Decree No. 2004-1295 of 26 November 2004 establishing a service constraints premium for certain civil aviation personnel

The Prime Minister,
On the report of the Minister of Equipment, Transport, Land Management, Tourism and the Sea, the Minister of State, Minister of Economy, Finance and Industry, and the Minister of Public Service and State Reform,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State,
Decrete:

Engineers, with the exception of bridge and pavement engineers, senior technicians, workers and assimilated personnel managed by the General Civil Aviation Directorate, may be eligible for a service constraint award when assigned to one of the sites or services specified by joint decree of the Ministers responsible for Civil Aviation, Budget and Public Service.

The amount of the service constraint premium received by the personnel referred to in section 1 is determined by a joint decree of the Ministers responsible for civil aviation, budget and public service.
Officers who are required to work regularly outside the working hours of the day or working days receive the amount of the service stress premium increased by 50%.
Service-operated staff receive 60 per cent of the amount of their service-related premium.
The service constraint premium may not be assigned to the officers housed by absolute necessity of service.

The amounts of the service constraint premium are revalued based on the evolution of the value of the index point used to calculate salary in the public service.

Decree No. 99-521 of 21 June 1999 establishing a service constraint premium for certain civil aviation personnel is repealed.

The Minister of State, Minister of Economy, Finance and Industry, the Minister of Equipment, Transport, Land Management, Tourism and the Sea, the Minister of Public Service and State Reform, the Secretary of State for Budget and Budget Reform, and the Secretary of State for Transport and the Sea are responsible, each with respect to it, for the execution of this decree published in January and for the implementation of the decree published in the French Republic.
