Summary the provisions of arts. 52 and 53 of the Act 2001-1246 of 21-12 - 2001 social security for 2002 funding improve the compensation of victims of accidents at work and their successors. This Decree specifies detailed rules for the application of these provisions. Art. 1 this text back from 100% to 80% the rate of PPI enabling the victim to obtain the increase in his pension when she appealed to a third person. The rate of 80% was selected by reference to other repair of disability schemes which already compensate the third party without requiring a disability total (compensatory allowance). In addition the Act includes among beneficiaries of the victim of accident at work, a civil solidarity pact partner and partner. It provides for an increase of 10% of the annuity that is served to them in the event of death of the victim. The same measure is applied to the annuity paid to orphaned children. As a result, art. 2 of Decree increased from 30% to 40% the allowance granted to the spouse, partner or cohabitee. At art. 3, I postponed from 16 to 20 years the age limit for payment of the annuity to children regardless of their location. the II and III increase of 10 points the annuity paid to orphans.

Article R. 434 - 3 of the social security code reads as follows: «art.» R. 434-3. -The degree of incapacity under the third paragraph of article L. 434 - 2 is set at 80%. The increase referred to in that paragraph is fixed at 40% of the pension.

Article R. 434 - 11 of the code is amended as follows: i. - the first paragraph reads as follows: "the portion of annual salary of the victim which serves as the basis for the planned pension in the first paragraph of article L. 434 - 8 in favour of the spouse, partner bound by a civil Pact of solidarity or cohabitee shall be 40%.» Mentioned in the same paragraph lasts for two years. Article R. 434 - 16 of the code is amended as follows: i. - the first six paragraphs are replaced by the following subparagraph: "the age limit laid down in the first paragraph of article L. 434 - 10 is fixed at 20 years. ''
II. - in the seventh preambular paragraph, which shall become the second subparagraph, the words: "15%" shall be replaced by the words: '25% ' and the words: "10%" with the words: '20% '.
III. - in the last paragraph, the words: '20% ' shall be replaced by the words: '30% '.
