Order dated 7 December 2006 extending an agreement entered into within the framework of the Union des chambres syndicats des métiers du verre (No. 2306)

Minister of Employment, Social Cohesion and Housing,
Considering the Labour Code, including articles L. 133-1 and following;
In view of the decree of 9 February 2004 and the successive decrees, including the decree of 20 July 2006, extending the national collective agreement of the Union des chambres syndicats des métiers du verre of 18 December 2002 and the texts that amended and supplemented it;
Having regard to the agreement of 22 March 2006 on vocational training, concluded under the aforementioned national collective agreement;
Considering the request for extension submitted by signatory organizations;
Considering the opinion published in the Official Journal of 7 July 2006;
Considering the opinions collected during the investigation;
Considering the reasoned opinion of the National Collective Bargaining Commission (subcommission of agreements and agreements), rendered in session on November 28, 2006,

Article 1


For all employers and all employees included in the scope of application of the national collective agreement of the Union of Trade Union Chambers of the glass trades of 18 December 2002, the provisions of the agreement of 22 March 2006, relating to vocational training, concluded within the framework of the aforementioned national collective agreement, excluding the last sentence of the second paragraph of Article 15-20, as contrary to the provisions of Article L-2.
The second and final paragraphs of Article 8 are extended subject to the application of the provisions of Article L. 981-1 of the Labour Code, under which the professionalization contract is intended to allow the beneficiary to acquire one of the qualifications provided for in Article L. 900-3 of the Labour Code.
The second paragraph of Article 10 of the Agreement shall be extended subject to the application of the provisions of Article D. 981-7 of the Labour Code, whereby only the expenses set out by the employer beyond the lump sums provided for in Article L. 983-1 of the Labour Code are attributable to participation in the financing of continuing vocational training.
The first sentence of the second paragraph of Article 16 shall be extended subject to the application of the provisions of Article L. 931-20-2 of the Labour Code under which employees employed under a fixed-term contract may enjoy the individual right to pro rata temporis training, after a period of four months.
The third paragraph of Article 21 shall be extended subject to the provisions of Article L. 951-1-II of the Labour Code, as set out in Article 3 of Order No. 2005-895 of 2 August 2005, subject to certain mandatory levies thresholds, whereby employers occupying ten to less than twenty employees are partially exempted from the legal and conventional mass payments that are applicable to them and shall, in particular, devote 1.05 per cent (and not)

The extension of the effects and sanctions of the above-mentioned actor shall be made on the date of the publication of this order for the remaining period and the conditions provided for by the said actor.

Article 3


The Director General of Labour is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
