Decree No. 2006-1394 of 17 November 2006 on conditions of access and modalities for organizing competitions for the recruitment of municipal police directors

The Prime Minister,
On the report of the Minister of State, Minister of Interior and Land Management,
Having regard to Act No. 71-577 of 16 July 1971 on guidance on technological education;
Having regard to Act No. 84-53 of 26 January 1984 as amended with statutory provisions relating to the territorial public service;
Having regard to Act No. 99-291 of 15 April 1999 on municipal polices;
In light of the amended Decree No. 85-1229 of 20 November 1985 on the general conditions of recruitment of officers of the territorial public service;
In view of Decree No. 92-23 of 8 January 1992 on the registration of titles and diplomas of technological education;
In view of Decree No. 2002-616 of 26 April 2002 adopted pursuant to articles L. 335-6 of the Education Code and L. 900-1 of the Labour Code relating to the National Register of Professional Certifications;
In view of Decree No. 2006-1392 of 17 November 2006 on the special status of the employment framework of municipal police directors;
Considering the opinion of the Superior Council of the Territorial Public Service dated 4 July 2006,
Decrete:

  • PART I: ACCESS CONDITIONS Article 1


    Applicants to the external examination for access to the employment framework of municipal police directors must be holder of one of the following titles or diplomas:
    1° National diploma corresponding to at least one graduate degree;
    2° Diploma or title at least level II, approved according to the procedure defined by the decree of 8 January 1992 referred to or registered in the national register of professional certifications in accordance with the decree of 26 April 2002.

  • PART II: NATURE OF OVERVIEWS AND MODALITIES
    • Chapter I: General provisions Article 2


      Municipal Police Directors' Employment Framework Access Contests include an external competition and an internal competition.

      Article 3


      The opening of the contests referred to in Article 2 is decided by the regional or interdepartmental delegate of the National Centre of the Territorial Public Service.

    • Chapter II: External competition and internal competition Article 4


      External competition eligibility tests include:
      1° A essay on a general topic relating to the major political, economic, cultural or social problems of the contemporary world since 1945 (duration: four hours); coefficient 3);
      2° A writing, from a professional file, of a note to verify the candidate's analytical and synthesis qualities and his ability to identify appropriate solutions (duration: four hours); coefficient 4);
      3° A questionnaire, calling for short or more developed responses on public law: administrative law, constitutional law and public freedoms (duration: three hours); coefficient 3).

      Article 5


      The admission tests for the external competition include:
      1° An interrogation on general criminal law and criminal procedure.
      The interrogation begins with an initial subject drawn by lot by the candidate (preparation: fifteen minutes; duration: fifteen minutes; coefficient 3);
      2° An interview with the jury allowing the jury to appreciate the candidate's personality, abilities and motivation to serve as a municipal police director, as well as his technical and professional knowledge (duration: twenty minutes); coefficient 5);
      3° A live oral test.
      The candidate chooses one of the following foreign languages: German, English, Spanish, Italian, Russian, Modern Arabic, Portuguese, Dutch, Greek.
      The test consists of the translation into French, without a dictionary, of a text in the language chosen by the candidate, followed by a conversation in that language (preparation of the test: ten minutes; duration: fifteen minutes; coefficient 1);
      4° Physical tests:
      (a) A running test;
      (b) Another physical test chosen by the candidate at the time of his entry to the competition among the following disciplines: jumping in height, jumping in length, throwing weight or swimming (coefficient 1).
      Pregnant candidates at the time of mandatory physical tests are exempted, upon request, from these tests. They must be in possession of a medical certificate establishing their condition. Applicants with this exemption are credited with a rating equal to the average of the scores obtained by all candidates for the contest in which they participate.

      Article 6


      The internal competition eligibility tests include:
      1° A commentary on a general topic relating to the major political, economic, cultural or social problems of the contemporary world since 1945 (duration: four hours); coefficient 3);
      2° A writing, from a professional file, of a note to verify the candidate's analytical and synthesis qualities and his ability to identify appropriate solutions (duration: four hours); coefficient 4);
      3° A questionnaire, calling for short or more developed responses on public law: administrative law, constitutional law and public freedoms (duration: three hours); coefficient 3).

