having regard to the notices published in the Official Journal of 6 March and 12 July 2002;
Considering the opinions collected during the investigation;
Considering the reasoned opinion of the National Collective Bargaining Commission (subcommission of agreements and agreements), rendered in session on 2 July 2002,

Article 1


For all employers and all employees included in the field of professional application of the national collective agreement of 8 October 1990 concerning the workers employed by the enterprises of the building referred to in the decree of 1 March 1962 (i.e. occupying up to 10 employees), as supplemented by the Actor No. 1 of 17 March 1992, and of the collective agreement of the workers employed by the enterprises of the building not covered by the decree of 1 March

Article 2


The extension of the effects and sanctions of the above-mentioned actor shall be made on the date of the publication of this order for the remaining period of time and the conditions provided for in that agreement.

Article 3


The Director of Labour Relations at the Ministry of Social Affairs, Labour and Solidarity and the Director of Operations, Social Policy and Employment at the Ministry of Agriculture, Food, Fisheries and Rural Affairs are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
