Decree No. 2006-1765 of 23 December 2006 setting the rates of the fish tax for the year 2007

The Prime Minister,
On the report of the Minister of Economy, Finance and Industry, the Minister of Ecology and Sustainable Development and the Minister Delegate for Budget and State Reform, Government Spokesperson,
Considering article L. 236-3 of the rural code in its version in force on 1 August 2000;
Considering the environmental code, including articles L. 436-1 and L. 436-3;
Having regard to Order No. 2000-914 of 18 September 2000 on the Legislative Part of the Environmental Code;
Having regard to the advice of the Board of Directors of the High Council for Fisheries of 23 November 2006,
Decrete:

Section D. 436-1 of the Environmental Code is replaced by the following:
"Art. D. 436-1. - I. The rates of the fish tax due by the members of the registered fishing and fish farming associations, the associations of amateur fishermen to the equipment and nets on the waters of the public domain and the associations of professional freshwater fishermen are set and follows for the year 2007:
1° Full-time or part-time professional fishermen, including adjudicaters, cofermiers and holders of professional fishing licences on public waters: 99 . The tax rate is 8.80 for the companions of these professional fishermen;
2° Amateur fishermen with gear and nets in the waters of the public domain: 8.80;
3° Other amateur fishermen in the 2nd category:
(a) Fishermen on the lines, on the vermée: 8.80;
(b) Fishermen to launch, to artificial fly, to live, to dead or artificial fish, to shrimp or shrimp balances and to equipment provided for in article R. 436-23, fishermen to machinery and nets in non-domanial watercourses, persons practicing night carp fishing, frog fishermen: 8.80;
4° Amateur fishermen in the 1st category: 8,80;
5° Amateur fishermen under the age of sixteen as of January 1 of the year, members of an approved fishing and fish farming association, regardless of fishing mode, without prejudice to that provided for in Article L. 436-2: 0;
6° Amateur fishermen, members of a registered fishing and fish farming association, holders of a vacation fishing card, valid for 15 consecutive days between June 1 and September 30: 3.80;
7° Amateur fishermen in the 2nd class watercourses and in the 1st and 2nd category water bodies, members of a registered fishing and fish farming association, holders of a day fishing card: 1 .
II. - Any amateur fisherman who is fishing for migratory salmonids (sea trout and salmon) must pay an additional fee at the rate of 20 .
III. - Any professional fisherman who is fishing for migratory salmonids (sea trout and salmon) must pay an additional fee at the rate of 30 .
IV. - Any professional civelle fisherman must pay an additional tax at the rate of 230 .
V. - Any civelle amateur fisherman must pay an additional fee at the rate of 20 . »

The Minister of Economy, Finance and Industry, the Minister of Ecology and Sustainable Development and the Minister for Budget and State Reform, the spokesperson for the Government, are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
