Having regard to amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, in particular its article 20;
Having regard to Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State, in particular its article 64;
Having regard to Act No. 84-53 of 26 January 1984, as amended, with statutory provisions relating to the territorial civil service, in particular its article 87;
Having regard to Act No. 86-33 of 9 January 1986 amending statutory provisions relating to the public hospital service, including its article 77;
Having regard to amended Decree No. 85-1148 of 24 October 1985 on the remuneration of civil and military personnel of the State, personnel of territorial authorities and personnel of public hospitalization institutions;
In view of the amended Decree No. 88-1077 of 30 November 1988 establishing the special statutes of nursing staff of the public hospital service;
In view of the amended Decree No. 89-609 of 1 September 1989 establishing the special statutes of the hospital civil service rehabilitation staff;
In view of the amended Decree No. 89-613 of 1 September 1989 on the special statutes of medical and technical staff of the hospital public service;
In light of Decree No. 2006-778 of 30 June 2006 on granting compensation to certain civil servants and military personnel,
Decrete:
Compensation bonuses are awarded to public servants governed by the above-mentioned Act of 9 January 1986, who have at least five years of seniority at the last level of the terminal grade of a body belonging to category B or Category A, and whose gross compensation index is less than or equal to 985.
The annual amount of compensation bonus is set at 400 gross euros for staff in category B or in the same level and 700 gross euros for those in category A or in the same level.
The amount of the awarded compensation bonus is determined on the prorated basis of the duration of the services performed by the employee and by reference to the rate of pay for the employee's rate of activity as long as the employee meets the conditions set out in section 1.
The agents belonging to the bodies classified as category B and governed by the decree of 30 November 1988, the decree of 1 September 1989 and the decree of 1 September 1989 referred to above, which in 2001 were classified as the 5th step of the upper class of their bodies and which, in 2002, were reclassified to the 6th step of the upper class of their bodies are deemed, subject to having been in continuous position of activity since, to satisfy the condition of
For those of the agents governed by the laws of 11 January 1984, 26 January 1984 and 9 January 1986 referred to above, who are detached into a body governed by the law of 9 January 1986 referred to above, the situation taken into account for the application of Article 1 is that of the rank of detachment.
Compensation bonus is the subject of an annual payment.
Compensation bonuses are paid during the years 2006, 2007 and 2008.
The above-mentioned Decree of 30 June 2006 is repealed as it relates to public servants subject to the above-mentioned Act of 9 January 1986.
The Minister of Economy, Finance and Industry, the Minister of Health and Solidarity, the Minister of Public Service and the Minister for Budget and State Reform, the spokesperson for the Government, are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
