In view of Decree No. 70-239 of 19 March 1970, as amended by Decrees No. 76-689 of 21 July 1976 and No. 83-1058 of 24 November 1983, concerning the administrative and financial organization of the National Office for Information on Lessons and Professions (ONISEP);
Having regard to Decree No. 85-634 of 25 June 1985, as amended by Decree No. 93-921 of 12 July 1993 and No. 2002-699 of 30 April 2002, establishing the Centre for Studies and Research on Qualifications (CEREQ) in a national public institution with an administrative character;
In view of the amended Decree No. 85-986 of 16 September 1985 on the particular regime of certain positions of State officials and certain modalities for the final termination of functions;
In view of Decree No. 87-325 of 12 May 1987, as amended by Decree No. 2000-1017 of 12 October 2000, erecting the International Centre for Educational Studies (CIEP) in a national public institution with an administrative character;
In view of Decree No. 93-288 of 5 March 1993, amended by Decree No. 2000-32 of 14 January 2000 on the National Institute for Educational Research;
Considering Decree No. 2002-548 of 19 April 2002 on the National Centre for Educational Documentation and the Regional Centres for Educational Documentation;
Having regard to Decree No. 2002-602 of 25 April 2002 on the organization and operation of the National Centre for Distance Education;
Considering the advice of the Central Joint Technical Committee of the National Institute for Educational Research dated 18 May 2003;
Considering the advice of the Central Joint Technical Committee of the National Centre for Academic and Academic Works of 15 December 2003;
Considering the advice of the Central Joint Technical Committee of the Qualification Study and Research Centre dated 16 December 2003;
Considering the advice of the Central Joint Technical Committee of the International Centre for Educational Studies of 19 December 2003;
Considering the advice of the technical committee of the National Educational Documentation Centre dated 13 February 2004;
Considering the advice of the Central Joint Technical Committee of the National Centre for Distance Education dated 26 March 2004;
Considering the advice of the Central Joint Technical Committee of the National Office of Information on Lessons and Professions dated June 22, 2004;
The State Council (Finance Section) heard,
Decrete:
The following jobs are governed by this decree:
1. Deputy Director and Secretary General of the National Centre for Educational Documentation (CNDP);
2. Deputy Director and Secretary General of the National Information Office on Lessons and Professions (ONISEP);
3. Secretary General of the Qualification Study and Research Centre (CEREQ);
4. Deputy Director and Secretary General of the International Centre for Educational Studies (CIEP);
5. Secretary General of the National Institute for Educational Research (INRP);
6. Deputy Director of the National Centre for University and School Works (CNOUS);
7. Secretary General of the National Centre for Distance Education (CNED).
The appointment to these jobs is made, after notice by the director of the institution concerned, by order:
1. Minister for National Education for the CNDP and CIEP;
2. Ministers responsible for national education and higher education for the NISEP and CNED;
3. Ministers responsible for national education and employment for the RECEQ;
4. Ministers responsible for national education, higher education and research for the NPRI;
5. The minister responsible for higher education for the CNOUS.
The jobs mentioned in Article 1 are divided into two groups, Group I and Group II, by order of the ministers mentioned in Article 2 as well as ministers responsible for the public service and the budget.
Staff members recruited by the National School of Administration who have reached at least the gross index 701 and employees of a body, employment framework or employment whose terminal index is at least equal to the gross index 985 and who have reached at least the gross index 780.
The employment of deputy director and the employment of secretary general each have seven levels. The time spent in each ladder to reach the upper ladder is set at one year six months for the 1st, 2nd and 3rd ladders, two years for the 4th and 5th ladders and three years for the 6th ladder.
Only staff appointed in a position classified in group I can access the seventh step.
Officials appointed to these jobs are placed in a detachment position in their original body or employment framework.
They are classified at the level with an index equal to or default immediately higher than that of which they were in their original body or employment framework or in the employment they previously occupied.
However, where this appointment provides a gain lower than the one that would have resulted from a level advancement in their previous grade or employment, the persons concerned shall be classified at the level immediately higher than that determined under the previous paragraph.
Any employee appointed to any of these jobs may be removed from the job in the interest of the service.
Officials occupying the date of publication of this decree the jobs referred to in Article 1 shall be classified in accordance with the provisions of the second paragraph of Article 6, with the retention of their seniority within the limits of the duration of the services required for access to the higher level in the new employment.
The last paragraph of Article 13 of the above-mentioned Decree of 19 April 2002 is replaced by the following provisions:
"The Director General is assisted by two Deputy Directors. In the administrative and financial management of the institution, he is assisted by a secretary general. »
Are repealed:
1. The decree of 7 March 1968 referred to above, as it concerns the employment of deputy director of the National Centre for Academic and Academic Works;
2. Decree No. 81-379 of 15 April 1981 on conditions of appointment and advancement in the employment of Secretary General of the National Correspondent Education Centre.
The Minister of Employment, Social Cohesion and Housing, the Minister of Economy, Finance and Industry, the Minister of National Education, Higher Education and Research, the Minister of Public Service, the Minister Delegate for Budget and Reform of the State, spokesman of the Government, and the Minister Delegate for Higher Education and Research, are responsible, each with respect to the decree published, for the execution of the French newspaper
