Considering the social security code, including articles L. 351-10 and L. 634-2;
Considering the rural code, including article L. 742-3;
Considering the opinion of the Interdepartmental Coordination Committee on Social Security of 28 November 2003;
Having regard to the advice of the Board of Directors of the National Old Age Insurance Fund of Employees dated 15 December 2003;
Considering the opinion of the joint delegation of the boards of directors of the national funds of the autonomous old-age insurance organisations of the artisanal, industrial and commercial professions of 22 December 2003,
Decrete:
Section V of Chapter 1 of Title V of Book 3 of the Social Security Code is supplemented by an article D. 351-2-1 as follows:
"Art. D. 351-2-1. - The minimum amount to which, upon liquidation, an old-age pension at a full rate under section L. 351-10 is set at EUR 6,511.06 per year as of January 1, 2004.
"Only the holders of an old-age pension for an insurance period under the general social security system shall be entitled to the full minimum amount of the minimum amount equal to the third paragraph of section L. 351-1 applicable to the insured.
"When this period is less than the limit set out in the preceding paragraph, the minimum amount is reduced to the prorated number of quarters of insurance actually completed reported to that limit.
"This minimum amount is increased for periods that have given rise to the expense of the insured, to reach EUR 6,706,39 per year as of January 1, 2004 when the total of these periods is greater than or equal to the limit set out in the third paragraph of section L. 351-1 applicable to the insured. It may be reduced under the conditions set out in the third paragraph of this article.
"The amounts provided for in the preceding paragraphs are revalued on the same dates and under the same conditions as those provided for old-age pensions under section L. 161-23-1.
"In addition to the minimum amount determined, if applicable, the bonuses, increases and annuities referred to in the second paragraph of section L. 351-10. »
The Minister of Social Affairs, Employment and Solidarity, the Minister of Economy, Finance and Industry, the Minister of Agriculture, Food, Fisheries and Rural Affairs, the Minister Delegate for Budget and Budget Reform and the Secretary of State for Small and Medium Enterprises, Trade, Crafts, Professionals and Consumer Affairs will be responsible, each in the matter of the decree published, for the purpose of the publication of the Journal
