Having regard to amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, including article 20, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
In light of amended Order No. 58-696 of 6 August 1958 relating to the special status of personnel in the external services of the prison administration;
Having regard to amended Decree No. 66-874 of 21 November 1966 concerning the special status of officials of the external services of the prison administration;
In light of amended Decree No. 2002-728 of 30 April 2002, which sets out the hierarchical classification of the ranks and jobs of staff under special status of the deccented services of the prison administration;
In light of Decree No. 2005-819 of 19 July 2005 on the award of liability to management personnel and certain prison personnel,
Decrete:
Article 1 of the above-mentioned Decree of 19 July 2005 is replaced by the following provisions:
"A liability allowance may be awarded to the regional directors of the prison services, to the functional directors of the prison services, to the members of the head of the prison services, and to the members of the staff of the prison directors. »
Article 2 of the same decree is replaced by the following provisions:
"A liability allowance may also be allocated to staff in the duties of:
- Director of Penitentiary Services for Inclusion and Probation;
- Secretary General of Regional Directorate of Prison Services;
- Chief of a penitentiary and Deputy Chief of Institution. »
Article 4 of the same decree is replaced by the following provisions:
"The amounts of the individual liability allowance may be adjusted according to the manner in which the agent is served, but may not be less than 50% of the reference amount and greater than 15% of the same amount. »
Article 5 of the same decree is replaced by the following provisions:
"The award of the liability allowance established by this Order is exclusive to the compensation for prison expenses, the lump-sum allowance for staff in the prison administration and the lump-sum allowance for additional work. The payment of the liability allowance is related to the effective performance of the duties. »
The provisions of this Decree come into force on 1 January 2006.
The Minister of Economy, Finance and Industry, the Minister of Justice, the Minister of Public Service and the Minister for Budget and Reform of the State, the spokesperson for the Government, are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
