Judgment of September 26, 2006 on the terms and conditions of organization, the program and the nature of the examinations for the recruitment of prison officers

The Seal Guard, Minister of Justice, and the Minister of Public Service,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
In view of amended Decree No. 82-886 of 15 October 1982 setting out the list of bodies for which separate recruitments may be provided for for men and women;
In view of Decree No. 2004-1105 of 19 October 2004 on the opening of recruitment procedures in the public service of the State, in particular Articles 19 and 26 of the State;
In view of Decree No. 2006-441 of 14 April 2006 on the special status of the prison supervisory staff, including Articles 4 and 5;
In view of the September 26, 2006 decision on the conditions of physical fitness for admission to the corps of command and to the supervision and enforcement of the surveillance personnel of the prison administration,
Stop:

Article 1


The external competition provided for by the decree of 14 April 2006 referred to for the recruitment of prison supervisors is opened by order of the seal guard, Minister of Justice, in accordance with the provisions of the decree of 19 October 2004 referred to above. This Order sets out the number of positions available to candidates and determines, where appropriate, the distribution of these positions between the sexes.

Article 2


The competition includes eligibility and admission tests.


1. Eligibility


Eligibility tests consist of:
A. - A composition on a topic of news or a general theme intended to assess the candidate's ability to expose ideas and to logically link them in writing and control his or her mastery of spelling (duration: two hours; coefficient 2).
B. - A series of multiple-choice questions and a series of questions calling for a short answer to assess the general knowledge of the candidates and their capacity for reflection (duration: one hour and thirty); coefficient 2).
All of the questions are:
- the historical evolution of France since the beginning of the 19th century;
- the physical, human and economic geography of France;
- recent news (international relations, political life, economic data, scientific problems, cultural movements, sport, daily life...).
Each of the tests is rated from 0 to 20. Any rating less than 5 out of 20 at one of the two trials is eliminated.
Only candidates who have obtained a total number of points for these tests at least 40, after applying the coefficients, may have access to the admission tests. This total number of points is determined by the jury, which lists eligible candidates after equalization, if applicable.


2. Admission


Admission tests are preceded by a 30-minute presentation to eligible candidates from the prison administration and the supervisor's profession, for which the presence of candidates is mandatory.
The admission examinations shall consist of:
A. - A personality interview on the candidate's ability to perform the supervisor's duties (coefficient 5), lasting fifteen minutes.
This interview is conducted by the group of examiners whose composition is defined by Article 3 of this Order, excluding the psychologist or psychiatrist.
The candidate is subjected, prior to personality maintenance, to psychotechnical tests followed by a psychological examination performed exclusively by a psychologist or psychiatrist.
The group of examiners and the psychologist or psychiatrist then meet to assign a rating of 20 to the candidate.
A score less than 10 out of 20 is eliminated.
B. - A series of physical tests recorded on 20 (coefficient 2), whose nature and terms are set out in the annex to this Order.
A score of 0 to all physical tests is eliminated.
Candidates may only be subjected to physical admission tests on the day of the tests of a certificate issued by a certified doctor certifying that they are capable of taking these tests.
Pregnant candidates as well as those coming from birth, benefiting from the post-natal legal period, and breastfeeding women beyond the post-natal legal period are exempted from physical trials. They must be in possession of a medical certificate from a registered physician establishing their condition. They are credited with a rating equal to the average of the scores obtained at the sporting events by all candidates at the contest in which they participate.
If a candidate, as a result of an injury that occurred during one of the physical tests, cannot complete the physical test, the candidate shall be assigned the lump sum rating set out in Appendix III to this Order.
Any absence of any sporting events not justified by a medical certificate of temporary incapacity to the sport practice established by a registered doctor is sanctioned by the 0-eliminary note.
Any candidate who produces, by the day of the tests, a certificate of temporary incapacity for the sport practice established by an accredited doctor is credited with the non-eliminary rating.
Candidates who have been given sports after a medical certificate of temporary incapacity for sport will be the subject, in the event of a successful examination and prior to their appointment, of a medical visit attesting to their ability to resume physical and sport activities.

Article 3


The jury, whose members are appointed by Seal Guard Order, Minister of Justice, includes:
The director of the prison administration or his representative, president;
Groups of examiners composed as follows:
- the Regional Director of the Penitentiary Region, headquarters of an Examination Centre, or his representative;
- an official of the prison administration management staff;
- a member of the Correctional Service Supervisory Personnel Command Corps;
- a penitentiary major or a first supervisor with at least five years of public service in his body;
- a brigadier supervisor or supervisor with at least five years of public service in the body;
- a psychologist or a psychiatrist who does not work with the criminal population.
In case of equal sharing of votes, the President's voice is preponderant.
The jury secretariat is provided by the recruitment office in the direction of the prison administration.

Article 4


At the end of the admission examinations, the jury meets to deliberate on the results transmitted by each group of examiners and fixes, after equalizations, and in order of merit, the list of candidates admitted to the contest.
Only candidates who have obtained a number of points fixed by the jury for all the examinations of eligibility and admission may be listed on this list, which cannot be less than 110 points or include no playoffs.
The jury may draw up a supplementary list of candidates that it considers fit to be admitted to the competition.
If several candidates total the same number of points, the priority is given to the one who obtained the best score at the first admission test and then, in case of new equality, to the one who obtained the best score in the written composition test.

Article 5


The decision of 17 April 2000 on the terms and conditions of organization, program and the nature of the examinations for the recruitment of prison officers is repealed.

Article 6


The director of the prison administration is responsible for the execution of this order, which will be published in the Official Journal of the French Republic.

A N N E X E I
EXTERNAL PHYSICAL REQUIRED
DE RECRUTEMENT DE SURVEILLANTS DE L'ADMINISTRATION PÉNITENTIAIRE


The physical tests of the external recruitment examination for prison officials include:
For men:
- a speed race of 80 meters;
- a half-ground race of 1,000 meters;
- a weight throw of 5 kilograms.
For women:
- a speed race of 60 meters;
- a half-ground race of 400 meters;
- a weight throw of 3 kilograms.

BARÈMES MODALITIES


Physical tests shall be carried out taking into account the following indications:
Weight launch (3 tests):
Men: weight of 5 kilograms;
Women: weight of 3 kilograms.
Half ground:
Men: 1,000 meters;
Women: 400 metres.
Speed: individual race (1 single test):
Men: 80 meters;
Women: 60 meters.
The scales for the 3 tests are spread from 4 to 4 points. Each of these points corresponds to 0.25 point for the calculation of the average over 20.
In case of force majeure caused by weather and jeopardizing the safety of candidates, the jury will have the opportunity to cancel one of the trials or all of them.
In the event that the jury should cancel one of the tests and in order to be able to always use the rating table, a lump-sum rating will be awarded to the candidates for the deleted test as follows:
Watching candidates:
Candidates under 30 years of age: 26 points;
Candidates over 30 years old: 25 points.
Watching candidates:
Candidates under 30 years: 19 points;
Candidates over 30 years: 18 points.
In the event that the jury should cancel all the trials, all candidates will have to be reconvened in the shortest time frame.
If a candidate, as a result of an injury in one of the physical tests, cannot complete the entire test, the candidate shall be assigned the following lump sum rating for the test:
Watching candidates:
Candidates under 30 years of age: 26 points;
Candidates over 30 years old: 25 points.
Watching candidates:
Candidates under 30 years: 19 points;
Candidates over 30 years: 18 points.
