Having regard to the amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants;
Having regard to Act No. 86-33 of 9 January 1986, amended with statutory provisions relating to the public hospital service;
In view of the amended Decree No. 88-1077 of 30 November 1988 establishing the special statutes of nursing staff of the public hospital service;
In view of the amended Decree No. 89-609 of 1 September 1989 establishing the special statutes of the hospital civil service rehabilitation staff;
In view of the amended Decree No. 89-613 of 1 September 1989 on the special statutes of medical and technical staff of the hospital public service;
Having regard to Decree No. 2001-1375 of 31 December 2001 on the special status of the body of health care executives of the public hospital service;
Having regard to the advice of the Higher Council of the Hospital Public Service dated 7 October 2003;
The State Council (Social Section) heard,
Decrete:
Decree No. 2001-1375 of 31 December 2001 on the special status of the body of health care executives of the public hospital service is thus amended:
Section 2 is amended as follows:
(a) The first is thus written:
« 1° Internal title competition open to hospital officials with a health framework diploma, subject to the bodies governed by decrees 88-1077 of 30 November 1988, n° 89-609 of 1 September 1989 and n° 89-613 of 1 September 1989 referred to above, counting on 1 January of the year of the contest at least five years of effective services performed in one or more of the aforementioned bodies, as well as to non-prisoners of the public service »
(b) At 2°, the words "as defined in article 2 of Decree No. 95-926 of 18 August 1995 establishing a health framework diploma" are deleted.
(c) After the third preambular paragraph, a sub-item is inserted:
"Candidates who hold the certificates referred to in Article 2 of Decree No. 95-926 of 18 August 1995 establishing the health framework diploma are exempted from the detention of the health framework diploma to attend the title competitions provided for in 1° and 2° of this article. »
In the last paragraphs of sections 21 and 24, the words "from January 1, 2004" are replaced by the words "from December 31, 2003".
The Minister of Economy, Finance and Industry, the Minister of Health, the Family and Persons with Disabilities, the Minister of Public Service, State Reform and Land Management, and the Minister Delegate for Budget and Budget Reform are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
