Decree No. 2004-1126 of 15 October 2004 on compensation for staff performing international cooperation missions

The Prime Minister,
On the report of the Minister of State, Minister of Economy, Finance and Industry, Minister of Foreign Affairs and Minister of Public Service and State Reform,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
In view of the amended Decree No. 67-290 of 28 March 1967 setting out the modalities for calculating the emoluments of civil personnel of the State and public institutions in service abroad;
Having regard to the amended Decree No. 86-416 of 12 March 1986, setting out the conditions and conditions for the State to take charge of travel and change of residence abroad or between France and abroad of civil agents of the State and public institutions of the administrative State,

Personnel performing international cooperation missions abroad may receive a daily hardship allowance under the conditions and in accordance with the terms and conditions set out in this Order, with the exception of cooperative actions financed by multilateral funds.
By derogation from the provisions of Article 8 of the aforementioned Decree of 12 March 1986, the duration of the mission may be up to ten months.

The daily amount of the hardship allowance, paid per working day, is equal to the product of a reference amount, fixed by joint order of Ministers for Foreign Affairs, Public Service and Budget, assigned to a coefficient of expertise and a risk factor, defined in section 3 below.

The coefficient of expertise is modulated in a range of 1 to 2 to take into account the level of expertise of the agent, corresponding to his qualifications and the nature of the mission carried out.
The risk factor is modulated in a range of 1-3 to take into account mission and risk constraints, assessed by the Ministry of Foreign Affairs on a geographical basis.

The hardship allowance may be combined with the daily mission allowances paid under the above-mentioned Decree of 12 March 1986.
It is not cumulative with a supplementary remuneration of the same nature, nor with the residence allowance established by the decree of 28 March 1967 referred to above.

The personnel referred to in section 1 of this Order may claim the reimbursement of the transportation costs that they are liable to undertake on the occasion of the travels carried out within the framework of their mission, under the conditions established by the aforementioned Order of 12 March 1986.

The Minister of State, Minister of Economy, Finance and Industry, the Minister of Foreign Affairs, the Minister of Public Service and State Reform and the Secretary of State for Budget and Budget Reform are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
