Summary


Application of art. 52 to 55 of the Constitution. Adopted in 1989 and entered into force on 05-05-1992, the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal aims to enable the international community to combat international movements of hazardous wastes that may present, in particular for developing countries, serious threats to the environment and human health. The inherent danger of waste is the basis for the regulation of transboundary movements. It is determined using the lists of categories of wastes to be controlled (annex I and II) and hazard characteristics (annex III). The characterization of waste was one of the first difficulties encountered by Parties in the implementation of the Convention. The technical working group of the convention was therefore tasked with carrying out a clarification work on the definition of hazard characteristics and the development of lists of hazardous wastes in order to facilitate the application of the convention. Based on the proposals of the technical working group, the 4th Conference of the Parties adopted, on 27-02-1998 in Kushing, an amendment to Annex I to the Convention, as well as 2 new annexes (annex VIII and IX). Appendix VIII lists a list of wastes considered hazardous under Article 1 relating to the scope of the Convention; Appendix IX lists a list of wastes that, on the other hand, are considered unsafe. However, the amendment to Appendix I provides that the danger of a waste referred to in Appendix VIII may, in some cases, be reconsidered in the light of the criteria in Appendix III. Similarly, the listing of a waste in Appendix IX does not exclude that, in some cases, a waste is considered to be hazardous, if the waste contains a substance listed in Appendix I in sufficient quantity to present a hazard characteristic in Appendix III. The amended Regulation (EEC) 259/93 of 01-02-993, of the application of the Basel Convention takes into account these provisions. The amendment to Schedule I and Annexes VIII and IX to the Basel Convention entered into force on 06-11-1998.

Decrete:

Article 1


The amendment to Annex I and Annexes VIII and IX to the Basel Convention of 22 March 1989 on the control of transboundary movements of hazardous wastes and their disposal, adopted in Kuching on 27 February 1998, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs are responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.

A M E N D E M E N T


ANNEX I AND ANNEXES VIII AND IX TO THE BELONG-RANGE CONVENTION OF 22 MARCH 1989 ON THE CONTROL OF TRANSBOUNDARY BUSINESS MOUVEMENTS AND ELIMINATION
The Conference,
Recalling decision III/1 of the Conference of the Parties in which it was instructed the Technical Working Group, inter alia, to consider as a matter of priority the completion of work on the definition of hazard characteristics and the development of lists, in order to submit the results of this work to the approval of the Conference of the Parties at its fourth meeting;
Recalling decision III/12 of the Third Conference of the Parties by which the Technical Working Group was requested, inter alia, to examine ways and means of advancing the development of lists of hazardous wastes and the procedure for their revision in accordance with the conclusions of the Technical Working Group, and to establish lists of wastes not covered by the Basel Convention;
Taking note of the work carried out by the Technical Working Group and in particular the development of a list of wastes considered to be hazardous under paragraph 1 (a) of Article 1 (list A in the note on the consolidated lists of wastes and the procedure for the revision of the lists of wastes [UNEP/CHW.4/3]) and a list of wastes not referred to in paragraph 1 (a) of Article
Considering that the characteristics set out in Annexes I and III must remain the characteristics defining the danger of waste for the purposes of the Basel Convention, that lists A and B developed by the Technical Working Group allowing for a prompt procedure to facilitate the application of the Convention and, in particular, of Article 4-A, indicating the wastes referred to in Article 1(a) of the Convention and those which are not of the same importance,
Noting that lists A and B of waste develop and specify the provisions of paragraph 1 (a) of Article 1 of the Convention, taking into account annexes I and III;
Noting that lists A and B are not exhaustive;
Taking note of the decision of the Ad Hoc Open-ended Committee at its third meeting to propose to the Conference of the Parties to extend the terms of reference of the Technical Working Group in order to carry out the procedure for the revision and adjustment of the lists of wastes and to add the application form to that end, as indicated in the note on the consolidated lists of wastes and the procedure for the revision of lists;
Noting that, in accordance with decision IV/6, the Technical Working Group is responsible for keeping the lists of waste under review and making recommendations to the Conference of the Parties regarding their revision and adjustment;
Taking note also of the fact that, in accordance with decision IV/6, the Technical Working Group is responsible for reviewing the procedure for the revision and adjustment of the lists of wastes, including the application form for registration or delisting, as set out in the note on the lists, waste recapitulatives and the procedure for the revision of the lists, and for submitting a proposal for approval to the fifth meeting of the Conference of the Parties;
Decides to adopt the amendment to the Convention and the following annexes:
1. Add the following paragraphs at the end of Annex I below:
(a) To facilitate the application of the Convention and subject to subparagraphs (b), (c) and (d), wastes listed in Annex VIII are considered hazardous under Article 1, paragraph 1 (a), of the Convention;
(b) The listing of a waste in Schedule VIII does not exclude that in some cases the use of Schedule III is used to demonstrate that a waste is not hazardous under paragraph 1 (a) of Article 1 of the Convention;
(c) The listing of a waste in Schedule IX does not exclude that in some cases a waste is considered hazardous under paragraph 1 (a) of Article 1 of the Convention if the waste contains a substance listed in Appendix I in sufficient quantity to present a hazard characteristic of Schedule III;
(d) Annexes VIII and IX shall not affect the application of paragraph 1 (a) of Article 1 of the Convention for the purpose of characterization of wastes.

