Order of December 21, 2004 amending the amended Order of June 5, 2001 concerning the carriage of dangerous goods by rail (hereinafter referred to as RID)

Minister of Economy, Finance and Industry, Minister of Equipment, Transport, Land Management, Tourism and the Sea and Minister of Ecology and Sustainable Development,
Having regard to Appendix I of Appendix B to the Convention on International Carriage by Rail (the so-called "COTIF" agreement) on the Regulations concerning the International Carriage of Dangerous Goods by Rail (the so-called "RID"), in its version applicable from 1 January 2005;
Having regard to Council Directive 96/35/EC of 3 June 1996 concerning the designation and professional qualification of safety advisers for road, rail or inland water transport of dangerous goods;
Having regard to Council Directive 96/49/EC of 23 July 1996 amended on the approximation of the legislation of member States concerning the transport of dangerous goods by rail;
Considering Act No. 263 of 5 February 1942 on the transport of dangerous substances;
Having regard to Act No. 75-1335 of 31 December 1975, as amended, on the recognition and punishment of public and private transport offences;
In view of Decree No. 77-1331 of 30 November 1977 on certain offences under the regulations on the transport of dangerous substances;
Considering Decree No. 2000-286 of 30 March 2000 on the security of the national railway network;
Considering Decree No. 2001-386 of 3 May 2001 on transportable pressure equipment;
In view of Decree No. 2003-194 of 7 March 2003 on the use of the national grid system;
Considering the amended decision of 19 November 1995 on the control of emissions of volatile organic compounds;
Having regard to the amended decision of 1 June 2001 on the carriage of dangerous goods by road (known as "ADR");
Having regard to the decision of 5 June 2001, last amended by the Order of 9 December 2003, concerning the carriage of dangerous goods by rail (hereinafter referred to as "RID Order");
In view of the opinion of the Inter-Ministerial Commission on the Transport of Dangerous Goods (CITMD) in its session of 20 October 2004,

The decision of 5 June 2001 referred to as "RID Order" is amended as follows:

Article 3


Decisions and notices of the competent authority.
Amend the table to read:
Brush the 6th line corresponding to provisions that have become deciduous.
At the 10th line, delete "after December 31, 2003".
Create an additional line that will be the 15th line, the content of which is as follows: "Tests of tests of battery cars referred to in 6.8.2.4.5 and related to operations referred to in 6.8.2.4.2 and 6.8.4.2.3".
At the last line, replace the existing text with the following: "Testations of test of tanks and their equipment of tank cars referred to in 6.8.2.4.5 carried out by an expert recognized in 6.8.2.4.6 and related to the operations referred to in 6.8.2.4.1, 6.8.2.4.2, 6.8.4.2.3 and 6.8.2.4.4 (except operations related to a modification of the approval of the prototype); "
In this same line, in the column "country", add: "European Union member countries or contractors to COTIF".

Article 14


Placarding cars.
Delete in the title of this article "and signs of road vehicles on cars".
Delete the second paragraph.

Article 14 bis


Security advisor.
Paragraph 1 on exemptions:
Replace the text of the first dash with the following:
" - transport of dangerous goods excluded from the requirements of the regulations for the carriage of dangerous goods applicable to the earth mode in question, and loading, unloading or packaging related to such transport";
In the second dash replace "1.1.3.1" with "1.1.3.6".

Article 16 bis


Internal emergency plan for yards.
In paragraph 1, replace "1.10" with "1.11".

Article 17


Notice of shipment to the Department of Industry, the Ministry of the Environment and the Ministry of Interior for certain radioactive materials.
At the end of paragraph 1:
Delete "and the infrastructure manager," and add a second sentence: "These provisions are also applicable to any shipment of fissile material package. »
Replace the text of paragraph 2 with the following text: "The carrier shall transmit the necessary information to the infrastructure manager who shall make the necessary arrangements to ensure that all train stations are notified of the movement of such shipments. »

Article 18


Acceptance of express packages and checked baggage on passenger trains.
In paragraph 2, delete "or gas boxes" and replace "1.1.3.1" with "1.1.3.6".

