Having regard to Council Regulation (EC) No. 1493/1999 of 17 May 1999 concerning the joint organization of the wine market and the regulations made for its application;
Considering the general tax code;
Considering the Customs Code;
Considering the rural code, including articles R. 641-94 and R. 641-96;
Considering the code of consumption;
Having regard to the decree No. 67-1007 of 15 November 1967 amended relating to the marketing of wines with controlled label of origin;
Considering Decree No. 2001-510 of 12 June 2001 implementing the code of consumption with regard to wines, sparkling wines, sparkling wines and liqueurs wines;
Considering the proposal of the National Committee of wines and brandies of the National Institute of the labels of origin of May 27 and 28, 2004,
Decrete:
The fourth paragraph of Article R. 641-94 of the Rural Code is replaced by the following:
"The validity of the certificate of approval for non-conditioning and non-marketed premium wines of the appellations mentioned in the decree of November 15, 1967 relating to the marketing of the wines with controlled label of origin ends from the grant to the applicant, for these wines, of a certificate of approval for the same name without the mention "primer and no later than the 15 December of the year of harvest. »
The second paragraph of Article R. 641-96 of the Rural Code is supplemented by the following provisions:
"However, for a specific campaign, specific limit values may be adopted by order of the Minister responsible for Finance and the Minister responsible for agriculture, as proposed by the National Committee of wines and Life Waters of IAO. »
The Minister of State, Minister of Economy, Finance and Industry, the Minister of Agriculture, Food, Fisheries and Rural Affairs, the Minister Delegate for Small and Medium Enterprises, Trade, Crafts, Professionals and Consumer Affairs, and the Secretary of State for Budget and Budget Reform are responsible, each with respect to it, for the execution of this Decree, which will be published in the French Republic.
