Order of November 22, 2004 amending the Order of November 19, 2002 concerning the organization of the working time of the staff of the General Civil Aviation Directorate providing the control service in the air traffic control or coordination bodies in the civil coordination detachments

Minister of Equipment, Transport, Land Management, Tourism and the Sea,
In view of the amended Decree No. 90-998 of 8 November 1990 on the status of the body of the air navigation control engineers;
Having regard to amended Decree No. 93-622 of 27 March 1993 concerning the special status of the corps of the superior technicians of the studies and the exploitation of civil aviation;
Considering Decree No. 2000-815 of 25 August 2000 on the development and reduction of working time in the public service of the State;
In view of Decree No. 2002-1170 of 16 September 2002, derogating from the minimum working and rest guarantees applicable to personnel performing control, maintenance and operation missions in the field of air navigation;
In view of the 12 July 1999 decision on control qualifications in air traffic control bodies;
In view of the decision of 12 September 2001 pursuant to Decree No. 2000-815 of 25 August 2000 on the development and reduction of working time at the Directorate General of Civil Aviation, the General Inspection of Civil Aviation and Meteorology, the Accident Investigation Office and the National School of Civil Aviation;
Having regard to the order of 2 August 2002 setting the lists of air traffic control bodies, as amended by the order of 10 July 2003;
Having regard to the amended decision of 19 November 2002 on the organization of the working time of the staff of the General Civil Aviation Directorate for the service of control in the air traffic control or coordination bodies in the civilian coordination detachments;
In view of the advice of the departmental technical committee dated 11 October 2004,

After article 3 of the above-mentioned decision of November 19, 2002, an article 3 bis is added as follows:
"Managers of organizations can mobilize a potential of a maximum vacation per year and per agent, outside the normal work cycle, to adapt the control potential offered to the needs of air traffic.
When used, this complementary vacation is compensated by a resting vacation to take in times of less traffic. The officers involved in this appointment may not, within the relevant work cycle, apply a replacement cycle as defined in Article 3 below. »

Article 2


In article 7 of the same order, a second paragraph is inserted as follows:
"When the supplementary vacation provided for in Article 3 bis is implemented, the average number of moving the home to the place of work may, for the agent concerned and during the cycle concerned, occasionally exceed the limit of one day in two. »

Article 3


After the first paragraph of article 8 of the same order, a sub-item shall be inserted as follows:
"When the supplementary leave provided for in Article 3bis is implemented, the weekly working period may, for the officer concerned and during the cycle concerned, temporarily exceed the 36-hour limit, without exceeding 43 hours. »

After the first paragraph of article 10 of the same order, a paragraph shall be inserted as follows:
"When the supplementary leave provided for in Article 3bis is implemented, the weekly working period may, for the officer concerned and during the cycle concerned, temporarily exceed the 36-hour limit, without exceeding 43 hours. »

Article 5


After the first paragraph of article 11 of the same order, it is added a paragraph as follows:
"When the supplementary leave provided for in Article 3 bis is implemented, the number of shifts per work cycle, calculated on average over two consecutive cycles, may, for the officer concerned and during the cycle concerned, exceed one-half of the number of days of the work cycle. »

Article 6


The Director General of Civil Aviation is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