LISTE A


The wastes listed in this annex are considered hazardous wastes under paragraph 1 (a) of Article 1 of the Convention and the registration of a waste in this annex does not exclude the use of Annex III to demonstrate that the waste is not hazardous.


A1 Metal waste and metal waste


A1010 Metal waste and waste consisting of alloys of one or more of the following metals:
- antimony;
- arsenic;
- beryllium;
- cadmium;
- lead;
- mercury;
- selenium;
- tellure;
- thallium,
excluding such wastes on List B.
A1020 Wastes with constituent or contaminant elements, excluding metal waste in solid form, one or more of the following:
- antimony; compounds of antimony;
- beryllium; compounds of beryllium;
- cadmium; cadmium compounds;
- lead; lead compounds;
- selenium; selenium compounds;
- tellure ; compounds of the tellure.
A1030 Wastes having as constituent or contaminant elements:
- arsenic; arsenic compounds;
- mercury; mercury compounds;
- thallium; thallium compounds.
A1040 Wastes having as constituents:
- carbonyl metals;
- hexavalent chromium compounds.
A1050 Galvanization bolts;
A1060 Liqueurs from the metal shift.
A1070 Residues of the leaching of zinc treatment, dust and mud such as jarosite, hematite, etc.
A1080 Zinc waste not on List B and containing sufficient lead and cadmium concentrations to have the characteristics of Schedule III.
A1090 Cendres from incineration of isolated copper wires.
A1100 Dusts and residues from copper smelting systems.
A1110 Exhausted electrolytic solutions from copper electro-extraction operations.
A1120 Residual muds, excluding anodic muds, from purification systems in copper electro-extraction operations.
A1130 Cutting solutions containing dissolved copper.
A1140 Waste of catalysts based on chloride and copper cyanide.
A1150 Cuts of precious metals from incineration of printed circuits not on list B (1).
A1160 Waste of lead and acid electric accumulators, whole or crushed.
A1170 Accumulators and used batteries other than those containing the mixture specified in List B. Used accumulators not listed in List B and containing components mentioned in Schedule I in a proportion that makes them dangerous.

A1180 Electrical and electronic assemblies used or in the form of debris (2) containing elements such as accumulators and other batteries listed in List A, mercury actuators, lenses from cathodic ray tubes and other activated and PCB capacitors, or contaminated by components listed in Schedule I (cadmium, mercury, lead, biphenyls)
A2 Wastes with mainly inorganic components that may contain metals and organic matter
A2010 Glass debris from cathodic tubes and other activated lenses.
A2020 Wastes of inorganic fluorine compounds in the form of liquids or muds excluding those listed in List B.

