President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs,
Considering articles 52 to 55 of the Constitution;
In light of the amended Decree No. 53-192 of 14 March 1953 on the ratification and publication of the international commitments undertaken by France,
Decrete:

Article 1


The Framework Agreement on Cooperation in Tourism between the Government of the French Republic and the Government of the Republic of Peru, signed in Paris on 13 October 2003, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs are responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.

SUR LA COOPÉRATION EN MATIÈRE DE TOURISME ENTRE LE GOUVERNEMENT DE LA RÉPUBLIQUE FRANÇAISE ET LE GOUVERNEMENT DE LA RÉPUBLIQUE DU PÉROU
The Governments of the French Republic and the Republic of Peru, as referred to as the “Parties”,
Considering the traditional bonds of friendship that unite France and Peru and wish to strengthen relations between their peoples;
Acknowledging that tourism is one of the fastest growing economic sectors and that tourism activity is the most creative of jobs;
Aware of the contribution that tourism can make to the enrichment of the bilateral relationship and to a better mutual knowledge of the French and Peruvian peoples,
agreed that:


Article I


Parties are committed to promoting sustainable development and cooperation in tourism, with a view to increasing tourism flows between the two countries and strengthening mutual knowledge of the history and culture of their peoples.


Article II


The Parties, through the participation and coordination of their official bodies, provide regular information on their promotion programmes for sustainable tourism management, with a view to cooperating in the definition of guidance and recommendations that both Governments implement in their respective tourism policies.


Article III


Parties are committed to promoting cooperation in the field of solidarity tourism and sustainable development through the exchange of information and assistance to local initiative projects.


Article IV


In accordance with the legislation in force in their respective countries, Parties may assist each other, both in the preparation and implementation of publicity and tourism promotion campaigns, by promoting the exchange of experts in tourism promotion and marketing and cooperation in the areas of training and technological research, improvement of the protection and management of spaces, as well as the promotion and development of tourism investments.


Article V


Parties undertake to promote the assistance or exchange of experts for vocational training or for the conduct of short-term seminars, as well as for the development of research programmes on aspects of tourism activity in accordance with the legislation governing international cooperation in their respective countries.
In exceptional cases, this assistance can be formalized through an exchange of notes.


Article VI


Parties shall exchange information on education programmes in the field of tourism, with a view to optimizing vocational training and bringing together tourism training curricula and, if necessary, to allow for the mutual validation of diplomas obtained in the course of these courses.


Article VII


Parties promote exchanges in the fields of culture, music, crafts and gastronomy, as part of festivals and events that they strive to facilitate the organization in a spirit of mutual cooperation.


Article VIII


Parties shall consult on the organization of air links between their territories in order to allow the increase of tourist flows between the two countries.


Article IX


The Parties shall implement the cooperative actions provided for in this Agreement within the limits of their budgetary availability.


Article X


The governmental authorities responsible for tourism of each Party are responsible for the implementation of this Agreement and for the convening, through diplomatic channels, of technical follow-up meetings to ensure the implementation of the Agreement.


Article XI


This Agreement shall be concluded for an indefinite period. Nevertheless, each Party may denounce it by notifying its decision to the other Party with a six-month notice.


Article XII


The denunciation of this Agreement shall not affect the course of the programs and projects decided during the validity period, which shall end in accordance with the deadline for execution.
Any disputes between Parties regarding the implementation of the agreement are resolved through diplomatic channels.


Article XIII


This Agreement shall enter into force on the date of its signature.
In faith, the signatories, duly authorized by their respective Governments, have signed this Convention.
Done in Paris on 13 October 2003, in two original copies in French and Spanish, both texts being authentic.