Article 19


Colis that can be retained by passengers on trains.
In the first paragraph, add the following two phrases: "For radioactive materials, this provision is applicable exclusively to packages in category I-BLANCHE. The carriage of radioactive material in packages of categories II-JAUNE and III-JAUNE is prohibited under these conditions. »

Rule 20


Declaration of loading of dangerous substances and marking of packages.
Replace the first paragraph of paragraph 3 with the following:
"For consignments of dangerous substances other than substances and articles of classes 1 and 7, the designation of the goods may be limited to the mentions of the class, the UN number of the goods and, where applicable, the packing group, with, for each class, the total gross mass of the packages. »

Rule 30


Accreditations, inspections and tests of tanks.
Replace the text of paragraphs 2, 4 and 5 with the following:
“2. The approvals of the prototypes of portable tanks provided for in 6.7.2.18, 6.7.3.14, 6.7.4.13 and MEGCs provided for in 6.7.5.11 shall be granted by an organization approved by the Minister responsible for the Merchant Navy.
4. The inspections and tests of tanks and their equipment of the tank cars provided for in 6.8.2.4 shall be carried out by a body approved in accordance with the procedure referred to in Article 31, or approved in accordance with 6.8.2.4.5 and in accordance with 6.8.2.4.6 by the competent authority of a COTIF contracting country and included in the list of experts recognized by the OTIF secretariat. The exceptional control provided for in 6.8.2.4.4, where the prototype approval is to be modified, may only be performed by an approved body after prior approval of the SNCF hardware management.
5. The controls and tests of portable tanks provided for in 6.7.2.19, 6.7.3.15, 6.7.4.14 and MEGCs provided for in 6.7.5.12 shall be carried out under the conditions prescribed by the amended Order of 23 November 1987 concerning the safety of ships. »

Rule 31


Accreditation procedure of organizations.
Replace the third paragraph with the following:
"For the test, inspection and verification of tanks provided for in 6.8.2.4, the approved bodies under 6.8.2.4.5 shall meet the minimum requirements of 6.8.2.4.6, which are deemed to be satisfied:
- if the organization justifies an accreditation according to EN 45004 and in the field of "pressure devices and accessories", by COFRAC, or by an accrelerant agency signatory to the multilateral agreement of EA (European co-operation for Accreditation).
- or if the body is authorized under Article 14 of Decree No. 2001-386 of 3 May 2001 and notified to the European Commission for the application of Directive 1999/36/EC in the field of tanks. »

Rule 40


Transitional provisions concerning inland transport to France.
In the third paragraph entitled “Tank Car Provisions”:
Replace "may" with "may";
Delete the fourth paragraph entitled " Flexible provisions".

Rule 41


Transitional provisions for accredited bodies.
An article 41 is drafted as follows:
"Up to 30 June 2005, in addition to the approved bodies referred to in Article 30, paragraph 4, the direction of the equipment of the SNCF is also authorized to perform the inspections and tests of the tanks and their equipment of the tank cars provided for in 6.8.2.4. »

Annex I to the above-mentioned Order of 5 June 2001 is replaced by the Regulation respecting the International Carriage of Dangerous Goods (RID), in its version applicable to 1 January 2005, which is itself Annex I to the Uniform Rules concerning the Contract for the International Carriage of Goods (CIM). This RID Regulation, including the amendments in force on 1 January 2005, is published in French by the Intergovernmental Organization for International Carriage by Rail (OTIF), Gryphenhüliweg 30, 3006 Bern, Switzerland.

Annex II to the above-mentioned decision of 5 June 2001 on the provisions applicable to the carriage of explosive substances and articles of Class 1 is amended as follows:
Annex II:
In point 2, after: "1.5" add: "or 1.6" and " 2.1" before "3";
In point 3, add "2.1" before "3".

The provisions of this Order come into force on 1 January 2005.
However, the provisions of Schedule I to the above-mentioned Order of June 5, 2001 as amended by the Order of December 9, 2003 are still applicable until June 30, 2005.

The Director of Land Transport and the Director General of Nuclear Safety and Radiation Protection are responsible, each with regard to the execution of this Order, to be published in the Official Journal of the French Republic.
