Excerpts from the agreement of the public interest 'Training - future executives' group Article 1 it is made between: the State represented by the High Commissioner of the Republic in New Caledonia, and New Caledonia, a group of public interest, which they are founding members, and which is governed by article 3 of the amended Act No. 99-210 of 19 March 1999 concerning to New Caledonia as amended by article 22 of Ordinance No. 2005-57 January 26, 2005 article 21 of Act No. 82-610 of 15 July 1982, Decree No. 2005-985 10 August 2005 and this convention.
Article 2 name the name of the group is 'Training - executives future public interest grouping', hereinafter referred to as the "GIP".
Article 3 purpose in partnership with actors training and application of the provisions of the Nouméa accord of 5 May 1998, in its point 4-1-2, IPTF 'Training - executives future' is designed to promote the economic and social development of New Caledonia and, more specifically, to devote its agenda further rebalancing of the country and to the accession of the Kanaks to responsibilities in all business sectors.
To this end, it initiates, anime and follows actions to prepare and to promote training, in metropolitan France, frameworks necessary to the economic and social development of New Caledonia and to implement aid to allow residents of New Caledonia training outside.
In this context, IPTF 'Training - executives future' manages 'Framework future' program that responds to the point 4-1-2 of the Noumea accord to allow the continuation of rebalancing and the accession of the Kanaks responsibilities in all business sectors.
This proposal does not limit the object of IPTF and allows the State to intervene, possibly on different actions with much heard otherwise.
Article 4 registered headquarters of the group is set to the following address: building SCICAL, 16, rue d'Austerlitz, downtown, Nouméa 98844. Its premises are grouped.
It may be transferred to any other place by decision of the Board of Directors as laid down in article 2 of Decree No. 2005-985 10 August 2005.
Article 5 duration the public interest grouping enjoys legal personality from the publication in the Official Journal of the French Republic in the opinion approving the agreement, with publication in the Official Journal of New Caledonia, for information purposes.
It is created for a period of ten years.
At the end of this period, the convention can be expressly extended on favourable decision of the General Assembly and opinion concerning the approval by the Minister of the overseas.
Article 6 accession, withdrawal running of the convention, the governing body may accept the accession of new members to a majority of the votes, after voting in favour of the General Assembly.
Running of the convention, any Member may withdraw from the Group at the end of a budget period, subject that it has notified its intention to the president of the Board of directors by sending by registered with acknowledgement of receipt one year before the end of the year. Members are bound by their commitments to the institution and trainees.
Article 7 the constituent convention, its amendments and its dissolution are, in accordance with Decree No. 2005 - 985 10 August 2005, subject to the approval of the Minister of the overseas.
Article 9-2 Obligations the members of the Group undertake by this agreement to:-use the IPTF as a tool for implementation in the only field of expertise;
-annually propose a level of contribution to the activities of IPTF under the terms of article 10;
-participate in the animation of the GIP.
Article 15 maintenance of the accounts of the group accounts is subject to the rules of accounting M 9 - 1 applicable to the EPA. It is ensured by the accounting officer appointed by the Minister responsible for the budget.