A3020 Wastes of unsuitable mineral oils for original use.

A3050 Wastes from the production, preparation and use of resins, latex, plasticizers or glues and adhesives, excluding those listed in List B (see corresponding entry in List B [B4020]).
A3060 Wastes containing nitrocellulose.
A3070 Phenols and phenol compounds, including chlorophenols, in the form of liquids or muds.
A3080 Used Hers, excluding those listed on List B.
A3090 Saws, ash, muds and leather flours containing hexavalent chromium compounds or biocides (see corresponding entry in list B [B3100]).
A3100 Rogs and other wastes of prepared leather or reconstituted leather, not usable for the manufacture of leather works, containing hexavalent chromium compounds or biocides (see corresponding entry in list B [B3090]).
A3110 Wastes derived from pelletry operations containing hexavalent chromium compounds, biocides or infectious substances (see corresponding entry in list B [B3110]).
A3120 Auto grinding residues (light effect: plush, fabric, plastic waste, etc.).
A3130 Organic compounds of phosphorus.
A3140 Non-halogenated organic solvents, other than those specified in list B.
A3150 Halogenated organic solvents.
A3160 Non-aqueous, halogenated or non-halogenated distillation residues from organic solvent recovery operations.
A3170 Wastes derived from the production of halogenated aliphatic hydrocarbons (such as chloromethane, dichlorethane, vinyl chloride, vinyl chloridene, ilyle chloride and epichloride).
A3180 Wastes, substances and articles containing, consisting of, or contaminated with polychlorinated biphenyls (PCB), polychlorinated terphenyls (PCT), polychlorinated naphthalene (PCN) or polybrominated biphenyls (PBBs), including any similar polybrominated compound with a concentration equal to or greater than 50 mg/kg (4).
A3190 Bituminous waste (excluding asphalt cements) from refinement, distillation and any pyrolitic treatment of organic matter.


A4 Wastes that may contain materials
inorganic or organic


A4010 Wastes from the production, preparation and use of pharmaceuticals, excluding those listed in List B.
A4020 Clinical waste from medical, nursing, dental and veterinary care, or other similar practices, and waste from patient examination and treatment operations in hospitals and related institutions, or research.
A4030 Wastes arising from the production, preparation and use of biocides and phytopharmaceuticals, including releases of pesticides and herbicides not meeting the specifications, perished (5) or unfit for the original intended use.
A4040 Wastes from the manufacture, preparation and use of chemicals for the preservation of wood (6).
A4050 Wastes containing, consisting of, or contaminated by one of the following substances:
- inorganic cyanides, except precious metal residues in solid form containing traces of inorganic cyanides;
- organic cyanides.
A4060 Mixtures and emulsions oil/water or hydrocarbon/water.
A4070 Wastes from the production, preparation and use of inks, dyes, pigments, paints, lacquers or varnishes, except those on list B (see corresponding entry in list B [B4010].
A4080 Wastes of explosive character (excluding those listed in List B).
A4090 Acid or basic solutions, other than those contained in the corresponding section of list B [B2120).
A4100 Wastes from industrial wastewater treatment plants, except those listed in list B.
A4110 Wastes containing, consisting of, or contaminated by one of the following substances:
- any product of the polychlorinated dibenzofurans family;
- any product of the polychlorinated dibenzoparadioxin family.
A4120 Wastes containing, consisting of, or contaminated with peroxides.

The wastes contained in this annex are not covered by paragraph 1 (a) of Article 1 of the Convention, unless they contain substances in Annex I to concentrations such as they have a hazard characteristic in Annex III.


