Considering the urban planning code, including articles L. 340-2, R. 340-2 and R. 340-3;
Having regard to the Overseas Program Law (No. 2003-660 of 21 July 2003), including its Article 46;
Considering Decree No. 2002-666 of 29 April 2002 on regional land and urban development funds in overseas departments;
Considering the deliberation of the regional council of Guadeloupe of 4 March 2004;
Considering the deliberation of the Regional Council of the Meeting of 19 March 2004;
Considering the referral of the Guyana Regional Council dated 26 February 2004;
Considering the referral of the Martinique Regional Council dated 26 February 2004;
Considering the referral of the general council of Guadeloupe dated 26 February 2004;
Considering the deliberation of the General Council of Guyana of 5 March 2004;
Considering the referral of the General Council of Martinique dated 26 February 2004;
In view of the deliberation of the General Council of the Meeting of 10 March 2004,
Decrete:
The last paragraph of section R. 340-2 of the urban planning code is repealed.
Section R. 340-3 of the urban planning code is replaced by the following:
"Art. R. 340-3. - The financial institution referred to in the third paragraph of Article L. 340-2 is responsible for pooling funds, managing and disbursing grants and advances on grants provided for in Article R. 340-2 to the beneficiaries listed in Article II of this Article.
Contributors may not use borrowing from the same financial institution to ensure the resources of regional land and urban development funds. »
On the basis of a framework agreement, each contributor to the regional land and urban development fund signs with this financial institution a convention that specifies the terms and conditions for the supply of funds and the payment of subsidies and advances on grants, the conditions for the management of the institution, the means of control and the accountancy of the regional land and urban development funds. »
