The Prime Minister,
On the report of the Minister of Interior, Homeland Security and Local Freedoms,
Having regard to the Administrative Justice Code, including its article R. 431-9;
Having regard to amended Decree No. 83-321 of 20 April 1983 on powers of prefects in non-military defence;
In view of Decree No. 95-1197 of 6 November 1995 on the management of national police personnel;
Having regard to the advice of the National Police Central Joint Technical Committee dated 19 February 2004;
Considering the advice of the Department of Interior's Departmental Joint Technical Committee dated 9 April 2004;
Having regard to the opinion of the Superior Council of Administrative Courts and Administrative Appeals Courts of 6 July 2004,
Decrete:
The prefects under whose authority are placed the general secretariats for the administration of the police and in the overseas departments the administrative and technical services of the police receive delegation of competence to the effect of representing the State before the administrative tribunals in the disputes relating to the decisions they take within the framework of the competences that are delegated to them on the basis of the decree of 6 November 1995 referred to above.
The provisions of Article 1 shall apply to disputes registered before administrative tribunals as of January 1, 2005.
The Minister of the Interior, Homeland Security and Local Freedoms, the Guard of Seals, Minister of Justice, and the Minister of Public Service and State Reform are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
