Summary


Art. L. 6134-1 of the Public Health Code states that in the missions which are assigned to them and in conditions fixed by regulation, public health institutions may participate in international cooperation actions in accordance with the international commitments undertaken by the French State. The purpose of this decree is to define the conditions for the implementation of the international cooperation actions of public health institutions under the control of the regional hospitalization agency. It also provides a legal basis for such actions. It reaffirms the role of the National School of Public Health in training and specifies how these actions are financed.

The Prime Minister,
On the report of the Minister of Health, Family and Persons with Disabilities,
Considering the Public Health Code, including articles L. 5211-4, L. 6114-2 and L. 6134-1;
In view of Decree No. 99-930 of 10 November 1999 establishing the status of internals and residents of medicine, pharmacy and in-patients;
The State Council (Social Section) heard,

Chapter III of title I of Book VII of the Code of Public Health (Part Two: Decrees in the Council of State), provides for a section IV, which reads as follows:

“International Cooperation Convention


"Art. R. 713-3-22. - As part of the tasks defined in Article L. 6112-1 and subject to ensuring continuity of the public hospital service, public health institutions may engage in international cooperation, with persons of public law and private law acting in the same area as theirs. Pursuant to Article L. 6134-1, each cooperative action is the subject of a cooperation agreement that respects the contract of objectives and means referred to in Article L. 6114-2. This agreement includes the terms and conditions for the exchange and training of medical and non-medical personnel.
"Art. R. 713-3-23. - Benefit from additional training under the conventions referred to in Article L. 6134-1:
" - Physicians and pharmacists, holders of a doctor's degree in medicine or pharmacy to exercise in the country of obtaining or of origin and who do not undertake studies in France for the preparation of a certificate of specialized training. They are designated as associate trainees for a period of six months renewable, under the conditions defined in article 39, paragraph 1, of Decree No. 99-930 of 10 November 1999 establishing the status of internals and residents of medicine, pharmacy and in-patients;
" - the nursing staff of the states whose list is fixed by order of the minister responsible for health, who hold a nursing diploma allowing the exercise in the country of obtaining or of origin. Complementary training is carried out in the form of hospital adaptation courses.
"A Minister of Health Order sets out the terms and conditions for the selection, assignment and remuneration of personnel referred to in this section.
"Art. R. 713-3-24. - Staff of public health institutions whose list is set by the Minister for Health may be sent, upon request, on a mission of international cooperation for a maximum of three months per period of two consecutive years by retaining their full remuneration.
"Art. R. 713-3-25. - Public health institutions can participate in international cooperation activities for the training of foreign management personnel in collaboration with the National School of Public Health.
"Art. R. 713-3-26. - As part of international cooperation, public health institutions participate in actions to collect medical devices that comply with the conditions set out in section L. 5211-4 and in terms set by order of the Minister for Health.
"Art. R. 713-3-27. - Public health institutions that engage in international cooperation activities in relation to their participation in the emergency medical assistance service referred to in Article L. 6112-5 may join a hospital network called "SAMU de France" whose organizational and operational terms are defined by decree of the Minister for Health. »