B1 Metal wastes and wastes containing metals


B1010 Wastes of metals and their alloys in metal form, not susceptible to dispersion:
- precious metals (gold, silver, platinum group, mercury being excluded);
- iron and steel waste;
- copper waste;
- nickel waste;
- aluminum waste;
- zinc waste;
- tin waste;
- tungsten waste;
- molybdenum waste;
- tantalum waste;
- magnesium waste;
- cobalt waste;
- bismuth waste;
- titanium waste;
- zirconium waste;
- Manganese waste;
- Germanium waste;
- vanadium waste;
- hafnium, indium, niobium, rhenium and gallium waste;
- thorium waste;

B1020 Pure and uncontaminated debris of the following metals, including alloys, in finished form (lams, plates, beams, stems, etc.):

B1030 Refractory metals containing residues.
B1040 Agglomerated debris from the production of electrical energy and not contaminated by lubricant oils, PCBs or PCTs to the point of becoming dangerous.
B1050 Mixtures of non-ferrous metal residues (heavy fractures) that do not contain Annex I substances at concentrations such that they may have the hazard characteristics set out in Appendix III (8).
B1060 Residues of selenium and tellurium in basic metal form, including powders.
B1070 Residues of copper and copper alloys in susceptible form of dispersion, unless they contain substances in Appendix I at concentrations such that they may have the hazard characteristics set out in Appendix III.
B1080 Zinc cinders and residues, including residues of zinc alloys in susceptible form of dispersion, unless they contain components of Appendix I at concentrations such that they may have the H4.3 hazard characteristic in Appendix III (9).
B1090 Used electric accumulators meeting certain specifications, except those containing lead, cadmium or mercury.

B2010 Waste of mining operations in non-dispersal form:
- natural graphite waste;
- slate waste, whether or not debursed or simply debited, by sawing or otherwise;
- mica waste;
- waste of leukite, nepheline and syenite nepheline;
- feldspar waste;
- fluorine waste;
- silicon waste in solid form, excluding those used in foundry operations.
B2020 Glass waste in non-dispersal form:
- calcin and other waste and glass debris, except for glass from cathodic tubes and other activated lenses.
B2030 Wastes of ceramics in non-dispersal form:
- scrap and debris of cermets (metal/ceramic compounds);
- ceramic fibres, not otherwise specified.
B2040 Other wastes containing mainly inorganic substances:
- partially refined calcium sulphate from smoke desulfuration;
- waste of coatings or plaster plates from the demolition of buildings;
- slag from copper production, chemically stabilized, containing a significant amount of iron (super than 20%) and processed in accordance with industrial specifications (e.g. DIN 4301 and DIN 8201), mainly for construction and abrasive applications;

B3 Wastes with essentially organic components

B3010 Waste of plastics in solid form:
Plastics or plastics composed below, provided that they are not mixed with other wastes and are prepared according to certain specifications:
- plastic waste of non-halogenated polymers and copolymers including, but not limited to (13):
- ethylene;
- Styrene;
- polypropylene;
- polyethylene terephthalate;
- acrylonitrile;
- butadiene;
- polyacetals;
- polyamides;
- polybutylene terephthalates;
- polycarbonates;
- polyethers;
- polyphenylene sulphides;
- acrylic polymers;
- C10-C13 (plasticizers);
- polyurethane (not containing CFCs);

B3030 Waste of textile materials:
The following substances, provided that they are not mixed with other wastes and are prepared according to certain specifications:
- silk waste (including non-disposable cocoons, yarn waste and effilochés):
- not carded or combed;
- others;
- waste of wool or fine or coarse hair, including yarn waste, but excluding flakes:
- licks of wool or fine hair;
- other waste of wool or fine hair;
- waste of coarse hair;
- cotton waste (including yarn waste and garbage):
- wire waste;
- erased;
- others;
- flax waste cubes;
- hemp (Cannabis sativa L.);
- swabs and wastes (including yarn waste and garbage) of jute and other Liberian textile fibres (excluding linen, hemp and ramie);

