In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Considering Decree No. 2004-1105 of 19 October 2004 on the opening of recruitment procedures in the public service of the State;
Having regard to Decree No. 2005-1215 of 26 September 2005 on common statutory provisions applicable to the bodies of State administrative officers and certain similar bodies;
Considering the opinion of the Joint Central Joint Committee of the Caisse des Dépôts et consignations (restricted training for public law officers) dated 21 July 2006;
The State Council (Finance Section) heard,
Decrete:
It is established at the Caisse des dépôts et consignations a corps d'attachés governed by the aforementioned decree of 26 September 2005 and by the provisions of this decree, which is managed by the Director General of the Caisse des dépôts et consignations.
In addition to the tasks set out in Article 2 of the above-mentioned Decree of 26 September 2005, the administrative officers of the Caisse des Dépôts et consignations may perform functions requiring specific knowledge in actuarial, banking, financial and accounting matters, as well as in the field of management control, local development, control of work and analysis of computer processes and human resources management. They may also participate in the design of work and studies related to these techniques.
For the recruitment of administrative assistants of the Caisse des dépôts et consignations, the contests provided for in 2° of Article 4 of the above-mentioned Decree of 26 September 2005 may be organized specifically for the purpose of filling posts within the specific missions mentioned in Article 2. These contests are open in one or more specialties.
The general organization rules, the list of specialties referred to in section 3, the nature and program of the examinations and examinations are determined by joint order of the Minister for Public Service and the Director General of the Caisse des Dépôts et consignations. The procedure for organizing competitions and professional examinations and the composition of the jury shall be determined by order of the Director General of the Caisse des Dépôts et consignations.
I. - The maximum number of administrative assistants that can be promoted each year to the rank of senior administrative officer is determined by applying a promotion rate to the staff of the public servants fulfilling the conditions for this grade promotion. This workforce is estimated at 31 December of the year prior to the year in which promotions are pronounced.
II. - The promotion rate referred to in the previous paragraph shall be determined by order of the Director General of the Caisse des Dépôts et consignations. This order is forwarded to the ministers responsible for the budget and the public service for information. Staff information is provided electronically and by posting at the facility premises.
The number of promotions to the rank of principal striker issued under the advance table provided for in Article 24 of the above-mentioned decree of 26 September 2005 cannot exceed one third of the total number of promotions issued in this rank pursuant to Articles 23 and 24 of the same decree.
The Central Administrative Officers and the Principal Administrative Officers of the 2nd Class and 1st Class of the Fund of the deposits and consignations governed by Decree No. 95-888 of 7 August 1995 establishing the common statutory provisions applicable to the Central Administrative Officers and the technical assistants and chief technical assistants of 2nd Class and 1st Class of the Fund of the deposits and consignations governed by Decree No.

The services performed by these agents in their bodies and their rank of origin are assimilated to services performed in their bodies and their degree of integration.
I. - Officials belonging to other bodies than those mentioned in Article 7 and detached in one of these bodies are placed in a detachment position in the body of the administrative officers of the Caisse des dépôts et consignations created by this decree for the duration of their detachment remaining to run. They are classified in the latter body taking into account their situation in the body in which they were detached and in accordance with the provisions of the correspondence table in Article 7.
II. - The services performed in the detachment position in their previous body and rank by the officials mentioned in I are assimilated to services performed in the detachment position in the body and grades created by this decree.
The technical assistants trainees of the Caisse des dépôts et consignations continue their internship in the body of the administrative officers of the Caisse des dépôts et consignations created by this decree.
The appointment as a trainee of the laureates to the examinations of the technical assistants of the Caisse des dépôts et consignations ouvert before the date of publication of this decree is in the body of the staff of the Caisse des dépôts et consignations established by this decree.
Complementary lists established for the examinations of technical assistants of the Caisse des dépôts et consignations and which are currently valid on the date of entry into force of this decree may be used to make appointments as an intern administrative attaché in the body of the directors of the Caisse des dépôts et consignations created by this decree until the date of commencement of the examinations of the first contest held later
Benefit from the provisions of Article 29 of the above-mentioned Decree of 26 September 2005 for promotion through the professional examination provided for in Article 23 of the same decree:
1° The former Central Administrative Officers of the Caisse des dépôts et consignations who met, in the latter body, the conditions set out in article 22 of Decree No. 95-888 of 7 August 1995 as amended above or who would have fulfilled these conditions in the two-year period following the date of entry into force of this Order;
2° The former technical assistants who fulfilled, in the latter body, the conditions set out in Article 18-1 of Decree No. 91-565 of 17 June 1991 as amended above or who have fulfilled these conditions during the two-year period following the date of entry into force of this decree.
Until the establishment of the competent parity administrative commission for the body created by this decree, which will intervene within one year from the date of publication of this decree, the members of the relevant parity administrative boards for the bodies of the Central Administrative Officers and the Technical Assistants of the Caisse des dépôts et consignations remain in office and sit in common training:
1° Representatives of the rank of central administration striker and the grade of technical assistant represent the rank of administrative striker;
2° Representatives of the ranks of 2nd Class Central Administration, Principal 1st Class Central Administration Attachment, Principal 2nd Class Technical Assistant and Principal 1st Class Technical Assistant represent the rank of Principal Administrative Attachment.
For a period of two years from the coming into force of this Order in Council, in addition to the appointments made pursuant to the second paragraph of Article 7 of the above-mentioned Decree of 26 September 2005, additional promotions may be carried out by professional review, within the limits of a contingent fixed by order of the Director General of the Fund of Deposits and Consignations subject to the procedure prescribed by the decree of 19 October 2004 referred to above.
This professional examination is open to the Caisse's exceptional class secretaries of deposits and consignations for at least five years of public service in a category B corps of the Caisse des dépôts et consignations.
The requirement of service seniority required in the previous paragraph is valued as of January 1 of the year for which the review is opened.
The rules of general organization, nature and program of the professional examination under section 12 shall be determined by joint order of the Minister for Public Service and the Director General of the Caisse des Dépôts et consignations.
The procedure for organizing the professional examination and the composition of the jury shall be determined by order of the Director General of the Caisse des Dépôts et consignations.
The body of the administrative officers of the Caisse des dépôts et consignations is added to the list attached to the decree of 26 September 2005 referred to above.
Decree No. 91-565 of 17 June 1991 on the status of the body of the technical assistants of the Caisse des dépôts et consignations is repealed.
The Minister of Economy, Finance and Industry, the Minister of Public Service and the Minister for Budget and State Reform, the spokesperson for the Government, are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
