Decree No. 2003-1359 of 30 December 2003 amending Decree No. 90-90 of 24 January 1990 concerning the special status of teachers of professional agricultural school

The Prime Minister,
On the report of the Minister of Agriculture, Food, Fisheries and Rural Affairs, the Minister of Equipment, Transport, Housing, Tourism and the Sea, the Minister of Economy, Finance and Industry and the Minister of Public Service, State Reform and Land Management,
Given the Civil and Military Pension Code;
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to Act No. 2003-775 of 21 August 2003 on pension reform, including article 66;
Having regard to amended Decree No. 51-1423 of 5 December 1951 setting out the rules that must be determined the seniority of the staff appointed in one of the bodies of officials of the teaching under the Ministry of National Education;
In view of the amended Decree No. 90-90 of 24 January 1990 concerning the special status of teachers of agricultural vocational high school;
Considering the advice of the Departmental Joint Technical Committee of the Ministry of Agriculture, Food, Fisheries and Rural Affairs of 9 October 2003;
Considering the advice of the Departmental Joint Technical Committee of the Ministry of Equipment, Transport, Housing, Tourism and the Sea dated November 21, 2003;
The State Council (Finance Section) heard,
Decrete:

  • PART I: PERMANENT PROVISIONS Article 1


    Article 1 of the aforementioned Decree of 24 January 1990 is amended as follows:
    I. - In the third paragraph, the word "grades" is replaced by the word "classes".
    II. - The fourth paragraph is repealed.

    Article 2


    In the seventh paragraph of Article 1, in the titles of Chapter II, sections 1 and 2, in the first three paragraphs of Article 10, in the seventh paragraph of Article 12, in the first paragraph of Article 19, in the first, third and fifth paragraphs of Article 20 and in Article 25-1 of the same Decree, the words "of the second grade" are deleted.

    Article 3


    The first three paragraphs of Article 4 of the Order are replaced by the following:
    "Professional agricultural high school teachers are recruited by external, internal and third competitions; they are held after an internship under the conditions set out in section 10 below. »

    Article 4


    In the first paragraph of Article 5, Article 6 and Article 6-1, in the last paragraph of Article 10 and in Article 25 of the same Decree, the words: "second grade of" are deleted.

    Article 5


    The provisions of 1° of Article 6 of the same Decree are repealed.
    The 2°, 3° and 4° of this same article are the 1°, 2° and 3° respectively.

    Article 6


    The provisions of articles 10-1 and 21 as well as those of the second paragraph of article 23 of the same decree are repealed.

    Article 7


    In the ninth paragraph of Article 12 of the Decree, the words "second grade" are replaced by the word "body".

    Article 8


    Article 18 of the same decree is amended as follows:
    I. - The first two paragraphs, 1°, the first table and 2° are replaced by the following:
    "The advancement of the professional agricultural high school teachers of the normal class takes place, all disciplines combined, part to choice, part to choice, part to seniority.
    The increment of the interested has effect of the day when they meet the conditions set out in the table below: »
    II. - In the paragraph following the second table, the words "and for each grade" are deleted.

    Article 9


    The second sentence of the first paragraph of Article 24 of the Decree is replaced by the following provisions:
    "For this purpose, the normal body of professional agricultural high school teachers is affected by the characteristic coefficient 135. »

    Article 10


    In the sixth paragraph of Article 29 of the same Decree, the words "of rank" are deleted.

  • PART II: TRANSITIONAL PROVISIONS Article 11


    I. - The professors of agricultural vocational high school of the first grade governed by the provisions of the decree of 24 January 1990 referred to in its earlier version than that of this decree are reclassified to the normal class of the body of professional agricultural high school teachers in accordance with the provisions of article 8 of the decree of 5 December 1951 referred to above.
    Services performed in the original grade are similar to services performed in the host grade.
    For the purposes of the previous paragraph, the first grade of professional agricultural high school teacher is affected by the characteristic coefficient 115.
    II. - Professors of the second-grade agricultural vocational high school and trainees of the normal class and professors of the second-grade agricultural vocational high school of the off-class governed by the provisions of the decree of 24 January 1990 referred to in its earlier version of the decree are reclassified to equal levels, respectively, as holder and trainee in the normal class and in the out-class body of the teachers of agricultural high school.
    They retain the seniority they had acquired in their original grade. The services they have performed are considered to be services performed in the host grade.

    Article 12


    For the purposes of the provisions of Article L. 16 of the Civil and Military Retirement Pension Code in its writing prior to January 1, 2004 to the professors of agricultural vocational high school of the first rank retired, the assimilations provided to fix the new treatment indices referred to in Article L. 15 of the said Code are carried out in accordance with the following table:

    Article 13


    For the purposes of the provisions of Article L. 16 of the Civil and Military Retirement Pension Code in its writing prior to January 1, 2004 to the second grade agricultural professional high school teachers belonging to the normal class and to the retired off-class, the assimilations planned to fix the new treatment indices referred to in Article L. 15 of the said Code are carried out at the level identity level, respectively in the normal class and in the outside school

    Article 14


    The competent administrative commission in respect of the second grade professional agricultural high school teachers is competent in respect of the body of professional agricultural high school teachers until the expiry of the term of its members.

    In all existing regulatory texts, the reference to the first grade of the body of professional agricultural high school teachers is deleted and the reference to the normal class and the second grade of the body of professional agricultural high school teachers is replaced by the reference to the normal class and the out-class body of professional agricultural high school teachers.

    Article 16


    The Minister of Economy, Finance and Industry, the Minister of Equipment, Transport, Housing, Tourism and the Sea, the Minister of Agriculture, Food, Fisheries and Rural Affairs, the Minister of Public Service, State Reform and Land Management, and the Minister Delegate for Budget and Budget Reform are responsible, each in the case of the Journal, for the execution of the decree published in the French Republic.
