On the report of the Seal Guard, Minister of Justice, Minister of Economy, Finance and Industry and Minister of Public Service,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, and in particular article 20 thereof, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
In view of Decree No. 2005-532 of 24 May 2005 on the special status of the body of directors of the judicial protection services of youth,
Decrete:
Within the available appropriations, directors of the youth judicial protection services may receive management compensation.
The annual reference amounts for the management allowance are determined based on the rank of the officer by joint order of the ministers responsible for justice, budget and public service.
The amount of the individual duties of the management allowance may be adjusted to take into account, on the one hand, the importance of the hardships to which the recipient is called to face in the effective performance of his or her duties, on the other hand, in the manner of serving the agent. It cannot exceed 15% of the annual reference amount attached to the officer's grade.
The average of the allowances served cannot exceed 120 per cent of the reference amount.
The directors of the judicial protection services of young trainees are excluded from the benefit of this allowance when they are not in a position of responsibility. Individual powers that may be paid to the directors of the judicial protection services of the young trainees are determined on a pro rata basis of the time spent on responsibility.
In the event of a vacancy or absence of the Director of Services for a period equal to or greater than one month, the officer in charge of the interim may, in proportion to the duration of the interim, benefit from the management allowance allocated to the performance.
Decree No. 2000-1103 of 14 November 2000 establishing executive compensation for the principal directors and directors of the judicial protection of youth is repealed.
The Minister of Economy, Finance and Industry, the Minister of Justice, the Minister of Public Service and the Minister for Budget and Reform of the State, the spokesperson for the Government, are responsible, each with regard to the execution of this decree, which will be published in the Official Journal of the French Republic and takes effect on 27 May 2005.
