Considering the social security code, including chapter IV of title I of Book VIII;
Considering the referral of the General Council of Guyana dated 31 December 2001;
Considering the referral of the General Council of Martinique dated 31 December 2001;
Considering the opinion of the General Council of Guadeloupe of 10 January 2002;
Having regard to the opinion of the General Council of the Meeting dated 14 February 2002,
Decrete:
Section D. 814-4 of the Social Security Code is replaced by the following provisions:
"Art. D. 814-4. - The file is sent by the mayor to the service of the special old-age allowance which decides on the grant or refusal of the allowance and which fixes the amount. In overseas departments, the file is addressed to the prefect of the department of the applicant's residence through the mayor. The prefect collects all the information necessary for the investigation of the file. When the latter is in good condition, he shall, with his opinion, transmit it to the service of the special old-age allowance that decides on the grant or refusal of the allowance and that fixes the amount. »
In article D. 814-6 of the Social Security Code, a paragraph is added as follows:
"The prefect of the department of the residence of the allocator, either on its own or at the request of the special old-age allowance service, shall be carried out by the departmental director of health and social affairs in any investigation into the resources of the persons concerned. It informs, as necessary, the service of the special allocation of the outcome of these investigations. »
The Minister of Social Affairs, Labour and Solidarity and the Minister of Overseas are responsible, each with regard to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