      Article 7


      The internal competition admission tests include:
      1° An interrogation on general criminal law and criminal procedure.
      The interrogation begins with an initial subject drawn by lot by the candidate (preparation: fifteen minutes; duration fifteen minutes; coefficient 3);
      2° An interview with the jury allowing the jury to appreciate the candidate's personality, abilities and motivation to serve as a municipal police director and his technical and professional knowledge (duration: 20 minutes); coefficient 5);
      3° An optional living language oral test.
      The candidate chooses one of the following foreign languages: German, English, Spanish, Italian, Russian, Modern Arabic, Portuguese, Dutch, Greek.
      The test consists of the translation into French, without a dictionary, of a text in the language chosen by the candidate, followed by a conversation in that language (preparation of the test: ten minutes; duration: fifteen minutes).
      Only points above 10 of 20 are taken into account under admission;
      4° Optional physical tests:
      (a) A running test;
      (b) Another physical test chosen by the candidate at the time of his entry to the contest among the following disciplines: jumping in height, jumping in length, throwing weight or swimming.
      Only points above 10 of 20.

      Article 8


      Can only be allowed to present themselves to the examinations the candidates declared eligible by the jury.
      They pass, under conditions guaranteeing their anonymity, a psychotechnical test intended to allow an assessment of their psychological profile. The results of this non-eliminary test are communicated to the jury for the second admission test.

      Article 9


      The testing programs set out in sections 4 to 7 above shall, as appropriate, be determined by order of the Minister responsible for local authorities.

    • Chapter III: Competition organization Article 10


      Each contest session is advertised in the Official Journal, which specifies the deadline for registration, the date of the examinations, the number of positions scheduled for each contest and the address to which applications must be filed.
      The regional or interdepartmental delegate of the National Centre for the Territorial Civil Service provides such advertising.

      Article 11


      Members of the competition jury are appointed by order of the president of the National Centre for the Territorial Civil Service.
      The jury at least includes:
      (a) Two Category A territorial officials, including at least one member of the employment framework of municipal police directors;
      (b) Two qualified personalities, including a psychologist accredited to the courts;
      (c) Two local elected officials.
      In the event of an increase in the number of members of the jury, the proportion of officials within the employment framework of municipal police directors must be greater than or equal to half of the members of that college.
      The order set out in the first paragraph of this article shall, among the members of the jury, designate its president and the replacement of the jury for the event that it is impossible to carry out its mission.
      The president and at least two members of these jury members are common to the external competition jury and the internal competition jury.
      The jury may establish itself in groups of examiners, particularly in view of the number of candidates for the correction of written examinations and oral interrogations under the conditions provided for in section 44 of the aforementioned Act of 26 January 1984.
      Correctors may be appointed by order of the President of the National Centre for the Territorial Civil Service to participate in the correction of the trials under the authority of the jury.

      Article 12


      A rating of 0 to 20 is assigned to each test. Each note is multiplied by the corresponding coefficient.
      Written tests are anonymous. Each composition is the subject of a double correction. Any rating less than 5 out of 20 at any of the mandatory eligibility or admission tests results in the removal of the candidate.

      Article 13


      For each competition, the jury determines the total number of points required to be eligible and on this basis determines the list of candidates admitted to the admission examinations.
      At the end of the admission examinations, the jury shall, within the limits of the places placed in the contest, determine an admission list.
      This list is separate for each competition.
      In case of equal sharing of votes, the President's voice is preponderant.
      The correctors mentioned in article 11 of this decree may be associated with the proceedings of the jury with an advisory vote.
      For each of the contests, the jury's president sends the admission list so established to the regional or interdepartmental delegate of the National Territorial Civil Service Centre with a record of all operations.

      Article 14


      The regional or interdepartmental delegate of the National Centre of the Territorial Civil Service shall, in alphabetical order, establish the suitability list in accordance with the admission lists.

      Article 15


      The Minister of State, Minister of Interior and Land Management, and the Minister Delegate to Territorial Authorities are responsible, each with respect to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.
