Summary

The evolution of the missions entrusted to the social security centre of migrant workers, which became the center of European and international social security connections, in application of art. 39 of Act 2002-73 of 17-01-2002 on social modernization, which amended the art. L. 767-1 of the Social Security Code, and the concern of the guardianship authorities to allow this institution to improve its way of operation, require that, on several points, the regulatory provisions of the said Code concerning both the scope of its powers and the reports it maintains with its guardianship authorities and the composition of its board of directors. The missions of the establishment are redefinite to art. R. 767-2 of that code. Thus, it is referred to the role of the focal point in relation to both foreign partners and vis-à-vis French communities and territories with autonomy in this area in terms of the implementation of social security coordination agreements. This decree also mentions, among the new missions entrusted to the institution, the decisions relating to the exceptional authorizations (or renewal) of the "detachment" of the workers, that is, the possibility for them to remain attached to the social security system of the country of origin, in case of temporary expatriation. In order to allow the definition of multi-year objectives, this decree provides for the possibility of establishing a convention of objectives and management between the institution and its guardianship authorities in art. R.767-3 of the code while, at the same time, the procedures for approval of the Board of Directors' deliberations are simplified, with an increased use of the tacit agreement, particularly for the approval of financial documents (R.767-6). In addition, the institution now receives the opportunity to recruit agents from social security funds, in accordance with the combined provisions of art. L. 767-l of the said code and art. R.767-8 under this Decree. Finally, this decree clarifies the role of guardianship administrations by ending the ambiguous situation of their representatives in the board of directors of which they are full members, while also being responsible for ex posting the exercise of guardianship powers. It is therefore anticipated that representatives of the ministries responsible for social security, budget, and agriculture will attend the council as simple government commissioners (R. 767-4).
