Decree of 13 November 2003 amending the decree of 2 October 1992 relating to the controlled label of origin "Monbazillac"

The Prime Minister,
On the report of the Minister of Agriculture, Food, Fisheries and Rural Affairs and the Minister of Economy, Finance and Industry,
Having regard to Council Regulation (EC) No. 1493/1999 of 17 May 1999 concerning the joint organization of the wine market and the regulations made for its application;
Considering the general tax code;
Considering the Customs Code;
Considering the rural code;
Considering the code of consumption;
Considering the decree of 2 October 1992 concerning the controlled label of origin "Monbazillac";
Considering Decree No. 2001-510 of 12 June 2001 implementing the code of consumption with regard to wines, sparkling wines, sparkling wines and liqueurs wines;
Having regard to Decree No. 2001-1163 of 7 December 2001 concerning the analytical and organoleptic examinations of wines with controlled label of origin;
Considering Decree No. 2002-1325 of 5 November 2002 on the conditions of production and yield of vineyards producing wines with controlled label of origin;
Considering the proposal of the national committee of wines and brandies of the National Institute of the labels of origin of May 22 and 23, 2003,
Decrete:

After Article 3 of the above-mentioned Decree of 2 October 1992, an article 3 bis was added and follows:
"Art. 3 bis. - Before March 31 of the year of the harvest, the winemakers must deposit at the National Institute of the labels of origin the list of the plots likely to produce wines with controlled label of origin "Monbazillac. These elements are annexed to the harvest declaration of the year under review. »

Article 6 of the above-mentioned Decree of 2 October 1992 is replaced by a written article as follows:
“Art. 6. - Can only claim to the controlled label of origin "Monbazillac that the wines responding to the conditions of production and yield fixed by decree n° 2002-1325 of 5 November 2002 relative to the conditions of production and the yield of the vineyards producing wines with controlled label of origin.
"The basic output referred to in Article 1 of this Order is set at 30 hectolitres per hectare.
"The aiming yield referred to in Article 4 of the same decree is set at 40 hectolitres per hectare.
"It cannot be claimed for wines produced on the same fixed area of vines in production only:
" - the controlled label of origin "Monbazillac, and
" - the controlled label of origin "Bergerac sec or the controlled label of origin "Côtes de Bergerac.
"In this case, the amount declared in the controlled label of origin "Bergerac sec or the controlled label of origin "Côtes de Bergerac must not be greater than the difference between that obtained by the application of a maximum agronomic yield to the plot fixed before overmaturation to 55 hectolitres to the hectare and that declared in the controlled label of origin "Monbazillac in application of the assigned annual return of
"The K coefficient, modulable between 1.5 and 3, is fixed annually by decision of the national committee of wines and brandies taken after opinion of the defense union of the label of origin.
"The benefit of the controlled label of origin "Monbazillac can only be granted to the wines coming from young vines from the second year following that during which the plantation was carried out in place before July 31. »

Article 7 of the above-mentioned Decree of 2 October 1992 is replaced by a written article as follows:
“Art. 7. - To be entitled to the controlled label of origin "Monbazillac, the wines must come from grapes harvested with supermaturity and present a minimum natural volumic alcoholometric title of 13 % vol.
"Can not be considered to supermaturity any unit batch of vintage presenting a wealth of sugars less than 221 grams per liter of must.
"White wines must present after fermentation a minimum voluminal alcoholometric title acquired of 12.5 % vol. and a sugar content fermentescibles (glucose + fructose) of 45 grams per litre at a minimum.
"The limits referred to in the above paragraphs may be amended by a joint decree of the Minister of Economy, Finance and Industry and the Minister of Agriculture, Food, Fisheries and Rural Affairs, on the proposal of the National Institute of the labels of origin, after advice of interested producers' trade unions. »

Article 8 of the above-mentioned Decree of 2 October 1992 is replaced by an article written and follows:
“Art. 8. - The plots on which are produced grapes whose wine is claimed in controlled label of origin "Monbazillac must be harvested manually by successive tries.
"The wines being entitled to the controlled label of origin "Monbazillac come from grapes harvested by these tries and present a natural concentration by overmaturation with action or not of noble rot. They are vinified according to local uses.
"They benefit from all oenological practices currently authorized by the laws and regulations in force, excluding the concentration that is prohibited on grapes, musts and wines.
"Only non-effervescent white wines are entitled to the controlled label of origin "Monbazillac. »

Article 10 of the above-mentioned Decree of 2 October 1992 is replaced by a written article, as follows:
“Art. 10. - The wines being entitled to the controlled label of origin "Monbazillac are elevated during a period ending at the earliest on May 31 of the year following that of the harvest. »

The Minister of Economy, Finance and Industry, the Minister of Agriculture, Food, Fisheries and Rural Affairs, the Minister Delegate for Budget and Budget Reform and the Secretary of State for Small and Medium Enterprises, Trade, Crafts, Professionals and Consumer Affairs are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
