Given the Civil and Military Pension Code;
Having regard to Act No. 2003-775 of 21 August 2003 on pension reform, including article 66;
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to amended Decree No. 51-1423 of 5 December 1951 setting out the rules that must be determined the seniority of the staff appointed in one of the bodies of officials of the teaching under the Ministry of National Education;
Having regard to Decree No. 90-89 of 24 January 1990 on the special status of the principal advisers and education advisers of agricultural educational institutions, as amended by Decree No. 97-921 of 7 October 1997, No. 2001-33 of 10 January 2001 and No. 2003-965 of 7 October 2003;
Considering the advice of the Departmental Joint Technical Committee of the Ministry of Agriculture, Food, Fisheries and Rural Affairs of 9 October 2003;
Considering the advice of the Departmental Joint Technical Committee of the Ministry of Equipment, Transport, Housing, Tourism and the Sea dated November 21, 2003;
The State Council (Finance Section) heard,
Decrete:
The above-mentioned decree of 24 January 1990 is amended as follows:
I. - In the title, the words "and advisers" are deleted.
II. - Before article 1, the title is inserted:
« TITRE I
« PERMANENT PROVISIONS »
III. - Section 1 is replaced by the following:
"Art. 1st. - The principal education advisers of agricultural educational institutions form a body classified in category A provided for in section 29 of the law of 11 January 1984 referred to above.
Its members are appointed and held by order of the Minister for Agriculture. »
IV. - The first paragraph of section 2 is repealed.
V. - In sections 3 and 4, the words "and education advisers" are deleted.
VI. - At the b of the 2nd of Article 5, the words: "education advisers as well as those" are deleted.
VII. - The second paragraph of Article 8 is replaced by the following provisions:
"The body of primary education advisers is affected by the characteristic coefficient 135. »
VIII. - Section 9 is repealed.
IX. - In the first paragraph of Article 11, the words: "the lists of prouvable officials of each of the two bodies" are replaced by the words: "the list of prouvable officials of the body of the principal education advisers".
X. - In section 15, the words "parity administrative commissions of education advisers and chief education advisers" are replaced by the words "of the parity administrative commission of the chief education advisers".
XI. - Before section 19, it is inserted the title: « Title II. - Transitional provisions."
Education advisers governed by the provisions of the decree of 24 January 1990 referred to in its earlier version than that of this decree are titularized and reclassified in the normal class of the body of the principal education advisers in accordance with the provisions of Article 8 of the decree of 5 December 1951 referred to above.
For the purposes of the preceding paragraph, the body of the education advisors is affected by the characteristic coefficient 115.
For the purposes of the provisions of Article L. 16 of the Civil and Military Retirement Pension Code in its writing prior to January 1, 2004 to the Retired Education Advisors, the assimilations provided for setting the new salary indices referred to in Article L. 15 of the said Code are made in accordance with the following table:

In all existing regulations, reference to the body of education advisors is removed.
The Minister of Economy, Finance and Industry, the Minister of Equipment, Transport, Housing, Tourism and the Sea, the Minister of Agriculture, Food, Fisheries and Rural Affairs, the Minister of Public Service, State Reform and Land Management, and the Minister Delegate for Budget and Budget Reform are responsible, each in the case of the Journal, for the execution of the decree published in the French Republic.
