Having regard to Council Directive 79/622/EEC of 25 June 1979, as amended, on the approximation of the legislation of member States on protective devices in the event of overthrowing of agricultural or forestry wheeled tractors (static tests);
Having regard to Council Directive 86/298/EEC of 26 May 1986, as amended, on the approximation of the legislation of the Member States relating to the protection devices in the case of overthrowing mounted at the rear of the narrow-track agricultural or forestry tractors;
Having regard to Commission Directive 2005/67/EC of 18 October 2005 on the adaptation of annexes I and II to Council Directive 86/298/EEC, Annexes I and II to Council Directive 87/402/EEC and Annexes I, II and III to Directive 2003/37/EC of the European Parliament and the Council on the type reception of agricultural or forest tractors;
Considering Decree No. 2005-1236 of 30 September 2005 on rules, requirements and procedures for agricultural or forestry tractors and their devices;
Having regard to the decision of 22 November 2005 on the reception of agricultural or forestry tractors and their technical systems, components and entities;
Considering the opinion of the National Commission for Hygiene and Safety in Agriculture of 13 December 2005,

The CE approval is granted to any protection device in the event of spill and its attachment to the tractor defined in Article 1 of the amended 26 May 1986 directive meeting the technical requirements of Council Directive 86/298/EEC of 26 May 1986 referred to above, last amended by Commission Directive 2005/67/EC of 18 October 2005.
The CE approval is also granted to any protection device in the event of overturning and its attachment to the tractor defined in the preceding paragraph if it meets the technical requirements of either Council Directive 77/536/EEC of 28 June 1977 referred to above, or Council Directive 79/622/EEC of 25 June 1979 referred to above, if it is not a protective device fitted to the driver's seat.
Any tractor defined in Article 1 of Council Directive 86/298/EEC of 26 May 1986 referred to above shall be entitled to the CE reception provided for in this Order if it is equipped with a protection device in the event of overturning and fixing on the tractor having obtained the CE registration and that the conditions of receipt provided for in this Directive have been met.
The CE registration referred to in Article 1 above and the CE reception referred to in Article 2 above shall be issued under the conditions provided for by the decree of September 30, 2005 and the above-mentioned decree of November 22, 2005.
As of 1 January 2006, the document provided for in Article 7 of the above-mentioned Order of 22 November 2005 shall no longer be issued for a tractor type if it does not meet the requirements of Directive 86/298/EEC as amended by Directive 2005/67/EC.
The 16 January 2001 European Receipt Order regarding protection devices for overthrowing mounted at the rear of narrow-track agricultural or forestry tractors is repealed effective 1 January 2006.
The Director General of the Forest and Rural Affairs is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
