Decree of 18 February 2002 amending the Decree of 1 July 1996 on the conditions of application to cultural personnel and cooperation in service abroad of Decree No. 67-290 of 28 March 1967 setting out the modalities for calculating the emoluments of State personnel and public institutions of the State in service abroad

Considering Act No. 72-659 of 13 July 1972 on the situation of civil personnel of cultural, scientific and technical cooperation with foreign states;
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to amended Decree No. 67-290 of 28 March 1967 setting out the modalities for calculating the emoluments of State personnel and public institutions of the State with an administrative character in service abroad;
In light of the amended Decree No. 76-832 of 24 August 1976 on the financial organization of certain cultural and educational institutions or organizations dependent on the Ministry of Foreign Affairs and the Ministry of Cooperation, including its Article 1;
In view of the Decree of 1 July 1996 on the conditions of application to cultural personnel and cooperation in service abroad of Decree No. 67-290 of 28 March 1967 setting out the modalities for calculating the emoluments of State personnel and public institutions of the State administrative in service abroad, as amended by the Order of 9 June 2000;
Having regard to the advice of the second Joint Technical Committee of the Ministry of Foreign Affairs of 27 June 2001;
Considering the advice of the first Joint Technical Committee of the Ministry of Foreign Affairs of 12 December 2001,

Section 1 of the above-mentioned decision of July 1, 1996 is replaced by the following provisions:
"Art. 1st. - This Order sets out the conditions for the application of the Decree of 28 March 1967 referred to the personnel recruited by the Minister of Foreign Affairs to exercise in a cultural, scientific, cooperation and cultural action service or a medical-social centre of a diplomatic or consular post or in one of the establishments listed in Article 1 of the above-mentioned Decree of 24 August 1976.
"It does not apply to locally recruited and remunerated staff by the state services, including establishments listed in Article 1 of the above-mentioned Decree of 24 August 1976.
"It may be extended, by a decision of the Minister for Foreign Affairs pursuant to this Order, to agents meeting the conditions set out in section 2 below, in institutions and organizations of the same nature as those mentioned above but not under the Ministry of Foreign Affairs. »

The second paragraph of section 6 of the above-mentioned decision of 1 July 1996 is repealed.

Paragraphs 2 and 3 of Article 16 of the above-mentioned Decree of 1 July 1996 are repealed.

Article 4


1° Staff performing a task of technical or cultural cooperation with foreign States within the meaning of the law of 13 July 1972 referred to and paid in accordance with the provisions of the decree of 1 July 1996 referred to at the date of entry into force of this Order shall remain governed by the provisions that were previously applicable to them until the expiry of their contract;
2° Young people who, after their release from the active national service of cooperation with a foreign State in a school of education, complete the school year that was started and are paid according to the provisions of the decree of 1 July 1996 referred to at the date of entry into force of this order remain governed by the provisions that were previously applicable to them until the end of their contract.

Article 5


The Director General of Administration at the Ministry of Foreign Affairs and the Budget Director at the Ministry of Economy, Finance and Industry are responsible, each with respect to it, for the execution of this Order, which will take effect on 1 March 2002 and will be published in the Official Journal of the French Republic.
