Decree No. 2006-1335 of 3 November 2006 on the award of a special risk and hardship allowance to certain youth judicial protection personnel

The Prime Minister,
On the report of the Seal Guard, Minister of Justice, Minister of Economy, Finance and Industry and Minister of Public Service,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, and in particular article 20 thereof, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to amended Decree No. 48-1108 of 10 July 1948, establishing hierarchical classification of the ranks and jobs of civil and military personnel of the State under the general pension system;
In view of the amended Decree No. 70-251 of 21 March 1970 on the common statutory provisions applicable to the bodies of automobile drivers and garage managers of the state administrations;
Having regard to amended Decree No. 90-712 of 1 August 1990 on the common statutory provisions applicable to the bodies of administrative agents of the state administrations;
Having regard to amended Decree No. 90-713 of 1 August 1990 on the common statutory provisions applicable to the administrative units of the State administrations;
In view of the amended Decree No. 90-714 of 1 August 1990 on the common statutory provisions applicable to the bodies of professional workers of the state administrations and the bodies of workers of the state administrations, as amended by Decree No. 97-413 of 25 April 1997, Decree No. 2005-1228 of 29 September 2005 and Decree No. 2005-1372 of 2 November 2005;
In view of Decree No. 92-344 of 27 March 1992 on the special status of the body of educators of judicial protection of youth, as amended by Decree No. 94-313 of 15 April 1994 and Decree No. 2004-19 of 5 January 2004;
In view of Decree No. 92-345 of 27 March 1992 on the special status of the body of the heads of educational service of the judicial protection of youth, as amended by Decree No. 97-70 of 28 January 1997, Decree No. 2001-617 of 10 July 2001 and Decree No. 2004-19 of 5 January 2004;
Having regard to Decree No. 96-158 of 29 February 1996 on the special status of the body of psychologists of the judicial protection of youth, as amended by Decree No. 98-289 of 9 April 1998 and Decree No. 98-485 of 12 June 1998;
Having regard to Decree No. 96-1113 of 19 December 1996 concerning the special status of technical teachers of the judicial protection of young people, as amended by Decree No. 98-280 of 8 April 1998;
In view of the amended Decree No. 97-896 of 2 October 1997 on the special status of the body of the officers specialized in the judicial protection of youth, as amended by Decree No. 98-212 of 19 March 1998, Decree No. 2005-1228 of 29 September 2005 and Decree No. 2005-1364 of 2 November 2005;
In view of Decree No. 97-925 of 8 October 1997 on the special status of the body of the technical agents of the education of the judicial protection of youth, as amended by Decree No. 99-681 of 3 August 1999, Decree No. 2005-1228 of 29 September 2005 and Decree No. 2005-1365 of 2 November 2005;
Having regard to Decree No. 2002-60 of 14 January 2002 on Hourly Allowances for Supplementary Work;
Having regard to amended Decree No. 2002-61 of 14 January 2002 on administrative and technical compensation,

As far as available, some youth judicial protection officials may receive a special risk and hardship allowance.

The list of beneficiaries and the annual reference amounts for the special risk and hardship allowance are determined by joint order of the Minister of Justice, the Minister of Budget and the Minister for Public Service.

The amount of the individual award of the special risk and hardship allowance may be adjusted, on the one hand, to the extent of the hardships to which the recipient is called to face in the effective performance of his or her duties, on the other hand, in the manner of serving the agent.

The amount of the individual award may vary within the limits of between 80% and 15% of the annual reference amount attached to the agent's body for technical professors, psychologists, educational chiefs and youth judicial protection educators.
It may vary within limits ranging from 100% to 15% of the annual reference amount attached to the agent's body for automobile drivers and garage managers, professional workers and workers' masters, administrative agents and assistants, specialist agents and technical agents for the education of the judicial protection of youth.

Trainees receive this allowance on the basis of the time spent on practical training in youth justice institutions and services.

In the event of a vacancy or absence for a period equal to or greater than one month, the agent performing the interim may, in proportion to the duration of the interim, benefit from the special risk and hardship allowance for the function performed.

The compensation provided for in this Decree shall not be combined with the hourly allowance for additional work established by Decree No. 2002-60 of 14 January 2002 referred to above and with the administrative and technical compensation established by Decree No. 2002-61 of 14 January 2002 referred to above, for the following bodies:
- body of specialists;
- the body of professional and master workers;
- body of technical education officers charged or not of night watch functions.

The Minister of Economy, Finance and Industry, the Minister of Justice, the Minister of Public Service and the Minister for Budget and Reform of the State, the spokesperson for the Government, are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic and takes effect on January 1, 2006.
