Considering the code of entry and residence of foreigners and the right to asylum;
Considering the amended Organic Law No. 99-209 of 19 March 1999 on New Caledonia;
Having regard to Organic Law No. 2004-192 of 27 February 2004 on the status of autonomy of French Polynesia;
Having regard to Act No. 61-814 of 29 July 1961 as amended conferring on the Wallis and Futuna Islands the status of overseas territory;
Having regard to Act No. 71-569 of 15 July 1971 on French Southern and Antarctic Lands, as amended by Order No. 92-1150 of 12 October 1992 and Order No. 2000-374 of 26 April 2000;
Considering Act No. 2001-616 of 11 July 2001 on Mayotte;
In light of amended Order No. 2000-371 of 26 April 2000 on the conditions of entry and residence of foreigners in the Wallis and Futuna Islands;
Having regard to amended Order No. 2000-372 of 26 April 2000 on the conditions of entry and residence of foreigners in French Polynesia;
Having regard to amended Order No. 2000-373 of 26 April 2000 on the conditions of entry and residence of foreigners in Mayotte;
Having regard to amended Order No. 2002-388 of 20 March 2002 on the conditions of entry and residence of foreigners in New Caledonia;
Having regard to the amended Decree No. 46-1574 of 30 June 1946 regulating the conditions of entry and residence in France of foreigners;
Having regard to Decree No. 2004-814 of 14 August 2004 on the French Agency for the Protection of Refugees and Stateless Persons and the Refugee Appeals Board;
Considering the advice of Mayotte's General Council of 26 October 2005;
Considering the opinion of the Government of New Caledonia of 10 November 2005;
Considering the seizure of the French Polynesia government of 19 October 2005;
The State Council (inland section) heard,
Decrete:

  • Chapter I: Provisions relating to the French Refugee and Stateless Protection Agency and the Refugee Appeals Board Article 1


    The above-mentioned decree of 14 August 2004 is applicable to Mayotte subject to the following provisions:
    1° The Chairperson of the Refugee Appeals Board may take the necessary steps to establish and operate sections of the Commission serving in Mayotte;
    2° In the third paragraph of Article 2, the words "to the competent prefect and, in Paris, to the police prefect, as well as to the director of the Office of International Migration" are replaced by the words "to the representative of the State in Mayotte";
    3° In the third paragraph of Article 2, the words: "to the interested prefect and, in Paris, to the police prefect, when they make the request" are replaced by the words: "to the representative of the State in Mayotte, when the latter so requests";
    4° In the fifth paragraph of Article 2, the word "prefectural" is replaced by the words: "from the representative of the State to Mayotte";
    5° In the fourth paragraph of Article 2 and in the first paragraph of Article 3; the words: "from the title V of Book V of the Code of Entry and Residence of Aliens and the Right of Asylum" are replaced by the words: "from Article 48 of Order No. 2000-373 of 26 April 2000";
    6° In Article 4, the words: "The competent prefect and, in Paris, the police prefect may" are replaced by the words: "The representative of the State in Mayotte may";
    7° In the first paragraph of Article 27, the words: "the competent prefect or, in Paris, the police prefect, as well as the director of the International Migration Office" are replaced by the words: "the representative of the State in Mayotte";
    8° In the second paragraph of Article 27, the words: "to the competent prefect or, in Paris, to the police prefect, when they apply for it" are replaced by the words: "to the representative of the State in Mayotte, when the latter so requests";
    9° In articles 29 and 30, the words: "Minister of the Interior" are replaced by the words: "Government Representative in Mayotte".

    Article 2


    The above-mentioned decree of 14 August 2004 is applicable in the Wallis and Futuna Islands subject to the following provisions:
    1° The Chairperson of the Refugee Appeals Board may take the necessary steps to establish and operate sections of the commission serving in the Wallis and Futuna Islands;

    Article 5


    The above-mentioned decree of 14 August 2004 is applicable in the French Southern and Antarctic Lands under the conditions defined by Article L. 765-1 of the Code of Entry and Residence of Aliens and Asylum.

  • Chapter II: Provisions relating to the stay of asylum seekers Article 6


    Title III of the above-mentioned Decree of 30 June 1946 is applicable to Mayotte, subject to the following provisions:
    1° Article 14:
    (a) The words "in France" are replaced by the words "in Mayotte";
    (b) At 2°, the words "in the order provided for in Article 1 of this Decree" are replaced by the words "at 1° of Article 4 of Order No. 2000-373 of 26 April 2000";
    (c) At 4°, the words: "prefectural arrest" are replaced by the words: "arrest of the representative of the State in Mayotte";
    (d) In the last paragraph, the words: "prefecture services" are replaced by the words: "services of the State representative in Mayotte";
    2° Article 15:
    (a) In the first paragraph, the words: "a validity of one month" are replaced by the words: "a validity of three months";
    (b) In the first paragraph, the reference: "1" is replaced by the reference: "2°";

    Article 10


    I. - The foreigner who arrives in the French Southern and Antarctic Lands and requests his admission to asylum under Article L. 765-1 of the Code of Entry and Residence of Aliens and the Right of Asylum present in support of his application:
    1° The information on his or her civil status and, where appropriate, that of his or her spouse and dependent children;
    2° The documents mentioned in Article 7 of the above-mentioned Act of 15 July 1971 justifying that it has entered regularly in the French Southern and Antarctic Lands or, if not, any indications relating to the conditions of its entry and its travel routes from its country of origin.
    II. - The recipient granted, pursuant to Article L. 765-1 of the Code of Entry and Residence of Aliens and the Right of Asylum, a foreigner who solicits in the French Southern and Antarctic Lands his admission to asylum shall bear the mention "Request for Asylum formulated in the French Southern and Antarctic Lands, with a view to approaching the competent authorities of La Réunion".
    The report of the foreign national is transmitted to the senior administrator of the French Southern and Antarctic Lands. This is addressed to the prefect of La Réunion and the French Agency for the Protection of Refugees and Stateless Persons.
    III. - The administrative authority mentioned in the first paragraph of Article L. 765-1 of the Code of Entry and Residence of Aliens and the Right of Asylum is the superior administrator of the French Southern and Antarctic Lands.
    IV. - The administrative authority referred to in section 12 of the above-mentioned Act of 15 July 1971 is the deputy head of the French Southern and Antarctic Lands.

  • Chapter III: Final provisions Article 11


    Are repealed:
    1° Decree No. 99-849 of 27 September 1999 on the application in French Polynesia, in the Wallis and Futuna Islands and Mayotte of Decree No. 53-377 of 2 May 1953 concerning the French Office for the Protection of Refugees and Stateless Persons and the Commission of Appeal;
    2° Decree No. 99-511 of 21 June 1999 on asylum in New Caledonia;
    3° Decree No. 2001-294 of 4 April 2001 on asylum in overseas territories and Mayotte.

    Article 12


    The Minister of State, Minister of Interior and Land Management, the Minister of Foreign Affairs, the Minister of Employment, Social Cohesion and Housing, the Minister of Justice, and the Minister of Overseas are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.
