Considering the code of social action and families, including articles L. 451-1 to L. 451-4;
Considering the education code, including articles L. 335-5 and L. 335-6;
In view of Decree No. 2002-615 of 26 April 2002 adopted for the application of Article L. 900-1 of the Labour Code and Articles L. 335-5 and L. 335-6 of the Education Code relating to the validation of the acquired experience for the issue of professional certification;
Considering the opinion of the professional advisory committee on social work and social intervention of 2 July 2003;
The State Council (Social Section) heard,
Decrete:
It is created a State degree of family mediator that attests to the skills necessary to intervene with people in situations of rupture or separation in order to promote the reconstruction of their family bond and to help in the search for solutions that meet the needs of each family member.
Applicants for the training of family mediators must justify, in the social, health or legal field, a national diploma or a professional experience. They are the subject of a selection organized by the training institutions. An order of the Minister for Social Affairs determines the conditions for the application of this section.
The duration of the training is determined by the order provided for in section 2 above. This training cannot be provided over a period of more than three years. It includes theoretical education and practical training.
The order set out in section 2 above sets out the nature of the pre-certification tests, including assessments of legal knowledge and family mediation.
The regional prefect validates the certification procedures organized by the training institutions.
No one can present himself more than three times at the graduation.
To be able to obtain the degree by validation of the acquired experience, candidates must justify the professional skills acquired in the exercise of an employee, non-employed or voluntary activity, directly related to the content of the degree. The total duration of cumulative activity required is three years and may be taken into account up to ten years after the termination of this activity.
The regional prefect decides on the admissibility of applications for validation of the experience.
The regional prefect appoints the jury of the degree, which, in accordance with the provisions of Article L. 335-5 of the Education Code, includes:
- the regional director of health and social affairs or his representative, president of the jury;
- trainers from accredited training centres for the family mediator diploma;
- for at least one quarter of its members, qualified representatives of family mediation professionals.
The state diploma of family mediator is issued by the prefect of the region.
Training prepared for the State degree of family mediator is provided by public or private institutions approved by the prefect of the region under conditions defined by the decree mentioned in article 2.
Accreditation is provided on the basis of the qualifications of supervisory and training staff, the educational project and the related teaching methods, as well as the selection rules for candidates for training.
The Minister of Social Affairs, Labour and Solidarity, the Minister of Health, Family and Persons with Disabilities and the Minister Delegate for the Family are responsible, each with respect to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.
