Order of October 20, 2005 establishing the knowledge program and training modalities for professional and non-professional technical airworthiness personnel for the issuance of a knowledge certificate from JAR-OPS 1, JAR-FCL 1 and JAR-FCL 3

Minister of Transport, Equipment, Tourism and the Sea,
In view of the Convention on International Civil Aviation of 7 December 1944, published by Decree No. 47-974 of 31 May 1947, together with the protocols that amended it, including the Protocol of 24 September 1968 concerning the authentic trilingual text of the said Convention, published by Decree No. 69-1158 of 18 December 1969;
Considering the Civil Aviation Code, including its article L. 410-1;
Having regard to the amended decision of 31 July 1981 relating to the patents, licences and qualifications of professional airworthiness navigators (aircraft driving personnel, with the exception of testing and reception personnel);
Having regard to the amended decision of 31 July 1981 concerning the patents, licences and qualifications of non-professional civil aeronautics aircraft;
Having regard to the amended decision of 29 March 1999 on the licences and qualifications of flight crew members (FCL 1);
Having regard to the decision of 27 January 2005 on the physical and mental fitness of professional aviation personnel of civil aeronautics (FCL 3);
In view of the advice of the Professional Airworthiness Staff Council in its session of 29 September 2005,

Article 1


The purpose of this Order is to define the content of the program and the training arrangements for professional and non-professional aircrew personnel for the issuance of a knowledge certificate from JAR-OPS 1, JAR-FCL 1 and JAR-FCL 3.


Provisions relating to aircrew personnel
professional professionals

Article 2


Professional aircrew personnel must demonstrate sufficient knowledge of the JAR-OPS 1, JAR-FCL 1 and JAR-FCL 3 as set out in Annex 1 to this Order. This program can be delivered either by an approved training organization in accordance with the above-mentioned March 29, 1999, or by any approved operator.

Article 3


The level of knowledge acquired by the candidate at the end of the training is subject to a documented check by the training organization. If the control is satisfactory, this body delivers a certificate of knowledge.

Article 4


The operator's approval referred to in section 2 covers the content of the training program, the terms and conditions of knowledge control and the educational means implemented. Instructors and examiners must have acquired satisfactory knowledge of the subjects taught either through their professional experience or, where applicable, through a suitable training course.


Provisions relating to aircrew personnel
not professional

Article 5


Non-professional aircrews will need to demonstrate sufficient knowledge of the JAR-FCL 1 program contained in annex 2 to this Order. The training is provided either by an organization approved under sections 2 and 4 above, or by an organization reported for training in the private airplane pilot licence (PPL[A]). In this case, the training program is communicated to the relevant departments of the General Civil Aviation Directorate. The instructors must be qualified as a flight instructor (FI), a class (CRI) or a type (TRI) and have acquired a satisfactory knowledge of the materials taught either through their professional experience or, where applicable, through a suitable training course.
A certificate of knowledge is issued by the instructor after the training.
Staff who have satisfied the conditions set out in sections 2, 3 and 4 are deemed to have demonstrated that knowledge.

Article 6


IATT and ITT qualifications are subject to the provisions of articles 2, 3 and 4 of this Order.

Article 7


At the date of application of this Order, persons who hold a certificate of knowledge pursuant to the Order of September 28, 1999, setting out the knowledge program and the training procedures for professional and non-professional airworthiness personnel who permit the issuance of a certificate of knowledge of JAR-OPS 1 and JAR-FCL 1 shall retain the acquis.

Article 8


The Order of September 28, 1999 setting out the knowledge program and training arrangements for professional and non-professional civil aviation personnel for the issuance of a knowledge certificate from JAR-OPS 1 and JAR-FCL 1 is repealed.

Article 9


The Director General of Civil Aviation is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
