Judgment of December 21, 2006 on the vacancy announcement of lecturer positions at universities-patients offered for transfer and recruitment for the year 2007 and setting out the terms and conditions of application

Minister of National Education, Higher Education and Research and Minister of Health and Solidarity,
Considering the public health code, including articles R. 6152-1 to R. 6152-99;
Having regard to amended Decree No. 84-135 of 24 February 1984 on the status of teachers and hospitals in hospitals and universities, including its title III, chapter II;
Having regard to Decree No. 86-10 of 3 January 1986 establishing the conditions of service in cooperation with hospital and university staff;
Having regard to the decree of 2 January 1986 establishing the conditions under which candidates of foreign nationality may be allowed to participate in the contests mentioned in articles 48 and 61 of Decree No. 84-135 of 24 February 1984;
In view of the amended decision of 17 September 1987 setting out the procedure for recruiting professors from universities-patients and lecturers from universities-patients;
Having regard to the amended decision of 26 January 1993 setting out the list of disciplines in which a practical pedagogical examination is organized pursuant to article 52 of amended Decree No. 84-135 of 24 February 1984, which provides for the status of teachers and hospitals in hospitals and universities;
In view of the decision of 18 December 2006 on the equivalence or dispensation of certain diplomas required for the recruitment of teachers and hospital staff from hospital and university centres and dental care, education and research centres,
Stop:

Article 1


The lecturer positions of the hospital-practice universities designated in the lists annexed to this Order (Appendix I a and I (b) are declared vacant and may be filled under the following conditions.

  • PART I: MUTATION Article 2


    The lecturers of the universities-hospital practitioners who satisfy the condition of seniority provided for in article 47 of the aforementioned decree of 24 February 1984 may apply for their transfer to the jobs set out in annexes I a and I b, under the conditions defined below.
    However, pursuant to Article 1 of the above-mentioned Decree of January 3, 1986, jobs involving co-location are not available for transfer.

    Article 3


    Within twenty-one days of publication in the Official Journal of this Order, candidates for transfer must address to the Director of the Medical Training and Research Unit and the Director General of the University Hospital Centre:
    - a transfer request, which can be downloaded on the website http ://www.education.gouv.fr, under the heading "tools - forms", then "for national education officers", "supplies in the hospital-university sector", "recruitment forms for the hospital-university sector (2)";
    - a detailed curriculum vitae;
    - a list of their titles and works.
    The candidates shall, within the same period, send a copy of the letter of application and the curriculum vitae:
    - on the one hand, at the Ministry of National Education, Higher Education and Research, General Directorate of Human Resources (Health Personnel Office [DGRH A 2-4]), 34 rue de Châteaudun, 75436 Paris Cedex 9;
    - on the other hand, in the Ministry of Health and Solidarity, direction of hospitalization and organisation of care (office of hospital and hospital-university medical policy [DHOS M 2]), 14, avenue Duquesne, 75350 Paris 07 SP.

    Article 4


    Upon the expiry of the period specified in Article 3 of this Order, the following procedure shall be applied:
    For each job to be filled:
    - the Director General of the University Hospital immediately submits the application(s) received to the Medical Establishment Commission, which meets in restricted training to hospital-university staff performing functions at least equivalent to those to which the applicant applies;
    - the director of the medical training and research unit immediately seizes the board of the unit which meets in restricted training to teachers of at least equal to that of lecturer.
    These two instances have a time limit of twenty-one days to make their opinions known by conducting, in the event of multiple applications, a classification of candidates who have received a favourable opinion.

    Article 5


    The notices are attached to the applications and sent within six weeks of the date of publication in the Official Journal of this Order, by the Director of the Medical Training and Research Unit at the Ministry of National Education, Higher Education and Research and by the Director General of the University Hospital Centre at the Ministry of Health and Solidarity.

  • PART II: RECRUTMENT CONCOURS Article 6


    Individuals of French nationality and nationals of the European Union or other States parties to the Agreement on the European Economic Area or the Swiss Confederation may apply to the competitive examinations for lecturers from universities-patients, in the following conditions defined by type of examinations.
    These conditions, with the exception of the ageing condition, are appraised at the deadline for submission of applications set out in section 7 below.


    A. - Type 1 competition organized under article 48 (1°)
    Decree No. 84-135 of 24 February 1984
    (Cf. annex II)


    Candidates:


    I. - In clinical disciplines


    The heads of clinics at universities-assisted hospitals and former chiefs of clinics at universities-assisted hospitals under the age of forty-five as of January 1 of the year of the competition.


    II. - In biological and mixed disciplines


    Academic hospital assistants and former university hospital assistants under the age of forty-five as of January 1 of the year of the competition.


    III. - In all disciplines


    University hospital practitioners and hospital practitioners.
    These candidates must justify at least one year of effective functions in either of these qualities and be held in one of the following degrees:
    - degree of studies and research in human biology;
    - State doctorate in human biology;
    - national master's degree;
    - degree of in-depth studies;
    - PhD mentioned in article L. 612-7 of the Education Code;
    - postgraduate doctorate;
    - enabling the conduct of research;
    - PhD in State Science;
    - State doctoral in pharmaceuticals;
    - State doctorate in odontology;
    - degree of engineering doctor;
    - degree in studies and research in odontological sciences.
    Diplomas and foreign titles allowing access to similar teacher-research functions in the higher education institutions of the country in which they are issued may be admitted in equivalence or exempt from the French diplomas listed above. Equivalences or dispensations are granted, as the case may be, by the appropriate subsection or intersection of the National Council of Universities for medical disciplines sitting in jury training.


