Summary

The Forest Guidance Act 2001-602 of 09-07-2001 (art. 21) provides for the creation of groupings of employers whose main purpose is to replace them in the event of temporary incapacity or absence for reasons such as illness, accident or leave. This decree extends to the aforementioned companies the benefit of the provisions of the art. R. 127-9-1 to R. 127-9-8 of the Labour Code which define the status, activity and conditions of accreditation of employer groupings whose main purpose is to make alternates available to agricultural operators in the event of absence for the reasons listed above.

The Prime Minister,
On the report of the Minister of Social Affairs, Labour and Solidarity and the Minister of Agriculture, Food, Fisheries and Rural Affairs,
Considering the Labour Code, including Article L. 127-9;
Considering the rural code, including article L. 722-3;
The State Council (Social Section) heard,
Decrete:

Section II of Chapter VII of Book I II of the Labour Code is amended as follows:
I. - The title of the section is as follows:

“Section II

"Special provisions for employer groupings with the primary purpose of making substitutes available to agricultural operators and business leaders engaged in forestry work"
II. - The section is supplemented by an article R. 127-9, as follows:
"Art. R. 127-9-9. - The provisions of sections R. 127-9-1 to R. 127-9-8 also apply to employer groupings whose main purpose is to make alternates available to business leaders performing the forestry work referred to in section L. 722-3 of the rural code. »

The Minister of Social Affairs, Labour and Solidarity and the Minister of Agriculture, Food, Fisheries and Rural Affairs are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