B3050 Untreated cork and wood waste:
- sawdusts, waste and debris of wood, whether or not in the form of logs, briquettes and pellets or similar forms;
- cork waste: crushed cork, granulated or sprayed.
B3060 Wastes from food and agri-food industries, provided they are not infectious:
- lees of wine;
- plant and plant waste, residues and by-products, dried and sterilized, whether or not aggregated in the form of pellets, types used for animal feeding, not elsewhere specified or included;
- decay: residues from the treatment of fat or animal or vegetable waxes;
- waste of bones and cornillons, raw, degreased, simply prepared (but not cut into shape), acidulated or dégélatinated;
- fish waste;
- shells, pelicles and other cocoa waste;
- other waste from food and agri-food industries, excluding by-products meeting national and international requirements and standards for human consumption and animal feed.
B3070 The following wastes:
- hair waste;
- straw waste;
- fungus mycelium deactivated from production of penicillin, used for feeding animals.
B3080 Waste, grinding and rubber debris.
B3090 Rognures and other wastes of prepared leather or reconstituted leather, not usable for the manufacture of leather works, excluding leather sludges, not containing hexavalent chrome compounds or biocides (see corresponding entry in list A [A3100]).
B 3100 Powders, ashes, muds or leather flours that do not contain hexavalent chromium or biocides (see corresponding entry in list A [A3090]).
B 3110 Wastes derived from pelletry, containing no compounds of hexavalent chromium, biocides or infectious substances (see corresponding section of list A [A3110]).
B 3120 Wastes made of food dyes.
B 3130 Waste of polymer ethers and waste of unsafe monomer ethers and unable to form peroxides.
B 3140 Used tyres, excluding those for operations listed in Appendix IV A.


B4 Wastes that may contain components
organic or inorganic


B 4010 Wastes consisting mainly of water/oil paints, inks and hardened varnishes, containing no organic solvents, heavy metals or biocides at concentrations that can make them hazardous (see corresponding section of list A [A4070]).
B 4020 Wastes derived from the production, preparation and use of resins, latex, plasticizers or glues and adhesives, not included in List A and devoid of solvents and other contaminants so that they do not have the hazard characteristics referred to in Annex III, for example when they are made of water or amiin bases glues.
B 4030 Waste of disposable cameras after use with batteries not on list A.

(1) It should be noted that the corresponding entry in List B (B 1160) does not include exceptions. (2) This section does not include agglomerated waste from the production of electrical energy. (3) PCB concentration equal to or greater than 50 mg/kg. (4) The rate of 50 mg/kg is considered to be a practical international level for all wastes. However, several countries have individually set lower regulatory levels (e.g. 20 mg/kg) for certain wastes. (5) They are said to have not been used within the time limits recommended by the manufacturer. (6) This section does not include treated wood with chemicals for its preservation. (7) They are said to have not been used within the time limits recommended by the manufacturer. (8) It should be noted that, even in the case of low levels of initial contamination by Annex I substances, subsequent treatments, including recycling, could result in separate fractions with significantly higher concentrations of these substances. (9) The status to be granted to zinc ash is currently under consideration, and it is recommended by the United Nations Conference on Trade and Development (UNCTAD) that these ashs are not classified as hazardous substances. (10) This section does not include residues from the production of electrical energy. (11) Reuse may include repair, rehabilitation or reclamation, but not a major reassembly. (12) In some countries, materials intended for direct reuse are not considered waste. (13) It is understood that these wastes are fully polymerized. (14) This section does not cover waste produced after the consumption stage. Waste must be homogeneous. Problems arising from open air burning practices must be considered. (*) N.d.t.: The previous entry was repeated in the English version, probably by mistake. According to abbreviation, it should be "fluoroalkoxy alcane" (alcane alcoxyle monofluorinated).