    B. - Type 2 organized under Article 48 (2°)
    Decree No. 84-135 of 24 February 1984
    (Cf. annex II)


    Candidates:
    Applicants who do not meet the conditions set out in A above and who hold one of the following degrees:
    - enabling the conduct of research;
    - State doctorate;
    - doctorate provided for in Decree No. 84-573 of 5 July 1984;
    - postgraduate doctorate;
    - degree of engineering doctor;
    Diplomas and foreign titles allowing access to similar teacher-research functions in the higher education institutions of the country in which they are issued may be admitted in equivalence or exempt from the French diplomas listed above. Equivalences or dispensations are granted, as the case may be, by the appropriate subsection or intersection of the National Council of Universities for medical disciplines sitting in jury training.

    Article 7


    The application file is sent, preferably in a single recommended consignment (without notice of receipt), no later than January 19, 2007, at midnight (the cachet of the advertised post), to the consignee designated below according to the contest discipline:
    - for the biological and mixed disciplines listed in List A (Appendix III), at the Ministry of Health and Solidarity, direction of hospitalization and organization of care (office of medical examinations, DHOS M4), 14, avenue Duquesne, 75350 Paris 07 SP;
    - for the clinical disciplines listed in List B (Appendix III) and, where applicable, the disciplines components of an intersection, at the Ministry of National Education, Higher Education and Research, General Directorate of Human Resources (Health Personnel Office, DGRH A2-4), 34 Rue de Châteaudun, 75436 Paris Cedex 09.

    Article 8


    The application must include the following documents:
    (a) A dual copy nomination statement, which can be downloaded on the website http://www.education.gouv.fr, under the heading "tools, forms", then "for national education officers", "students in the hospital-university sector", "recruitment forms for the hospital-university sector (2)";
    (b) A photocopy of the national identity card or, if not, a certificate of nationality;
    (c) A photocopy of diplomas (for foreign diplomas and titles: attach an application written on paper to obtain the equivalences or dispensations referred to in Article 6);
    (d) An administrative certificate showing the duration of the functions required to be submitted under section 48 (1°) (Type 1 examination), copy of the appointment orders;

    (e) For candidates who wish to be enrolled in a different hospital discipline from the academic discipline, an application written on a free paper specifying the title of the university and hospital disciplines considered (the academic discipline being the one indicated on the declaration of application) and that this hospital discipline be included in respect of their name in the event of registration on the admission list referred to in article 52 of the aforementioned decree of 24 February 1984; only applicants enrolled in the relevant hospital discipline will be able to apply the jobs referring to this discipline at the hospital level;
    (f) A detailed curriculum vitae;
    (g) Two envelopes of 162 x 229 mm, denominated at the applicant's address and postaged at the current tariff;
    (h) For people seeking a backward or age limit exemption, an application, which can be downloaded on the website http://www.education.gouv.fr, under the heading "tools, forms", then "for national education officers", "students in the hospital-university sector", "recruitment forms for the hospital-university sector (2)", and any document to assess the application.
    Only records with all required parts will be reviewed.
    Any document in a foreign language must be translated into French.

    Article 9


    For the purposes of articles 48 and 50 of the above-mentioned decree of 24 February 1984, the date of commencement of the tests is set on 29 March 2007.
    Candidates, in a discipline whose employment at least has been filled by transfer, are notified, by individual letter, of the decrease in the number of jobs offered, or of the removal of the contest if all the jobs offered have been filled by transfer. In the latter case, the application is automatically cancelled.
    Candidates who wish to withdraw their nominations may do so by the date fixed for the start of the examination, only by registered letter to the office.

    Article 10


    The list of candidates authorized to compete is jointly decided by the Minister of National Education, Higher Education and Research and the Minister of Health and Solidarity.

    Article 11


    Authorized candidates are required to submit directly, at a date and to the addresses indicated to them:
    1° To all members of the competent jury:
    (a) A presentation of their titles and works;
    (b) Where applicable, a copy of the application for equivalence or exemption for foreign diplomas and securities;
    (c) If applicable, a copy of the application referred to in e of section 8 above.
    2° To the president of the competent jury and to the rapporteurs, in addition to the above-mentioned document:
    (a) A copy of the certificates, diplomas and certificates filed during the registration;
    (b) To their choice, all or part of their works and from the drawings apart from their publications.

  • TITRE III : CANDIDATURES À TITRE ÉTRANGER Article 12


    Persons of foreign nationality, meeting the conditions set out in article 1 (paragraphs 2 and 3) of the above-mentioned decision of January 2, 1986, may apply for the award of the title of lecturer of universities - a foreign hospital practitioner.

    Article 13


    For all disciplines, the files must be sent, no later than January 19, 2007, at midnight (the stamp of the position in question), to the Ministry of Health and Solidarity, direction of hospitalization and organisation of care (the office of medical examinations, DHOS M4), 14, avenue Duquesne, 75350 Paris 07 SP.
    The nomination form shall be as follows:
    (a) A completed individual registration notice with a reasoned opinion from the competent local authorities regarding the teaching activities, also covering the quality of the candidate's titles and work and specifying the possible prospects for his/her future in his/her country of origin;
    (b) A certified copy of the diplomas referred to in Article 1 of the above-mentioned Decree of 2 January 1986;
    (c) A certificate relating to the three-year exercise of teaching activities aimed at the preparation of a doctor's degree;
    (d) A detailed curriculum vitae.
    Only records with all required parts will be reviewed.
    Any document in a foreign language must be translated into French.

    Article 14


    The provisions of articles 9, 10 and 11 shall apply to foreign candidates.

    Article 15


    The Director General of Human Resources and the Director of Hospitalization and Care Organization are responsible, each with respect to him, for the execution of this Order, which will be published, as well as its annexes, in the Official Journal of the French Republic.
